FAR SUBPART 8 JUSTIFICATION AND APPROVAL

FOR

BRAND NAME

Program/Equipment: Purpose of requirement is to provide supplies to support the transition from a Stand-Alone CAIRS Unified Communications Management (UCM) system at Fort Gordon, GA, to the NetPlus-based Telecom Management Solution (TMS) hosted at Fort Drum, NY.

Authority: Federal Acquisition Regulations (FAR) 8.405-6(b)(1) Application- Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

JUSTIFICATION AND APPROVAL

FOR

BRAND NAME

1. Contracting Activity: Army Contracting Command-Aberdeen Proving Ground, Huachuca Division, 2133 Cushing Street, Building 61801, Room 3410, Fort Huachuca Arizona 85613-7070.

2. Description of Action: This is a new requirement for a Brand Name NetPlus based Telecom Management Solution hosted at Fort Drum, New York Network Enterprise Center. This procurement is proposed to support the transition from a Stand-Alone CAIRS Unified Communications Management (UCM) system at Fort Gordon, GA, to the Ventraq Corporation NetPlus-based Telecom Management Solution (TMS) hosted at Fort Drum, NY. The 93d Signal Brigade implemented a brigade-wide contract to serve as the Command's TMS for effectively managing an installation's telecom infrastructure and providing a single solution for monitoring, managing, and reporting telecom services across multiple installations. This procurement requires the use of NetPlus TMS licenses in order to utilize the Fort Drum hosted solution. The contractor shall be responsible for establishing all IP switch connections from Fort Gordon to the TMS primary site at Fort Drum using Government-provided IP addresses and appropriate switch logins with permissions. Legacy Army switches requiring serial connections will employ contractor-provided TeleBoss 850 JITC IP-to-serial (RS-232) conversion devices.

Pricing/Contract Type: This will be a Fixed Price Contract.

3. Description of Services or Supplies: This procurement is proposed to support the transition from a Stand-Alone CAIRS Unified Communications Management (UCM) system at Fort Gordon, GA, to the Brand Name NetPlus-based Telecom Management Solution (TMS) hosted at Fort Drum, NY. This procurement requires the use of the Brand Name NetPlus TMS licenses in order to utilize the Fort Drum hosted solution Products are listed below:

5. Reasons for Authority Cited:

NetPlus Telecom Management Solution (TMS) is the only solution that will allow the Fort Gordon telecommunications infrastructure to tie into the Fort Drum hosted TMS servers. Other vendors could only provide a stand-alone solution for Fort Gordon, which degrades the ability of the Brigade to monitor, manage, and report telecom services across multiple installations. Additionally, the NetPlus TMS solution is web-based and only requires the applicable licenses to monitor the applicable systems and hardware. Other solutions would require the Fort Gordon to set up separate servers and install applications on computer workstations for monitoring, managing and reporting telecom services. This would increase the sustainment cost to the NEC in terms of manpower for managing the servers and installing and patching of applications on the user workstations. It is in the best interest of the Government this contract be awarded specifying the use of NetPlus TMS in the solution.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 will apply.

7. Market Research: Market Research was conducted via internet on 17 May 2019 to determine if there were other small businesses that could provide the requested service.

The following Market Research Techniques were used:

- Using the North American Industry Classification Code (NAICS) “517311”, the Small Business Administration (SBA) website revealed that there were several small businesses that could satisfy this requirement. However, in accordance with FAR 8.405-6(b)(1), the Brand Name item specification for Fort Gordon Telecom Management Solution at least 2 small businesses can meet the requirement.

- Contacted knowledgeable people (Government and industry) in specific markets.

- Used Internet tools and performed Web searches by searching Google Search engine to see how many various NetPlus products were available in the market.

Prices were found online google shopping ranging from $389 and more, but the pricing did not meet the Brand Name Net-Plus Based Telecom Management Solution requirements. Quantity discounts are available to the government.

Forces that may lead to lower prices would be the company having an overstock supply of NetPlus based products that must be sold.

- Posted Sources Sought on FedBid (Unison) and FedBizzOpps.

Historical data revealed that the Brand-Name NetPlus-based Telecom Management Solution for Fort Drum, New York is available through at least 2 small businesses.

Furthermore, the google search engine was used to check out the various types of NetPlus products available in the market. Results revealed they did not meet all of the salient characteristics specified by the customer.

8. Efforts to Obtain Competition: This is a brand name item peculiar to one manufacturer. After conducting a sources sought, results revealed that there are at least 2 small business that can supply the Brand-name item, therefore, this action will be synopsized and competition will be applicable.

9. Other Facts:

Class J & A: This Class J&A will cover all future actions for these items/services (as appropriate). Each action will be supported by a memorandum for record stating the action is within the scope of the class J&A in each contract file.

10. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.

11. Contracting Officer Certification/Approval:

I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based upon price analysis evaluation.

I certify that this justification is accurate and complete to the best of my knowledge and belief, and that completing this purchase as a Brand Name is in the best interest of the Government. Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
