About this opportunity

The National Institute of Standards and Technology (NIST) Acquisition Management Division has issued a Special Notice announcing its intent to negotiate a sole source contract with Photon Spot, Inc. for maintenance and repair of a Cryospot 4TS Cryogenic System. The contract opportunity, identified by the ID 3a2af9f4f6f249a599cdbfb1ddc7b29f, is classified under the NAICS code 334516 for Analytical Laboratory Instrument Manufacturing. NIST plans to award a firm-fixed-price purchase order to Photon Spot, Inc., located in Monrovia, California, under the authority of FAR Subpart 13.106-1(b). Market research determined Photon Spot, Inc. as the sole vendor capable of providing the specific commercial services required for maintenance and repair of the NIST-owned cryogenic system.

The primary objective of this Special Notice is to replace the RDK-205D Cold Head with a refurbished version and provide a 6-month warranty on the entire product. Interested parties who believe they can satisfy the requirement must submit a written response demonstrating their capability to lia.arthofer@nist.gov no later than May 27, 2025. NIST emphasizes that this notice is not a solicitation but rather an opportunity for potential contractors to prove their competitive capability. The agency justifies the sole source approach by highlighting that alternative maintenance and repair services would be less accurate and potentially cause unreasonable costs, delays, and system inoperability. If no competitive procedures are identified, NIST anticipates issuing the award in the 3rd Quarter of FY25. Contractors interested in responding must clearly and unambiguously communicate their ability to meet the specific requirements outlined in the Statement of Work.

Notice text

The National Institute of Standards and Technology (NIST) Acquisition Management Division intends to negotiate with Photon Spot, Inc. located in Monrovia, California on a sole source basis under the authority of FAR Subpart 13.106-1(b), soliciting from a single source, for Cryospot 4TS Cryogenic repair and maintenance.

Specific Requirements are as follows:

Item 1: Service Cryospot 4TS Cryogenic System, Replace RDK-205D Cold Head with Refurbished RDK-205D Cold Head, and provide a 6-month warranty on the entire product

This shall be provided and accomplished in accordance with the Statement of Work (SOW).

NAICS Code is 334516 – Analytical Laboratory Instrument Manufacturing, with a Size Standard of 1,000 employees. NIST anticipates negotiating and awarding a firm-fixed-price purchase order to Photon Spot, Inc. for this requirement.

Interested parties that can demonstrate they could satisfy the requirement listed above for NIST must clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition. If competitive procedures are not used it is estimated that an award will be issued 3rd Quarter of FY25. Any questions regarding this notice must be submitted in writing via email to lia.arthofer@nist.gov . All responses to this notice of intent must be submitted to lia.arthofer@nist.gov no later than the date and time provided herein this posting.

JUSTIFICATION FOR OTHER THAN FULL AN OPEN COMPETITION:

Market research resulted in Photon Spot, Inc. being the only vendor to provide commercial services for maintenance and repair of a NIST owned Cryospot 4TS Cryogenic System consistent with the statement of work provided herein. Maintenance and repair does not meet these specifications and tasks would be less accurate than what is required to proceed with the repair of the system, and NIST would have to attempt to develop something which would cause unreasonable costs, delays and lead to the Cryogenic system inoperable and would cause delays in ongoing research.
