About this opportunity

This pre-solicitation notice is seeking offers for 548 each transmission fluid coolers identified as National Stock Number 2520-01-098-5124. The Defense Logistics Agency Land and Maritime is procuring these items to support its mission requirements. Offerors must be able to meet the delivery schedule of 90 days for production units following a 90 day period for a first article test with 30 days allowed for government review. Proposals are due by March 25, 2020 and the award will be made based on a combination of price, delivery schedule, past performance, and technical approach.

There is no set-aside designation for this requirement. The small business size standard is 1,500 employees and this will be a full and open competition with a HUBZone price evaluation preference. Technical data for the item is export controlled and offerors must have an approved US/Canada Joint Certification Program certification to access such data. The delivery schedule requires shipment of the first article test unit within 90 days of award with production units due 210 days after award.

Item is being procured in accordance with:

Quantity: 548 EA with a 100% option

Unit of Issue: EA

Inspection/Acceptance: Origin

FOB: Origin – First Destination and Transportation (FDT) applies

Delivery Schedule: 210 days

The required delivery is 90 days for Production.  Item requires a Contractor First Article Test.  Delivery of FAT is 90 days with 30 days for Government review.  Total delivery with FAT requirement is 210 days.  Delivery will be 90 days with waiver of FAT.

One or more of the items under this acquisition may be subject to an Agreement on Government Procurement approved and implemented in the US by the Trade Agreements Act of 1979.  All offers shall be in the English language and in US dollars.  All responsible sources may submit an offer/quote which shall be considered..

This is a full and open competition with a HUBZONE price evaluation preference acquisition and will be solicited per FAR part 15. This is not set-aside for small business

This item has technical data some or all of which is subject to export-control of either the International Traffic in Arms regulations

(ITAR) or the Export Administration Regulations (EAR), and cannot be exported without prior authorization from either the Department of State or the Department of Commerce.  Export includes disclosure of technical data to foreign persons and nationals whether located in the United States or abroad.  This requirement applies equally to foreign national employees and U.S. companies and their foreign subsidiaries. The Defense Logistics Agency (DLA) limits distribution of export-control technical data to DLA contractors that have an approved US/Canada Joint Certification Program (JCP) certification, have completed the Introduction to Proper Handling of DOD Export-Controlled Technical Data

To be eligible for award, offerors and any sources of supply proposed for use are required to have an approved JCP certification and have been approved by the DLA controlling authority to access export-controlled data managed by DLA.  DLA will not delay award in order for an offeror or its supplier to apply for and receive approval by the DLA controlling authority to access the export-controlled data.

Based on market research this item is manufactured for military use only and is not commercial; therefore, the Government is not using the policies contained in FAR Part 12 in its solicitation for this item.  However, interested persons may identify to the contracting officer their interest and capability to satisfy the Government’s requirement with a commercial item with 15 days of this notice. 

While price may be a significant factor in the evaluation of offers, the final award decision will be based upon a combination of price, delivery, past performance and other evaluation factors as described in the solicitation.
