Tolemaida’s Compound Maintenance Services
PART 1
General Information
1. GENERAL: This is a non-personnel services contract to perform general maintenance for the Advance Operating Base (AOB) for US compound located on Tolemaida, Cundinamarca Department Colombia. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The scope of this contract includes: monthly maintenance for air conditions units, toilets, showers, water pumps, generators, refrigerators, grade stove, automatic gate, fans, propane gauge, vector control and kitchen area and laundry room. These services are to be provided and delivered to the above mentioned location with the approval and coordination of the using activity.
1.2 Background: The US Embassy to Bogota’s Military Group (MILGP) AOB team has a compound located at Military Base at Tolemaida that needs general maintenance in accordance with this PWS.
1.3 Objectives: The purpose of this requirement is to provide maintenance for mission critical base facilities and equipment for current operations in Tolemaida military installation.
1.4 Scope: The scope of work includes the maintenance in the compound for the following items:
1. Twenty-five, (25) air conditioning units.
2. Twenty three (24) toilets
3. Twenty one (21) showers
4. Two (2) five thousand liter water tanks and three (3) three thousand liter water tanks,
5. Two (2) water pumps
6. Two (2) generators with their ATS (Automatic Transfer Systems)
7. Two (2) refrigerators
8. One (1) grade stove
9. Two (2) Front Automatic Gates and Two (2) Manual Gates
10. Fans and Extractors
11. One (1) Propane Gauge
12. Vector Control
13. Kitchen Area and Laundry Room
14. Grass Cutting Service
15. Janitorial Service
16. Maintenance for Lighting system (external and internal lamps)
17. Electrical Network (Transformers, panelboards, receptacles, Lightning and grounding system)
18. Extinguisher fires (Refilling according to the requirement)
19. Fuel system
20. Fence
21. Internet service
22. Reimbursable Funds
1.4 Period of Performance: The period of performance shall be for one (1) year as follows:
28 September 2015 – 27 September 2016
1.6 General Information
1.6.1 Quality Control The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. Within 15 days after contract award the contractor shall provide the QCP. If the contractor makes any changes, three copies of a comprehensive written QCP shall be submitted to the KO and COR within five working days when changes are made thereafter. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.
1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards shall be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.3 Recognized Holidays: The contractor is not required to perform services on the following holidays:

1.6.4 Hours of Operation: The contractor is responsible for conducting business, between the hours of 08:00 a.m.
until 5:30 p.m. Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor shall not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
The Contractor shall respond to all on-site service calls within 2 hours. In the case of major/emergency repairs, the Contractor shall provide a replacement or service within 24-hours of notification in a 7x24 modality.

1.6.6 Type of Contract: The government shall award a hybrid contract that is a combination of Firm Fixed Price
(FFP).
1.6.7 Security Requirements: Contractor personnel performing work under this contract must request all permissions and authorizations in order to get into the Compound at Tolemaida, Cundinamarca Department, Colombia. All staff working on this contract will meet the requirements and laws of the Ministry of Social Protection (EPS, ARL, etc.).
1.6.7.1 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.
1.6.7.2 Key Control (N/A).
1.6.7.3 Lock Combinations (N/A).
1.6.8 Special Qualifications: The contractor must possess experience in general maintenance of facilities.
1.6.9 Government Representative (GR): The Government Representative monitors all technical aspects of the contract and assists in contract administration. The GR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the GR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the GR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The GR is not authorized to change any of the terms and conditions of the resulting order.
1.6.10 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.7 Refusal of Services and Termination of Contract: The Government reserves the right to refuse services from the contractor if the maintenance performed or being performed is deemed inadequate, dangerous, hazardous, or not to standard. If maintenance being performed or already performed has been deemed as such by any US Government employee receiving the services, the government can refuse the service and the contract will be terminated and the contractor will not be allowed to perform future maintenance or work for the US Government. The Government also reserves the right to terminate this contract if the contractor’s actions or work ethic is deemed questionable, unreasonable, or suspicious by the government personnel receiving the services.

DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1. DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. GOVERNMENT REPRESENTATIVE (GR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have private of contract with the subcontractor.
2.1.12. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.
2.1.13. WORK WEEK. Monday through Friday, unless specified otherwise.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.2 Facilities: Shall provide storage area for consumable supplies and minor equipment.
3.3 Utilities: Shall be provided at no cost.

PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1 General: The Contractor shall furnish all supplies, equipment, and services required to perform work under this contract that are not listed under Section 3 of this PWS.
4.2 Secret Facility Clearance: N/A.
4.3 Materials: See paragraph 4.1
4.4. Equipment: See paragraph 4.1
PART 5
SPECIFIC TASKS
5. Specific Tasks:
5.1. Basic Services. The contractor shall provide services of the following tasks:
Maintenance for Twenty Five (25) Air Conditions Units
1. Change and Installation of twenty five (25) Mini split Air Conditioner, Inverter type, Including uninstalling current equipment; Cover of current hole with similar material to the container's wall. Includes new kit, electrical connection and necessary accessories, 2 years Warranty.
2. Clean Air Filters every month
3. Check, rinse and clean inside and outside units monthly
4. Check AC Gas levels monthly per units
5. Emergency Calls for AC units will be fixed immediately
6. If any replacement item is needed it will be subject to Government Representative approval.
Maintenance for Twenty Four (24) Toilets
1. Contractor shall conduct maintenance for the aforementioned every month
2. Contractor shall provide maintenance repair and/or replace toilets, seats, seals, floats, levers, lids, and any items or devices required for the proper operation and sanitation of toilets.
3. Emergency Calls will be fixed immediately.
4. If any replacement item is needed it will be subject to Government Representative approval
Maintenance for Twenty One (21) Showers
1. Contractor shall conduct maintenance for the aforementioned every month
2. Replace or repair shower heads, pipes, knobs, valves, seals, brackets, faucets, filters, aerators, drains, heaters, fuses, or any other deficiency associated with the proper function or condition of the bathroom noted by Government Representive or contractor
3. Emergency Calls will be fixed immediately
4. If any replacement item is needed it will be subject to Government Representative approval
Maintenance for (2) Water Tanks
1. Repair top lids on the water storage
2. Contractor will inspect water tanks put screen around the water tank to keep birds and bugs out of the water tank.
3. Needs to get shocked and cleaned out
4. Storage water tank will be maintained and checked monthly
5. If any replacement item is needed it will be subject to Government Representative approval
Maintenance for (2) Water Pumps
1. Contractor will inspect Water Pumps monthly
2. Contractors will check for unusual noise, unusual vibration, unusual temperature, leaks in the pump or piping, pressure gauge readings, visual inspection of equipment general condition,
3. Anytime a pump is opened, inspect the running clearances and restore them to original specifications if the running clearances have doubled (adjust ring clearances if supplied or install new wear rings)
4. Anytime a pump is opened, inspect the impeller for corrosion or excessive wear, check Mechanical seal(should be no leakage), Drain lines are working properly, clean and oil gland bolts, remove packing and inspect sleeves. Get with Government Representative to get the okay to install new wear rings.
5. If any replacement item is needed it will be subject to Government Representative approval
0006 Maintenance for Two (2) Generators
1. Contractors will look for corroded elements, loose wires, stuck buttons, etc. Check for any loose connections and frayed wiring. Make sure the area around the generator is clean, and if the generator has sucked in any foreign material make sure to clean out the area.
2. Contractors will check the distilled water in the battery; fill up if needed.
3. Contractors will change the lubricant oil and filters (super, by-pass, etc.) following the manufacturer's instructions. Record the yearly change in the record book so that you are reminded each time when it is due. Make sure that the oil level is adequate and top up if needed monthly. Air cooled machines should have their oil replaced every 250 hours of run time. Liquid cooled machines should have their oil replaced every 1000 hours of run time
4. Contractors will conduct maintenance and services of generators monthly

Contractor Management Reporting (CMR): The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the United States Army South via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/, and then click on the “Department of the Army CMRA” or the icon of the DoD organization that is receiving or benefitting from the contract services.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2014. 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Technical Acceptability - Offers will be rated on an "Acceptable" or "unacceptable" bases. Technical acceptability will be determined by the quoted items meeting or exceeding all the specifications/requirements in the Performance Work Statement. If one of the specifications is not met, the offer shall be considered technically unacceptable and shall not be considered for award. Offeror shall submit a certification stating that the contractor has the capability and experience to provide all the requirements stated in the solicitation.
2. Price - Price will not be assigned an adjectival rating; however, proposed prices evaluated unreasonably high may be grounds for eliminating an offer from the competitive range. Price will be evaluated toasdetermine if the offeror’s proposed price is fair, reasonable, and balanced utilizing price analysis techniques in accordance with the guidelines in FAR 15.404-1(b). The Government will award contracts to offerors whose technically acceptable proposal represents the lowest price to the Government. Unless otherwise specified, offerors shall submit prices for all CLINs. Failure to submit a price for any CLIN/sub-CLIN shall result in the offer being considered unacceptable.
Award will be made to the lowest priced technically acceptable offer
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUL 2016)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.
(a) Definitions. As used in this provision --
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
Subsidiary means an entity in which more than 50 percent of the entity is owned--
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.
The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
