This amendment is issued to add contract clause 1452.236-71 Additive or Deductive Items to Section L of clauses and replace clause 52-204-11 (MAR 2009) with 52.204-11 (MAR 2010 Deviation) in Section I of the clauses. Attached is the revised set of clauses that incorporates the above changes and that can be used to replace the set of clauses provided with the original solicitation issued on April 6, 2010.

This contract is for the installation of bat gates at abandoned mine portals on National Park Service (NPS) land in the New River National River near Glen Jean, Fayette County, WV.
This project will be administered through an Interagency Agreement between the NPS and the Office of Surface Mining, Pittsburgh, PA (OSM Project No: NPS-10-01)
NPS Recovery Act funding in the amount of $209,750.00 is available for this project. The Treasury Account Symbol for this funding is 14 1041
The North American Industrial Classification System (NAICS) code for this acquisition in 237990. The small business size standard is $33.5M.
A MANDATORY 3 DAY PREBID CONFERENCE IS SCHEDULED FOR 9:00 AM EACH DAY ON APRIL 20 - 22, 2010. A DETERMINATION WILL BE MADE AS TO WHETHER ALL 3 DAYS ARE NEEDED FOR VIEWING THE SITES AND PREPARATION OF BIDS AFTER FURTHER DISCUSSIONS WITH THE PROSPECTIVE BIDDERS IN ATTENDANCE. PROSPECTIVE BIDDERS ARE TO MEET AT THE NEW RIVER GORGE VISITOR CENTER LOCATED ONE AND A HALF MILES NORTH OF FAYETTEVILLE, WV ON THE NORTH SIDE OF THE BRIDGE.
Bids will be opened on May 6, 2010. An original hard copy of the completed and signed IFB along with a 20 % Bid Bond and Section K Reps and Certs, if applicable are due at the depository in 3 Parkway Center, Pittsburgh, PA 15220 on May 6, 2010 @ 2:00 pm. ONLY BIDS RECEIVED FROM THOSE ATTENDING THE PRE-BID CONFERENCE WILL BE ACCEPTED. Electronic and/or faxed bids will not be accepted.
Contractors doing business with the Government are required to have a DUNs number, register in the Central Contractor Registration at ccr.gov data base and complete on line representations and certifications at orca.bpn.gov. Award will not be made to a contractor who has not satisfied these requirements.

Work will consist of: mobilization and demobilization of the contractor's labor, equipment and materials; erosion/drainage control; site preparation; excavation; removal/disposal of existing gates; construction of concrete sills for gate bases; placement of wire mesh over stone and shale bedrock; covering fragmented rock and wire mesh with cement mixture; construction/installation of bat gates; and site restoration. Conveyance of construction material and equipment to sites may be accomplished using vehicles, helicopters, or other methods, subject to prior approval by the NPS Representative.This project will be administered through an Interagency Agreement between the NPS and the Office of Surface Mining, Pittsburgh, PA. Funds for this project were received by NPS under the American Recovery and Reinvestment Act of 2009 (Recovery Act). Treasury Account Symbol for this funding is 14 1041. Funding for the requirements described herein is limited to $209,750. The Recovery Act requires contractors to report on their use of Recovery Act funds. Contractors are required to register and report each calendar quarter on their use of Recovery Act funds using the centralized reporting tool at http://www.FederalReporting.gov . The Invitation for Bid (IFB) will be available to prospective bidders on or about April 5, 2010. The IFB will include the date, time and directions to the meeting place for the pre-bid meeting to be conducted on or about April 20, 2010. It is anticipated that bids will be opened on or about May 5, 2010 (an original hard copy bid will be due at the depository and on the date and time identified in the IFB. Work will consist of: mobilization and demobilization of the contractor's labor, equipment and materials; erosion control; site preparation; drainage control; excavation; removal and disposal of existing gates; construction of concrete sills for bat gate base; placement of wire mesh over fragmented siltstone and shale bedrock; covering fragmented rock and wire mesh with cement mixture; construction and installation of bat gates; and site restoration. Conveyance of construction material and equipment to sites may be accomplished using vehicles, helicopters, or other methods, subject to prior approval by the designated Park Representative.This project will be administered through an Interagency Agreement between the National Park Service (NPS) and the Office of Surface Mining (OSM), Pittsburgh, PA. All work will be performed on NPS land.Funding for this project is being provided by the NPS received under the American Recovery and Reinvestment Act of 2009 (Recovery Act).
