Limited Sources Justification or

Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold

(Simplified Acquisition Threshold is $150K)

1. Contracting Activity: Control Number: 16-RHCO-P-11, William Beaumont Medical Center (WBAMC), TX is requesting approval of a sole source contract to Depuy Synthes for patient specific surgery implants. Period of Performance 14 Jan 2016 – 30 Sept 2016.

2. Description of Action:

Requirement: New Repeat Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: _________ Total Dollar Value: $150,000.00

3. Description of Supplies/Services: The doctor/surgeon at WBAMC is requesting a sole source purchase to Depuy Synthes for various trauma, craniomaxillofacial and legacy Synthes spinal implants & supplies for specific patient cases. This required implants and supplies are prescribed by the patients’ physician/surgeon and determined to be best suited to meet the patient’s medical, health and life-style needs. The doctor/surgeon is both skilled and trained on these products to ensure that they meet the patient critical care needs.

4. Authority Cited:

xx (a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

5. Reason for Authority Cited: The doctor/surgeon did not evaluate any other vendors since Depuy Synthes Sales Inc. is the only vendor that can provide specific trauma implants and surgical instruments for each unique patient case for required surgery. FAR 13.106-1(b)(1)(i), applies to this procurement because, Depuy Synthes Sales Inc. has the required item, and has confirmed they can provide the implants in time for each surgery. By awarding directly to Depuy Synthes Sales Inc, the Government has reduced liability risk, and ensures this vital item will be received in time for an increased likelihood of successful surgery, recovery, and quality of life for the patient.

6. Actions to Increase Competition: A general competitive effort was made by the surgeon and attending team throughout the requirement review process which considers the applicability of products from various sources to determine the product that best meets the needs of the patient. This effort for this requirement definition level is not publicized on Federal Business Opportunities in accordance with FAR 5.201, but is standard industry practice. Efforts to obtain competition are not practical because this requirement is needed for surgery scheduled based on patient needs, and does not lend itself to pre-planning. Due to the critical nature of patient care the cartilage cell implant re-implantation surgery is considered mission critical to the MAMC health care mission. In addition, the intended contractor is the only source capable of meeting the surgeon’s requirements in a timely manner.

7. Actions to Increase Competition: This is a one-time purchase.

8. Market Research: This requirement is for surgical supplies (Class VIII). Details, including key word searches, are described in the Market Research Report that supports this J&A, found at PCF 01.01_Market_ Research and submitted with the J&A for review purposes. Research has been conducted by the MAMC doctor/surgeon and with Depuy Synthes Sales Inc. for “trauma implants” under NAIC Code “339113”.
