About this file

This is a Worker Protection and Investment Certification Form (BOP 2201) issued by the Commonwealth of Pennsylvania requiring compliance documentation from contractors and grantees. The certification applies to the Interstate Secondary Herbicide Services contract opportunity with PennDOT and mandates that all contractors verify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws. Contractors must certify adherence to thirteen specific labor regulations, including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and the Construction Industry Employee Verification Act, among others.

The certification requires an authorized company official to sign and date the form, confirming the contractor's compliance status with all listed Pennsylvania labor laws. The Commonwealth has established significant penalties for false certifications, including contract termination and three-year ineligibility to bid on future contracts under Pennsylvania's debarment and suspension statutes. Certifying officials must understand that any false statements are subject to criminal penalties under 18 Pa. C.S. § 4904 (Unsworn Falsification to Authorities), and they are obligated to report any changes in the contractor's compliance status to the Purchasing Agency immediately.
