PROCUREMENT SENSITIVE INFORMATION – FOR OFFICIAL USE ONLY

Justification and Approval for Other than Full and Open Competition under FAR Part 13

In accordance with FAR 13.106-1(b), a Contracting Officer may solicit without providing for full and open competition if the Contracting Officer determines that the circumstances of the contract action deem only limited sources reasonably available.

Per FAR 13.106-1(b)(2), this requirement is for supplies and services and exceeds the Simplified Acquisition Threshold (SAT) but is not greater than $7.5 million and the Contracting Officer reasonably expects, based on the nature of the supplies or services sought and on market research, that offers will only include commercial items.

1. Identification of the agency and the contracting activity:

Uniformed Services University of the Health Sciences (USUHS), Acquisitions Directorate

2. Nature and/or description of the action being approved:

Issuance of a sole source award. This will be a firm fixed price contract for a new award with a base and four option years using simplified acquisition procedures.

3. Description of the supplies or services required to meet the agency’s needs (including estimated value):

The Uniformed Services University’s (USU) Radiation Sciences Department (RSD) of the Armed Forces Radiobiology Research Institute (AFFRI) has a requirement for a five-year (base plus four option years) maintenance service contract with Xstrahl Inc. to maintain AFRRI’s Small Animal Radiation Research Platform (SARRP). The maintenance service contract includes:

● Two (2) Annual PMI (one (1) every six (6) months)

● All PMI Travel Costs

● All PMI Service Consumables

● Critical Software Updates (Ex new/separate products)

● Breakdown Labor and Travel

● All part covered including X-ray tube, CT flat panel detector

● Unlimited technical remote support via phone, email or team viewer

● Two (2) additional days of onsite applications training

The estimated value for this requirement is $292,635.00.

4. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The SARRP is a unique research platform within the Armed Forces Radiobiology Research Institute (AFRRI) and was manufactured by Xstrahl. Xstrahl is the only source that has the expertise and resources to service, repair, and update the unit as the entire system is proprietary. Service by a third-party vendor could jeopardize any certification, calibration or warranty provided by the manufacturer. Additionally, third party vendors do not have access

to the necessary drawings, parts, and software necessary to properly perform the work for the required maintenance services.

5. Procedures of FAR 13.5 were or will be used in accordance with 41 USC 1901 or the authority of 41 USC 1903 (including publicizing required justifications):

On April 12, 2023, USU posted a Notice of Intent to Sole Source to the Governmentwide Point of Entry (GPE) as required by FAR Subpart 5.2. USU received no responses.

6. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

For pricing information, USU has obtained a quote for this requirement from the proposed contractor. Historical pricing, pricing found in the commercial marketplace and/or recent redacted quotes from the contractor for similar requirements will be reviewed and utilized in an award memorandum decision document to ensure the Government is offered pricing that is fair and reasonable.

7. Description of market research conducted and the results, or a statement of the reason market research was not conducted:

Market research was conducted for this requirement and it was confirmed that no other vendor is capable of fulfilling the Government’s requirement. Due to the proprietary nature of the SARRP, Xstrahl Inc. is the only source capable of fulfilling the Government’s requirement.

USU inquired if Xstrahl uses any vendors for service and maintenance of their equipment or if they have a service distributorship. Xstrahl stated all service and maintenance for the SARRP is accomplished internally and not other vendor is authorized to perform SARRP service and maintenance.

8. Any other facts supporting the use of other than full and open competition (see FAR 6.303-2(b)(9) for examples):

9. Listing of the sources, if any, that expressed, in writing, an interest in the acquisition:

No other sources have expressed an interest, in writing, in the proposed acquisition.

10. Statement of the actions, if any, the agency may take to remove or overcome any barrier to competition before any subsequent acquisition for the supplies or services required:
