JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Ship Support and Services Division (N102).

2. Description of the Action Being Approved: The action is a Justification and Approval (J&A) to execute a second bridge action for an additional twelve (12)-month Period of Performance for Worldwide Logistics Support Services.

3. Description of Supplies/Services: MSC requires Worldwide Logistics Support Services in the functional areas of: Corrective Maintenance Logistics System (CMLS) support, Combat Logistics Force (CLF) Load Management, Material Handling Equipment (MHE) and Ordnance Handling Equipment (OHE). The estimated dollar value of the instant requirement is and will be funded by FY22 and FY23 Navy Working Capital Funds (NWCF) and Transportation Working Capital Funds (TWCF).

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C § 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a)(2)(iii)(B).

5. Rationale Justifying Use of Cited Authority: The incumbent contractor is currently performing global

Logistics Support Services for MSC under an executed bridge action under Contract N3220520C4008.

The Period of Performance for the bridge action expires 19 June 2022. In order to mitigate the risk of a lapse in mission-critical support services, a second bridge contract action is required to allow MSC adequate time to execute the follow-on contract action. MSC anticipates the award of the follow-on contract action to exceed one year from requirement generation to contract award with an anticipated award date of April 2023. The incumbent because it has the corporate knowledge and has the appropriate number of personnel strategically placed throughout the world to ensure continuity of the required Logistics Support Services. Additionally, the contractor has access to infrastructure which is necessary to perform the required services worldwide. There is insufficient time to execute the follow-on contract action, conduct the required phase-in operation prior to the completion of the current period of performance and mobilize contractor support personnel worldwide. Should mission-critical services lapse, ship life cycle logistics support, MHE/OHE support, CMLS support, CLF Load Management, and the other vital support that are critical to the MSC Government Owned/Government Operated (GOGO)/Government Owned/Contractor Operated (GOCO) fleet, sustainment of Navy/coalition forces, and centralized shipboard support services would be severely impacted and could lead to mission failure.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: MSC will post the Notice of Intent to Sole Source and the J&A at the Government Point of Entry, SAM.gov, website to notify industry that the Worldwide Logistics Support Services will continue as a Sole-Source effort, and that MSC will take steps to compete the follow-on effort.

7. Determination of Fair and Reasonable Cost: In accordance with FAR Part 15, the Contracting Officer will make, prior the executing the bridge, a determination that the costs of the supplies/services are fair and reasonable.

8. Market Research: In accordance with FAR Part 2.101, this requirement is for the acquisition of commercial services. The majority of the needed services are similar in nature to services regularly provided in the commercial marketplace (e.g., life cycle logistics, MHE/OHE and supply chain management services). On 15August 2021, an internet search at https://www.blumeglobal.com, revealed numerous commercial sources are capable of providing these types of logistic services. The services are offered and sold competitively and in substantial quantities in the commercial marketplace based on established catalog or market prices for specific tasks performed or specific outcomes to be achieved and are under standard commercial terms and conditions. Additionally, the incumbent contractor has been providing the commercial logistics services for MSC for the past fourteen (14) years.

9. A Listing of the Sources, if any that expressed, in writing, an interest in the Acquisition: No sources have expressed an interest in writing.

10. Actions to Remove Barriers to Future Competition: The follow-on procurement package is currently being developed. The anticipated award date of the follow-on competitive contract action is 12 April 2023. The Government anticipates holding a pre-proposal conference with all interested parties prior to proposal submission.
