DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, CBG-3800, Acquisitions Division, Supply and Services Branch, Sacramento CA 95825
2. Name and Address of Single Source. This is a firm-fixed-price requirement for garbage disposal services. This requirement will be awarded as a single source to Waste Management of Oregon, Inc.
3. Description of Supplies/Services and Estimated Cost. This is a requirement for disposal of the solid waste from the KBAO Bureau of Reclamation property. The Reclamation property is located at 6600 Washburn Way, Klamath Falls, OR 97603. The period of performance will be August 1, 2024 through July 31, 2029 and the estimated cost is

IAW FAR 13.106-1(b)(1)(ii), an exclusive Franchise Agreement is in place between Klamath County and Waste Management for the area in which Klamath Basin Area Office is located.
Therefore, Waste Management is the only source available in Klamath County.
An Intent to Sole Source was posted on SAM.gov on 03/15/2024 and closed on 3/29/2024.
We received one (1) response from a vendor that provided a capabilities statement with little evidence that they can provide garbage removal services. However, a search on FPDS-NG showed they have one waste management contract with the National Parks Service. A search was conducted via SBA – Dynamic Small Business Search, utilizing search criteria of NAICS 562111, location: “Oregon”, and keyword “waste & garbage,” which resulted in thirty (30) profiles of small businesses. The only qualified company that can provide garbage removal service is Waste Management of Oregon, Inc. due to an exclusive Franchise Agreement is in place between Klamath County and Waste Management for the area in which Klamath Basin Area Office is located.
5. Determination of Fair and Reasonable Price. Prices and rates are set by law or regulation.
