FAR Part 6 Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: Army Contracting Command – Aberdeen Proving Ground (ACC-APG), Building 4310, 6515 Integrity Court, Aberdeen Proving Ground, Maryland 21005-3013
2. Description of Action: The US Army Office of Business Transformation requests a firm-fixed-price follow-on contract to W91CRB-16-P-0029 with Upland Software, Inc., 401 Congress Ave #1850, Austin TX, 78701. The Government projects award in April 2019 and fiscal year 2019 OMA funds will be used.
This action is a follow-on to contract W91CRB-16-P-0029. That contract was not competed under authority (FAR) 6.302-1(a)(2) “Only one responsible source and no other supplies or services will satisfy agency requirements.” Paragraph, “Actions to Increase Competition” of the previous justification, stated: those actions were not accomplished due to: In 2006, the Secretary of the Army and Chief of Staff of the Army directed that the Army utilize PowerSteering software as the system of record as the project and portfolio management system for capture and tracking of Lean Six Sigma projects for the Army’s Lean Six Sigma program.
3. Description of Supplies/Services: This purchase request is for annual maintenance and level-one help desk service for the Power Six Sigma Software. This software tracks and gathers data on Lean Six Sigma (LSS) projects as they are created by the Army’s Business Transformation Team.
The total estimated value of the proposed action is $698,900.63
Base Period: 4/15/2019 to 4/14/2020 Value: $225,000.00 Option Period 1: 4/15/2020 to 4/14/2021 Value: $232,875.00 Option Period 2: 4/15/2021 to 4/14/2022 Value: $241,025.63
4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.
Upland Software Inc, holds exclusive license agreements to their PowerSteering software. They are the only firm with expertise to provide license maintenance and remote hosting support, provided in this effort.
In 2006, the Secretary of the Army and Chief of Staff of the Army directed that the Army utilize PowerSteering software as the system of record as the project and portfolio management system for capture and tracking of Lean Six Sigma projects for the Army’s Lean Six Sigma program. Since this time, the Army has invested over $2M in upgrades and annual maintenance for a perpetual license for use by the Army’s Continuous Process Improvement/Lean Six Sigma program.
This proprietary software is in direct support of the project tracking requirement related to the Army’s Continuous Process Improvement/Lean Six Sigma program, which supports the Army Business Transformation to successfully track the stats of all Business Transformation, CPI/Lean Six Sigma projects Army-wide. Due to the Upland Software I, Inc. helpdesk support and software upgrades requested, if this support is not continued, the Army will be left without the support it needs to effectively maintain the Lean Six Sigma project System of Record, thereby threatening the success of the Army Business Transformation project and the Secretary of the Army’s Business transformation goals. A lack of continued support will cause an extreme amount of rework by Army employees to compensate for required changes within the software. The Government would also risk duplicating efforts resulting in the expenditure of unnecessary manpower and funds.
No other IT system in the Army is capable of capturing the Army’s Continuous Process Improvement and Lean Six Sigma projects, for the whole Army. Without this specialized software for use by over 40,000 Army users, the Secretary of the Army’s goals of Business Process Improvement will not be reportable or trackable. A lack of this support effort will cause rework by Army government employees to compensate for required changes that the software would otherwise track. Without this reporting capability, there would not be possible the required update to the Army’s annual “Report to Congress”.
6. Efforts to Obtain Competition: Upland Software I, Inc. is the sole proprietor of PowerSteering software Enterprise-wide License that the Army operates. The proposed Enterprise license maintenance and Enterprise helpdesk support, for the PowerSteering Enterprise license, that the Army operates, can only be provided by Upland Software I, Inc. A Notice of Intent to Award Sole Source was posted to FedBizOpps on 19 March 2019. No responses were received.
a. Effective Competition: Because this is a sole source action, effective competition is not applicable.
b. Subcontracting: No subcontracting is anticipated.
7. Actions to Increase Competition: Market research is being conducted on a yearly basis to see if there are any products available that will meet the government’s needs. To date, only Upland Software can provide PowerSteering software and no interest has been shown by other vendors for this service.
8. Market Research: The Business Transformation Office researched the following products: LeanView, InStanis, Primevara, CA Technologies PPM, PowerSteering and Microsoft Project. After review by the Business Transformation Office concluded that PowerSteering was the only vendor that met the requirements that were initially outlined by the team.
In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), A notice of intent to award a sole source contract to Upland Software was posted on FedBizOpps.gov on 13 October 2015 for 30 days and no other vendors submitted a response. No vendors, other than PowerSteering, could support the currently installed enterprise license that drives the current CPI/LSS capability in the Army. Significant re-training, expense and capability tradeoff would occur if another vendor product was utilized in place. Summary:
LeanView: No project management capability, geared towards process mapping management only.
Oracle’s Instantis Enterprise Track: No task level approval method for advancing a work flow to a completed state.
Oracle’s Primevara: No Lean Six Sigma focus towards gated project flow. No ability to configure role based approvals to advance through a sequential requirement list.
CA Technologies PPM: No Lean Six Sigma focus towards gated project flow. No ability to configure role based approvals to advance through a sequential requirement list.
Microsoft Project: No Lean Six Sigma focus towards gated project flow. No ability to configure role based approvals to advance through a sequential requirement list.
9. Interested Sources: Unable to entertain interested sources due to proprietary rights of the software preventing other vendors from acquiring the code. To date, no other sources have written to express interest in the acquisition.
