DESCRIPTION:THIS COOPERATIVE AGREEMENT PROVIDES ASSISTANCE TO THE STATE OF WASHINGTON'S LEAKING UNDERGROUND STORAGE TANK (LUST) PROGRAM. SPECIFICALLY, THIS AGREEMENT PROVIDES FUNDING FOR ITS LUST CORRECTIVE ACTION PROGRAM, WHICH INCLUDES ASSESSMENT, REMEDIATION AND ENFORCEMENT RELATED ACTIVITIES. THE MAIN OBJECTIVES OF THE LUST CORRECTIVE PROGRAM ARE TO INVESTIGATE SUSPECTED PETROLEUM RELEASES AND TO PERFORM CORRECTIVE ACTION ON THESE RELEASES. ACTIVITIES:LUST COOPERATIVE AGREEMENT FUNDS ARE TO BE USED TO ADMINISTER THE LUST PROGRAM; TO OVERSEE AND ENFORCE CORRECTIVE ACTION BY OWNERS OR OPERATORS; TO INVESTIGATE SUSPECTED PETROLEUM RELEASES; TO PERFORM DIRECT CORRECTIVE ACTION WHEN OWNERS OR OPERATORS ARE UNKNOWN, UNWILLING OR UNABLE TO PERFORM THOSE ACTIVITIES THEMSELVES; TO TAKE THE NECESSARY PROMPT ACTIONS TO PROTECT HUMAN HEALTH AND THE ENVIRONMENT; AND TO PURSUE COST RECOVERY ACTIONS FOR LUST TRUST FUND (LTF) EXPENDITURES, WHEN NECESSARY. ACTIVITIES TO BE PERFORMED INCLUDE (1) ADMINISTERING THE LUST COOPERATIVE ACTIVE PROGRAM; (2) OVERSEEING AND ENFORCE CORRECTIVE ACTION BY OWNERS OR OPERATORS; (3) INVESTIGATING SUSPECTED PETROLEUM RELEASES; (4) CLEANING UP RELEASES WHEN UST OWNERS OR OPERATORS ARE UNKNOWN, UNWILLING OR UNABLE TO PERFORM THE CORRECTIVE ACTION; (5) TAKING THE NECESSARY PROMPT ACTIONS TO PROTECT HUMAN HEALTH AND THE ENVIRONMENT; AND (6) PURSUING COST RECOVERY ACTIONS FOR LUST TRUST FUND (LTF) EXPENDITURES, WHEN NECESSARY.SUBRECIPIENT:NO SUBAWARDS ARE INCLUDED IN THIS ASSISTANCE AGREEMENT.OUTCOMES:ANTICIPATED DELIVERABLES INCLUDE FUNDING FOR LUST CLEANUP, WHICH IS ACCOMPLISHED THROUGH PROGRAMS SUCH AS (1) THE POLLUTION LIABILITY LOAN AND GRANT PROGRAM, (2) THE COMMERCIAL UST REINSURANCE PROGRAM, AND (3) THE TECHNICAL ASSISTANCE PROGRAM (TAP). THE EXPECTED OUTCOME IS TO OVERSEE THE CLEANUP OF PETROLEUM RELEASES FROM USTS AND TO SUPPORT THE DEVELOPMENT OF ENVIRONMENTALLY AND ECONOMICALLY SUSTAINABLE COMMUNITIES. THE POLLUTION LIABILITY ASSURANCE AGENCY (PLIA) HAS COMMITTED TO A LONG-TERM OUTCOME OF REDUCING THE LUST BACKLOG BY 50 PERCENT AT THE END OF 2034. THE PRIMARY DELIVERABLE IS THE STATE CLEANUP DATA THAT IS ENTERED INTO EPA'S LUST4 DATABASE SYSTEM. THE PRIMARY OUTCOME IS THE CLEANUP OF PEN LUST SITES, WHICH WILL REDUCE THE SIZE OF WASHINGTON'S BACKLOG. THIS COOPERATIVE AGREEMENT IS FOR A PUBLIC PURPOSE, AND THE PRIMARY, DIRECT BENEFICIARY IS THE STATE LUST CORRECTIVE ACTION PROGRAM WITH THE INDIRECT BENEFICIARIES BEING THE STATE'S RESIDENTS.
