WBR 1413.106-1 Template 1 (11/2020)
DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity. Department of the Interior, Bureau of Reclamation, Acquisition and Assistance Operations Branch, Denver, Colorado.
2. Name and Address of Single Source. Reclamation anticipates the award of a firm fixed-priced purchase order to be awarded utilizing FAR Part 13 and 12 Procedures. This will be solicited as a single source requirement to Performance Software Associates, Inc. P.O Box 2655 Littleton, CO 80161.
3. Description of Supplies/Services and Estimated Cost. This requirement is for the renewal of software maintenance for Anchor Software Licenses. The Central Valley Operations Office currently have Anchor Software Implemented. This maintenance provides systems software and technical support which are critical to support the regions Supervisory Control and Data Acquisition (SCADA) systems also known as the Central Valley Operations Automated Control System (CVAS).
4. Description of Circumstances, including why only one source is reasonably available.
The Central Valley Operation's Office previously purchased Anchor Software that was designed specifically for the compilation of special operating conditions and functions based on the operation needs of the CGB hydro generation facilities. Lack of Support for the software would require the reverse engineering of the proprietary logic and configuration of the software. During this time the automated unit control and remote switchyard indication functions would be unavailable. A disruption in service could disrupt and negatively impact Reclamations current compliance activities and Reclamation could potentially be non-compliant for the North American Electric Reliability Corporation Critical Infrastructure (NERC) Protection (CIO) Standards.
5. Determination of Fair and Reasonable Price. The contracting officer will perform necessary price analysis techniques such as a comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13.106-3 (a)(2)(ii)), market analysis for similar items in the industry (FAR 13.106-3(a)(2)(i)), and/or review of current price lists or catalogs (FAR 13.106-3(a)(2)(iii)) will be employed, if deemed necessary in further assuring that the government will receive the best value for its dollars.
