(ix)  The provision at FAR 52.212-2, Evaluation—Commercial Items (Oct 2014), applies to this acquisition.  Specific evaluation criteria is included below:

  1. Price; and
  2. Past Performance

FAR 52.212-2 Addenda:

A. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered, in accordance with FAR 12.602(c).

B. In order to be eligible for award, offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and evaluation factor requirements; and be deemed responsible in accordance with FAR Part 9. If an offeror fails to meet all solicitation requirements, the Government may not make an award to that offeror.

B. Two evaluation factors will be used to evaluate quotations: Past Performance and Price, wherein past performance will be evaluated on a basis significantly more important than price. This may result in an award to a higher past performance rating, higher priced Offeror where the decision is consistent with the evaluation criteria herein and constitutes best-value to the Government.

C. Evaluations shall be conducted as follows:

Step 1: Evaluate all quotations for responsiveness.

Step 2: Sort all responsive quotations based upon offeror’s Price lowest to highest.

Step 3: Evaluate lowest price offeror’s past performance. If past performance is evaluated at a “Satisfactory,” evaluation is complete. If the lowest priced offeror’s past performance is not “Satisfactory,” evaluate the next lowest priced offeror’s past performance. Continue evaluating next lowest priced offeror’s past performance until an offeror is rated “Satisfactory” or until all offerors are evaluated.

Step 4: Make a Best-Value decision based on performance evaluation and a determination that the price is fair and reasonable.

Factor 1: Performance

  1. The Government will review Attachment 2 Past Performance Worksheet on recency and relevancy.  Each offeror will receive an integrated overall performance rating.  Performance will be evaluated as a measure of the offeror’s ability to successfully perform based on previous and current contract efforts.

  2. Verification of performance information will be handled by any means available. In the event the 341st Contracting Squadron is unable to verify data submitted within Attachment 2 with the listed Contract Point of Contact, the Offeror will receive a performance rating of neutral for that reference as neither favorable nor unfavorable. In the event complete, acceptable offerors are unable to provide three (3) references, the missing references will be rated
neutral as neither favorable nor unfavorable.

  3. For the purpose of this evaluation, “recent” is defined as performance occurring within the last three (3) years from the date of release of this COMBO.  The following relevancy definitions apply to each citation reviewed:

Rating

Definition

Acceptable

Performance effort involved successful recruitment and placement of Aerobics Instructors with similar magnitude of effort and complexities as this COMBO requires.

Unacceptable

Performance effort did not involve successful recruitment and placement of Aerobics Instructor with similar magnitude of effort and complexities as this COMBO requires.

*Any reference that receives an “unacceptable” rating for relevancy will not be further evaluated.

  1. The Government may use performance information submitted by the offerors’ references, other sources such as other federal government offices, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reports (CPARS), and private, commercial sources, or any combination thereof.  The Government is not bound by the offeror’s opinion of relevancy.  Relevancy is defined above.  More relevant performance will be a stronger predictor of future success and have more influence on the performance assessment than performance of lesser relevance.

  2. The Government will evaluate/assess required performance information, positive and negative. Offerors will be offered the opportunity to respond to negative performance reports if they had not had the opportunity to do so previously.

  3. Each offeror will be assessed a Performance Assessment Rating for each reference and overall, which is described below taking into account the recency, relevancy, and quality of each citation reviewed:

PERFORMANCE ASSESSMENTS

 Marginal

Unsatisfactory

Factor 2: Price

  1. Price evaluation will document the fairness and reasonableness.

    1. The offeror’s proposed price will be determined by multiplying the quantity identified in section “v” by the proposed unit price.
    1. Price Reasonableness. The techniques and procedures described under FAR 13.106-3(a) will be the primary mean of assessing fair and reasonableness.

The instructor must be certified by one of the agencies as above for the type of class taught. Group exercise instructors must have and maintain a primary instructor certification issued by an AF recognized organization (listed above) in addition to any specialized training and/or certifications required for Commercial-Off-The-Shelf (COTS) or Extreme Conditioning Program (ECP) that includes CrossFit, P90X, Insanity, etc.

3.2 A current CPR certification is required from the American Red Cross or American Heart Association. There will be no substitutes allowed for CPR, per AFI 34-266.

3.3 At the start of the contract, the Contractor will provide a listing of current certified instructors to the Fitness Center Director to include name, contact number and e-mail address for all instructors and provide a copy of each of the required certifications for filing. Each time the Contractor provides the names of instructors to the Fitness Center Director to complete the schedule, any updated certification copies will be provided to the Fitness Center Director. If instructors’ certifications have expired, they will not be allowed to teach class.

3.4 The Contractor will arrange for any substitute instructors by calling 24 hours in advance of the class start time to notify the Fitness Center Director or representative. Recognizing that a 24-hour lead time is not always possible, this should be completed as soon as practicable. It is the responsibility of the Contractor to locate a suitable replacement instructor to teach the set class in a timely manner.

Per 3.1 and 3.2 above, substitutes must have current certifications in order to teach.

3.5 Contractor’s personnel must present a neat appearance and clothing must be safe for all operations involved in the contract performance and present a proper image in the military family fitness facility. Proper workout attire requirements are posted in the fitness center.

Notification of the move will be given to the Contractor at least one week in advance of the move if possible.

5. WORK DAY: The schedule is expected to provide seven (7) sessions per week, not to exceed 364 classes[BJMGUA3C2] . The Contractor is not to exceed the total amount of sessions designated in the contract for the year. Classes will not be scheduled on legal holidays, down days or family days. In addition, no classes will be held on Mother’s Day, Father’s Day, or during major inspections—TBD by the Fitness Center Director. The Fitness Center Director will notify the Contractor one week prior to anticipated class interruption, based on anticipated delays of instructors or class participants due to base exercises. The Contractor will be compensated on the actual number of classes held. All classes interfered by down days, family days or major inspections will be handled in accordance with FAR 52.212-4(f) Excusable Delays.

6. CLASSES: The Contractor will provide instructors who are certified to teach the classes, which will include, but are not limited to: Spinning, low impact, beginner step, intermediate step, advanced step, Step-n-Sculpt, Yoga, Kickboxing, Body pump, Pilates, Boot camp, and COTS ECP type classes. Any combination of these classes may or may not be offered. Due to changing military schedules, a minimum number of classes is not available. Classes will not exceed 50 minutes (not including the instructor picking up and returning the sign-in sheet).

7. SCOPE OF WORK: There will be one instructor per class. Instructors will teach low/intermediate/high varied impact aerobics or spinning to class participants. Instructors will use teaching methods that provide aerobic fitness for beginning, intermediate, and moderate fitness levels. Personal assistance and corrective techniques will be provided before and during classes.

7.1 Instructors must arrive in enough time prior to the scheduled class time to pick up the sign in roster at the front desk, prepare the facility and have participants sign in. When instructors cancel class because they cannot make it and do not get a substitute, then there is no pay due for that class. If an instructor arrives late or fails to show for the scheduled class, the Contractor will be notified and the instructor will be replaced with another instructor that will be found by the Contractor. Attendees expect the class to start on time so the instructor needs to be here on time. Class sign in sheets are the only way to guarantee correct payment. It is the instructor’s responsibility to turn in their class sign in sheet. If the Fitness Center does not receive a sign in sheet, payment may not be guaranteed. Fitness Staff will create a draft sign in sheet that includes the instructors name, time, date and name of class. If a drafted sign in sheet is not available, the instructor can use a piece of paper that includes the day, time, class name, instructor name and the signatures from class participants. If an instructor is subbing for another instructor, the subbing instructor must pick up the draft sign in sheet from the original instructor and cross off the original instructors name and list their own.

7.2 The instructors will safeguard all equipment and aerobic media that are used in their classes.

  8. After cool down, monitor heart rate to determine if heart rate is below 120 before participant starts the toning segment, if applicable.

  9. In certain aerobics classes, a toning segment will be included at the end, utilizing full use of all toning equipment available.

  10. The instructors will secure/close exterior door upon leaving and shut off lights, fans and stereo.

Contractors may direct questions to the help desk at:  http://www.ecmra.mill.

[BJMGUA3C1]PWS should not have PoP, that’s in the contract.

[BJMGUA3C2]This opens the door for the contractor to provide less than the need without ability of the Government to hold them accountable.
