About this opportunity

The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 21 is seeking to procure a sole-source contract for ENT Video Rhino-Laryngoscope leasing and preventative maintenance services. The procurement specifically involves leasing six video rhino-laryngoscopes, one telepack system, one camera head, and associated Karl Storz equipment that is compatible with existing devices already in use by the VA. The agency justifies the sole-source approach under FAR 13.106-1(b)(1) because only the specific Karl Storz equipment maintains compatibility with current light sources, monitors, and camera heads, ensuring uniformity and preventing duplication of costs. The solicitation requires that any competing vendors must provide authorized distributor documentation from the Original Equipment Manufacturer and proof that equipment can be serviced without voiding warranties. Responses to this notice of intent were due by June 23, 2025, at 11:00 AM Pacific Time, with the contract estimated for completion by July 31, 2030.

This procurement does not utilize any set-aside designation, though it specifically targets L1 Enterprises Inc., a Service-Disabled Veteran-Owned Small Business located in Frederick, Maryland, as the intended sole-source contractor. The contract structure includes a base year plus four option years running from August 2025 through July 2030, with an estimated total value of $40 million under NAICS code 532490 for commercial and industrial machinery rental and leasing. The procurement falls under PSC 6515 for medical and surgical instruments with a small business size standard of $40 million. Performance will take place in Fresno, California, where the leased equipment will support ENT procedures while ensuring compliance with VA sterilization and processing guidelines. The contract includes requirements for quick response times, loaner equipment provision during maintenance, and both preventative and corrective maintenance services throughout the lease period.

Notice text

This is a notice of intent to sole source a contract under the authority of FAR 13.106-1(b)(1), only one source being available to meet the Government’s need.  The contract is estimated for final completion by 07/31/2030.

The North American Industrial Classification System (NAICS) code for this procurement is 532490, Other Commercial and Industrial Machinery and Equipment Rental and Leasing with a small business size standard of $40 million.  The FSC/PSC is 6515 – Medical and Surgical Instruments, Equipment and Supplies.

The Department of Veterans Affairs intends to solicit and base plus four option year contract, firm fixed price contract for ENT Scope Lease (Video Rhino-Laryngoscopes) and Preventative Maintenance to L1 Enterprises Inc., 618 W PATRICK ST, FREDERICK, MD 21701 USA. There are no other sources that will satisfy agency requirements for the necessary items and services.

Only the necessary scopes manufactured by Karl Storz are compatible with already purchased devices which are only compatible with the specific light source monitor and camera head.  Lease of these scopes through L1 allow for uniformity of equipment and allows for current OR consumables to be spent without the duplication of costs to the Government.  These specific models also ensure appropriate equipment is in place for reprocessing/sterilization as not to compromise patient care.  Previous market research with the OEM shows that scope renewals are typically handled through the OEM but new lease requirements are deferred to Service Disabled Veteran Owned Small Business (SDVOSB), L1 Enterprises.

Any responsible source that feels it is capable in performing this requirement may submit a quote for the above listed items and describe and/or submit documentation to support your capabilities.  The response will be considered by the agency.  If you are not the Original Equipment Manufacturer (OEM), you must submit an authorized distributor letter signed by the OEM and/or proof from the OEM that equipment can be serviced and maintained without voiding current warranties.  Responses should be submitted to Leah Smith at leah.smith@va.gov no later than Monday, June 23rd, at 11:00 AM Pacific Time to be considered. The Government will not pay for information submitted. Any responses received will only be considered for the purposes of determining whether to conduct a competitive procurement in lieu of sole source contract described in this notice, and such determination shall be made at the sole discretion of the Government. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirement. If no responses are received, the government will proceed with the Sole Source acquisition.
