SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5

Nature and/or Description of the Action Being Processed: New Requirement: GE Healthcare Hemodynamics.
Description of Supplies/Services Required to Meet the Agency’s Needs: The procurement is to upgrade the GE Healthcare Combolab and Maclab systems at Indianapolis VAMC to Windows 10 OS and supported Server OS. The procurement includes HL7 interfaces for the integration with the new electronic health record, Cerner. It includes the professional services to install, configure, and test the system. The procurement should also include training and necessary after hours and weekend work for go live.
The estimated value of the proposed action is $399,883.86
2. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:
(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The services and products required to upgrade the Maclab and Combolab systems are proprietary to the OEM, GE Healthcare and its authorized distributor, Trillamed. This is an upgrade of the current GE Healthcare Maclab and Combolab systems at the Indianapolis VAMC. The hardware and software must be compatible with the current GE Healthcare system and only the OEM or the authorized distributor can provide these proprietary services.

3. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: GE Healthcare is the OEM of the required equipment and has one SDVOSB distributor, Trillamed LLC.
4. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: GE Healthcare is the OEM and the price has been determined to be fair & reasonable and the items are listed on Contract VA797H-17-D-0024.
5. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: VIP queried using NAICS code 339112 along with keywords “hemodynamics” resulted in zero findings. GSA queried using keywords “hemodynamics” resulted in four findings. This is an EHRM-Cerner upgrade. The OEM is GE Healthcare and has one SDVOSB distributor.
6. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A
7. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
None, because of the additional cost for no additional benefit.
8. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required: N/A
9. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
