This solicitation seeks proposals to complete HVAC and electrical upgrades at an administration building located on the Pine Ridge Reservation in South Dakota. PROJECT TITLE: HVAC AND ELECTRICAL UPGRADES - BUILDING 159 PINE RIDGE AGENCY

Amendment to the Solicitation for the following;

1. Respond to questions submitted by 2/12/20

Is the project sales-tax exempt on equipment & material being used? No

Is 4 days 10 hours possible for the possible for the project? Yes

Does TERO TAX 4% should be added to the BID? Please confirm? Yes, it's an actual line item on the bid sheet

Do they provide office room for the meetings? Yes, there is a conference room that will be available for meetings.

Any FIRE ALARAM replacement is required for the project? No

4. To clarify the phasing of the work

In order to keep the building operational during construction, it will be necessary to phase the project and move people around accordingly. We estimated and confirmed with the building personnel that there is enough swing space to accommodate occupants temporarily during construction and maintain operations throughout. How ever the BIA staff will need to be given a minimum of one week to move prior to construction beginning on any phase of the project. The phasing plan is outlined below and it is important that the primary phases of the project start as soon as the heating season is over (late April) and must be completed prior to the start of the next heating season. The phasing is to be done as two primary phases with three sub phases. Completing all of the work in the boiler room is phase 1. All of this work can be done independently of anything outside the boiler room. The front ends of the new DDC system can be installed to run the boiler room equipment and expanded during the next phase to include the new terminal units.

Phases 2A and 2B will need to have at least some overlap but are split out into different phases due to the nature of the work. Phase 2C can be completed last.

Phase 1: Boiler Room - Approximately 90 days

Phase 2: Terminal Units - Approximately 120 days

2A: Rooms 115-119, 201-205

2B: Rooms 105-126,207-219

2C: Rooms 132-149

52.211-12 Liquidated Damages-Construction. (Sept 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $250.00 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor¿s right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause. (End of clause)

PROJECT TITLE: HVAC AND ELECTRICAL UPGRADES - BUILDING 159 PINE RIDGE AGENCY

BACKGROUND: The existing Administration Building is in need of HVAC and electrical upgrades. The Tribe does not have the option to contract this project under P.L. 93-638, Subpart J, therefore the Bureau of Indian Affairs is soliciting this work to be done on behalf of the Tribe. The Tribes does have a TERO Ordinance that will apply. The current TERO Tax is 4% and is due prior to the Notice to Proceed being issued. A copy of the Ordinance is attached for review and use.

DESCRIPTION: Contractor shall furnish the necessary personnel, materials, equipment and services as necessary to successfully complete the work as required by the contract documents and attachments. The building was built in 1967 and is approximately 20,000 square feet. The existing HVAC system also installed in 1967 and is scheduled for updating and replacement.

PROJECT LOCATION: The project is located in Pine Ridge, South Dakota, Shannon County.

MAGNITUDE OF PROJECT: In accordance with FAR Part 36.204, the Project Magnitude is between $500,000 and $1,000,000.

SOCIOECONOMIC PROGRAMS: This procurement is being set-aside as a Total Small Business Procurement. Only those vendors that are registered in SAM as a small business under the stated NAICS Code can submit a bid. Due to issues with SAM, all bidders will need to be registered and active at the time bids are due. Those not registered will be eliminated and determined as non-responsive.

NAICS CODE: This procurement is being issued under NAICS Code 238220, Plumbing, Heating and Air Conditioning Contractors, with a small business size standard of $16.5m.

PERMITS: Applicable Permits, archeological and environmental clearances have been acquired.

DATES: Bid Opening is set for February 27, 2020 at 3:00pm CT. The Government anticipates the award to be made by April 1, 2020. Notice to Proceed will be issued once bonding and insurance is provided, with 210 days to complete all work after Notice to Proceed (NTP) is issued.

SITE VISIT: A site visit has been scheduled for 2:00pm(MT), February 4, 2020. Additional information is available under Section L.

BONDING: FAR Clause 52.228-15, Performance and Payment Bonds-Construction, will apply, along with FAR Clause 52.228-1 Bid Guarantee. Contractor will also comply with the Davis Bacon Act.
