1. Contracting Activity: Department of Veterans Affairs, VISN 11, VA Ann Arbor Healthcare System, 506-15-2-1405-0126.



2. Nature and/or Description of the Action Being Processed: Base year plus 3 option year firm fixed price contract, for Functional MRI scans in support of a VA funded research project.





FAR13.5 Test Program: This procurement is for Functional MRI Scans in accordance with FAR 13.5 Test Program for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.





3. Description of Supplies/Services Required to Meet the Agency's Needs: Functional MRI scans in support of a VA funded research project. $193,970 contract total ($77,350 base year, $61,285 option year one, $36,295 option year two, $19,040 option year three. 5/1/2015 to 4/30/2019. Vendor, University of Michigan, PO Box 0614, Ann Arbor, MI 48109.

FAR13.5 Test Program: The authority for applying the Commercial Test Program of FAR 13.5 is (Section 4202 of the Clinger-Cohen Act of 1996) and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).











5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Functional MRI laboratory is the only MRI facility within a reasonable distance of both the VA Ann Arbor Healthcare System and University of Michigan (where the Principle investigator laboratory is located). There are three other FMRI units in Michigan, Wayne State University in Detroit, Butterworth Hospital in Grand Rapids and one at Michigan State University in Lansing.



In addition to the MRI machine itself, the FMRI has rooms available for post MRI testing that will ensure the highest quality data collection, post-processing, and analysis. Dr. Peltier has developed several unique post-processing methods that are central to the scope of the study.





6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: An intent to sole source was published to FBO with no responses.



7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: $193,970 contract aggregate total, or $595 per hour is fair and reasonable based on historical pricing for these services. Contract VA251-P-0924 awarded 9/30/2010 for $79,954.88 for FMRI scans shows similar pricing, $525 per hour.



8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A Market study was completed. FSS and the internet were searched, Vetbiz, SBA, were checked with negative results.



9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None



10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None



11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Should another requisition of this nature reoccur, a new market study will be completed. A sole source justification is required for the entire contract period to provide continuity of services for the ongoing research study.





12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
