Added: Mar 27, 2014 3:59 pm Under the authority of Federal Acquisition Regulation (FAR) Part 15 - Contracting by Negotiation, the U.S. Environmental Protection Agency (EPA) Office of Enforcement and Compliance (OECA), Office of Civil Enforcement (OCE) anticipates issuing up to two competitive awards under NAICS code 541620 - Environmental Consulting Services.

The subject requirement provides technical, analytical, and enforcement support for EPA's Office of Enforcement and Compliance Assurance (OECA), Office of Civil Enforcement (OCE). OCE is charged with the development, litigation, and settlement of administrative and civil judicial cases against violators of the environmental laws pursuant to the: Clean Water Act (CWA); Safe Drinking Water Act (SDWA); Marine Protection, Research and Sanctuary Act (MPRSA); Clean Air Act (CAA); the Act to Prevent Pollution from Ships; Resource Conservation and Recovery Act (RCRA); Oil Pollution Act (OPA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Toxic Substance Control Act (TSCA); Federal Facility Compliance Act (FFCA); Emergency Planning and Community Right-to-Know Act (EPCRA); Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); Asbestos Hazard Emergency Response Act (AHERA); and Mercury-Containing and Rechargeable Battery Management Act (Battery Ac t).

OCE's activities are diversely implemented under these authorities and in accordance with federal environmental statutes. Major activities include the following: developing national policy and guidance for technical evaluations, investigations, case development and settlement strategies; developing management controls and data systems for assisting with enforcement of, and monitoring compliance with, all national enforcement initiatives and programs; targeting, developing and implementing compliance assurance activities to monitor and improve compliance of the regulated pollution sources; ensuring effective enforcement of environmental requirements; compliance monitoring, including on-site inspections and investigations of pollution sources; motivating the regulated community to voluntarily discover, disclose and correct violations; developing and implementing, in association with the National Enforcement Training Institute (NETI), enforcement related training and workshops; monitoring and enforcing federal, and federally-authorized, State programs; and providing support to Regions, States, Territories, Indian Tribes, and other regulatory authorities.

The resultant contract for the discussed requirement will contain a Limitation of Future Contracting (LOFC) clause, stipulating that: During the life of the contract, and for a period of seven (7) years after the completion of the contract, unless prior written approval is obtained from the cognizant EPA Contracting Officer, the Contractor shall not enter into a contract: (1) with owners or operators of facilities that may be impacted by enforcement and compliance activities performed under a Work Assignment, of the resulting contract, as regulated parties under the Clean Water Act (CWA); Safe Drinking Water Act (SDWA); Marine Protection, Research and Sanctuary Act (MPRSA); Clean Air Act (CAA); Resource Conservation and Recovery Act (RCRA); Oil Pollution Act (OPA); Pollution Prevention Act (PPA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Superfund Reauthorization and Amendments Act (SARA); Toxic Substance Control Act (TSCA); Federal Facility Compliance Act ( FFCA); National Environmental Policy Act (NEPA); Emergency Planning and Right-to-Know Act (EPCRA); Comprehensive Environmental Response, Compensation and Liability Act (CERCLA); Asbestos Hazard Emergency Response Act (AHERA); and Mercury-Containing and Rechargeable Battery Management Act (Battery Act); or (2) to act as a consultant to any such regulated parties that may be impacted by enforcement and compliance activities performed under Work Assignment, of the resulting contract.

This will be a recompete of the two previous contracts EP-W-09-032 with Leidos (formerly SAIC) and EP-W-09-033 with ERG. This procurement will be a full-and-open competition with no small business set-asides. The proposed acquisition is estimated at approximately 188,000 hours, including all options and optional quantities. The Government anticipates awarding two, five-year, cost-reimbursement type contracts, each for 50% of the total labor hours, in accordance with FAR Part 15: "Contracting by Negotiation Procedures." It is anticipated that the final Solicitation/SOW should be posted approximately mid-April, 2014. All responsible offerors may submit a proposal. Copies of the solicitation will be available on FedConnect and Fedbizopps. Paper copies of the solicitation will not be provided. An RFI (draft SOW)/Sources Sought was previously posted on September 19, 2013 (and updated on October 24, 2013) on EPA's website and Fedbizopps. It is the responsibility of interested parti es to regularly monitor FedConnect and Fedbizopps for updates to this procurement.
