Hotel Services Medellin, Colombia
1.0. General: This Presidential-led initiative is an effort designed to support the National Security Interests of Colombia and the United States. Discussions among senior officials from Colombia, U.S., Panama, Honduras, Guatemala, Costa Rica, Dominican Republic, and El Salvador will drive the theme of this workshop.
1.1 TIME LINE 19-28 August 2016, event dates 22-26 August 2016.
1.1.2 – 19 August 2016: Advance Party arrives (2 pax).
1.1.3 – 20 August 2016: J54 Leadership (6 pax).
1.1.4 – 21 August 2016: Event participants (44 pax) arrive.
1.1.5 – 22 August 2016: Workshop and meetings begins, first day events.
1.1.6 – 23 August 2016: Workshop and meetings continue, second day events.

1.2 Place of Performance: Medellin, Colombia (Hotel TBD)
1.3 SCOPE. The Contractor shall provide lodging, meals, conference facilities, equipment and incidental services to the US Southern Command, also referred to herein as “the Government”, in support of the USCAP 2016 Mid-Year Review and CY 2017 Security Cooperation Technical Committee (SCTC) WORKSHOP as defined in this Statement of Work, with the exception of those items specified as Government-furnished property and services. Attendees will begin to arrive on 19 August 2016, attend the specified days of the workshop, and depart when completed with required meetings, or the day after the conclusion of the workshop, 28 August 2016. The workshop will consist of approximately forty-eight (48) participants.
2.0 HOTEL REQUIREMENTS
2.1 HOTEL LOCATION: The contracted facility shall be located in a safe, secure location which shall be able to pass a US SOUTHCOM Force Protection assessment. The Contractor shall be located in the metropolitan area and within reasonable walking distance to eateries. The Contractor shall provide lodging, meals, and workshop requirements within their main facilities with all conference rooms/spaces in close proximity of each other and on the same floor level, as directed by the US Government.
2.2 HOTEL SECURITY/INSPECTION. The Contractor shall have a modern professional system of internal and external security. The Contractor shall heighten their security posture starting the morning before the seminar and continuing until the evening of the day after the seminar. If external security augmentation is used, the hotel security manager shall ensure complete and unlimited access and seamless coordination between the hotel’s organic security systems and the external augmentation units. Where possible, all workshop activities shall be conducted in designated areas located above the ground floor level. The Contractor shall not have any ongoing construction onsite or around the vicinity of the hotel, to include, major renovation which includes closing entire floors, changing out multiple elevators, replacing flooring at multiple location throughout the hotel and renovation that is disruptive due to extreme noise levels.
2.3 VET INSPECTIONS. Before time of award, the Hotel shall be able to pass a US Government VET inspection, as required.
2.4 FORCE PROTECTION INSPECTION. The conference rooms and hotel facilities are subject to a Force Protection Inspection. Contract award is contingent upon certification of facilities by a favorable Force Protection Inspection report.
2.5 HOTEL CONTRACT POC. A contract hotel POC-program manager shall be in a position at the hotel 24/7 and be able to direct the operation of the facility.
2.6 HOTEL EQUIPMENT. The Contractor shall ensure that any maintenance or repairs on hotel equipment shall be performed immediately without further cost to the Government.
2.7 HOTEL ITEMS/AMENITIES EXCLUDED FROM THE CONTRACT. The Government will not pay for movies, mini-bars, laundry, room service, telephone calls from or charged to guest rooms, or any other hotel charges other than those specifically provided for in this contract.
2.7.1 Lodging, movies, mini-bars, service charges, etc. shall be itemized separately on service bills. Hotel guests shall be responsible for all legitimate charges appearing on their lodging statements, with the exception of the contracted lodging and meals.
2.7.2 The Contractor’s staff shall inform guests during check-in which services shall not be covered by the Government. The Contractor’s staff shall request a credit card from guests upon check-in. Charges not covered by the contract are to be resolved between the guests and the hotel.
2.8 HOTEL ITEMS/AMENITIES INCLUDED IN CONTRACT. The Contractor shall provide a 24- hour fitness center with a variety of fitness equipment. All regular hotel guest facilities and amenities, to include the hotel business center and the spa facilities, shall be made available for all participants who are registered at the hotel.
No cover fees are to be charged to workshop attendees who are not registered in the hotel. The Contractor shall provide two (2) bottles of water per day and internet service/WI-FI in each contracted room, both included in the cost of the room.
3.0 LODGING.
3.1 ROOMS REQUIRED. The Contractor shall provide single occupancy rooms as denoted in the table below.
The table provided below is an estimate of required lodging. Any other rooms and/or services are the responsibility of participants arranging them and the Government will not be held liable. The Government may request additional rooms at any time, and the Contractor shall give the Government priority on all unoccupied lodging of similar quality. The Government requires rooms to be paid under this contract and reservations for rooms to be paid by individual guests outside the scope of this contract as specified below.

3.2 QUALITY STANDARDS FOR ROOMS. All rooms shall include: high standard of hygiene, private bath with full toilet and shower facilities, hot and cold running water, clean linen on a daily basis, electricity, and color television with cable, internet service, and appropriate furniture.
3.3 GOVERNMENT REPRESENTATIVE. A Government representative will coordinate administrative, logistical, and miscellaneous issues with the Contractor. This representative shall not make any changes to the terms, conditions, standards, or cost of the contract. This individual has authority to provide technical direction to the Contractor as long as the direction is within the scope of the contract, does not constitute a change, and has no funding implications.
3.4 ROOM INFORMATION. The Government Representative will only approve payment for rooms used (under contract). The Government intends to utilize all of the rooms requested. However, the possibility exists that, due to unforeseen circumstances, a few workshop participants may have to cancel their attendance. Therefore the Government reserves the right to fill any of the rooms with alternate personnel, without penalty, up to 24 hours in advance. If there is a no-show guest, the Government will only pay for one (1) night. Additionally, there will be an estimated nine (9) participants who will pay for their own lodging. These participants will not be included in the Lodging contract. They are noted in table above as “self-funded”. These participants are required to personally call/contact the Hotel and provide their credit card numbers to secure their lodging.
3.5 ROOM LIST. The Government Representative will furnish the Contractor with a room roster containing participant names by 15 August 2016, but may change any of the names for the rooms up to the day of check-in.
4.0 CONFERENCE FACILITIES.
4.1 CONFERENCE ROOMS. The Contractor shall provide one conference room large enough to accommodate a total of 60 participants, with 30 participants seated in a U-shape, and a classroom seating arrangement for the remaining 30 participants.with the additional of a translation booth. Set-up for the conference rooms shall be accomplished no later than 6:00 AM on 22August 2016. The conference room shall have dimmer switches and black out curtains (or similar) to allow for slide/audio visual presentations. The conference room shall have sufficient power strips for all participants to connect laptops and tablets. All seats shall be cushioned and tables shall be covered with white tablecloths.
The Contractor shall allow change of configurations and usage times for conference rooms at any time prior to the workshop to accommodate last minute directives and fluctuating requirements. Contractor personnel shall be available for changes in room configuration as needed.
If additional chairs or tables are required, the Government Representative will coordinate with the hotel representative. The Government Representative will provide instructions to the Contractor regarding the exact configuration of the rooms, as needed.
The Contractor shall also provide and place a registration table outside of the conference room by 7:00 am on each day of the event.
The Contractor shall provide flags of equal size and quality for the countries of Colombia, USA, Guatemala, Honduras, El Salvador, Costa Rica, Dominican Republic, and Panama.
The main conference rooms shall be completely cleaned prior to the workshop.

4.3 ADMINISTRATION ROOM. The Contractor shall provide an administration room large enough to accommodate 10 participants with enough space to fit at least 2 (5ft or larger) tables. Set up for the administration room shall be accomplished no later than 8:00 AM on 21 August 2016. All seats shall be cushioned and tables shall be covered with white tablecloths. This room’s configuration and usage times may be changed at any time prior to the workshop to accommodate last minute directives and fluctuating requirements. Contractor personnel shall be available for changes in room configuration, as needed. The Government Representative will provide instructions to the Contractor regarding the exact configuration of the room. The Contractor shall provide a house phone for the administration room.
The administration room shall be completely cleaned prior to the workshop.
4.4 BREAKOUT ROOM. The Contractor shall provide a breakout room large enough to accommodate ten (10) participants, with enough space to have at least two (2) (5ft or larger) tables. Set up for breakout room shall be accomplished no later than 6:00 AM on 22 August 2016. All seats shall be cushioned and tables shall be covered with white tablecloths. This room’s configurations and usage times may be changed at any time prior to the workshop to accommodate last minute directives and fluctuating requirements. The breakout room must be completely cleaned. Contractor personnel shall be available for changes in room configuration as needed. The Government Representative will provide instructions to the Contractor regarding the exact configuration of the room.

4.6 AMENITIES FOR CONFERENCE ROOMS.
4.7 A bottle of water for all participants and supplies, such as note pads, pens/pencils, shall be provided to each participant on each workshop date for the conference room.
4.8 Four (4) white boards; with one (1) each wide tip non- permanent markers, colored black, red, green, and blue, for the conference room.
5.0 PARKING REQUIREMENTS/ TAXI ACCESS
5.1 The Contractor shall provide ten (10) reserved parking spaces for local workshop participants and workshop staff in the hotel parking lot during the workshop. Parking shall be in a secure area with adequate lighting and security.

5.2 The Contractor shall have a readily responsive, 24-hour, taxi or limo service access at the hotel, to be used and paid by the workshop participants and staff.
5.3 The Government Representative will provide a list of workshop participants’ arrival and departure times prior to the start of the workshop period of performance.
6.0 FOOD AND BEVERAGE.
6.1 MEALS. The Contractor shall provide lunches and dinners to specific participants as directed by the Government Representative, and as depicted below. The Government will only pay for meals consumed by selected participants at the Hotel Restaurant. The selected participants will identify themselves and their room number prior to the meal. Meal consumption will be controlled with Government representative supervision. The Government will not pay for alcoholic beverages during meals. All meal receipts associated with this workshop shall be submitted daily to the Government Representative for verification and accountability. Direct specification of these meals shall be discussed between the Hotel and the Government representative.
6.2 MEALS SCHEDULE. Participants will eat at the hotel restaurants at their convenience.
6.3 BREAKFAST/LUNCH/DINNERS. The Contractor shall provide breakfast, lunch, and dinner to workshop participants, as shown in the following chart. The Government will pay for no more than twenty-one (21) of the participants, while the rest of the participants will pay for their own breakfast, lunch, and dinner. The participants for whom the Government will pay for meals will be identified by the Government representative on site.

6.5 BREAKS. The Contractor shall provide a permanent coffee station for a morning and afternoon break during the workshop days of 22, 23, 24, 25 and 26 August 2016. Both coffee stations shall be set up outside the conference room. The break menu shall be varied daily and the service shall include utensils and all necessary equipment. The menu selected and time and schedule for such breaks shall be discussed and determined between the Government representative and the Contractor prior to start of the workshop. Breaks shall have hot and cold beverages, including water, coffee, tea, water, and sodas.
7.0 WELCOME RECEPTION / SOCIAL – The Contractor shall provide an outdoor area for a reception of approximately fifty-five (55) people from 5:00PM to 7:00PM on 22 August 2016. The Contractor shall also have alternate locations available inside, in case of inclement weather. The Contractor shall provide a two-hour (2) bar open bar with alcoholic and non-alcoholic drinks, three (3) hot hors ' d'oeuvres and three (3) cold hors ' d'oeuvres.
All items will be selected by the Government representative.
8.0 ADDITIONAL REQUIREMENTS.
8.1 MAINTENANCE. The Contractor shall ensure that all equipment and services are in proper working order throughout the contract period. All scheduled maintenance shall be performed prior to the start of this contract.
Any unscheduled maintenance or breakdowns shall be corrected within one (1) hour or substitution provided.
8.2 TESTING OF ANY EQUIPMENT. The Contractor shall install and be ready to conduct a full communications test of all equipment/systems in the main conference room by 6:00 AM on 22 August 2016.
8.3 ROOM RATES. Room rates, plus any mandatory hotel fees such as gratuities / hotel service fees/ resort fees, shall not exceed the US Government per diem rates in effect for Medellin, Colombia for the period of the workshop.

8.4 APPLICABILITY. Tax exemption applies to self-funded participants as well as contract-funded attendees.
Therefore, taxes shall be removed from the bill once the tax exempt forms have been submitted to the hotel by the Government representative.
9.0 ADDITIONAL INFORMATION.
9.1 CANCELLATIONS/ADDITIONS. The Contracting Officer (KO) is the sole individual who has the right to make changes to this SOW, in coordination with the Government representative and Acquisition Support Center personnel (to include the numbers and types of personnel or equipment needed) to make this mission success. The Contractor shall give the Government priority on all equipment/personnel under the terms of any contract resultingfrom this SOW. Changes made with at least a twenty-four (24)-hour notice shall incur NO penalty. Other modifications may be negotiated as required, but only by the Contracting Officer is authorized to finalize any subsequent modifications. The Government will pay for only personnel and equipment used in this period of performance.
9.2 CHANGES TO CONTRACT. The only person authorized to make changes to the contract is the Contracting Officer. Failure to clear changes in the contract with the Contracting Officer (KO) will result in the Contractor not receiving compensation for incurred costs. Accordingly, the Contracting Officer will be notified prior to any additional services performed and a contract modification will be issued with any change to price, period of performance, or change to Terms and Agreements. When/if, in the opinion of the Contractor, an effort outside the existing scope of the contract is requested, the Contractor shall promptly notify the Contracting Officer for authorization to proceed.
9.3 The Contractor shall provide appropriate announcement boards at each entrance to the hotel and at the elevator and main conference room welcoming and providing directions to the workshop participants. The exact wording of the announcement will be provided to the hotel by the Government representative.
9.4 PRICE QUOTES. Quotes shall be submitted in English. Prices shall be all inclusive. Local taxes and Federal taxes need to be displayed separately, since the Government is a tax exempt organization. The Contractor shall submit quotes in U.S. Dollars.
NOTE: Offers will not be accepted from third party agencies. Offers will be accepted directly from Lodging Facility providers only. In accordance with the PWS requirements, the successful offeror shall provide a point of contact of sufficient authority to authorize changes. In order for this and other PWS requirements to be met, the Government must maintain privacy of contract directly with lodging facility providers. Offers from third parties shall be considered non-responsive and will be excluded from consideration for award.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Technical Acceptability - Offers will be rated on an "Acceptable", or "Unacceptable" basis. Technical acceptability will be determined by the quoted items meeting or exceeding all the specifications/requirements in the Performance Work Statement. If one of the specifications is not met, the offer shall be considered technically unacceptable and shall not be considered for award. Offeror shall submit a certification stating that the contractor has the capability and facilities to provide all the requirements stated in the solicitation. Offeror shall be included in the US-Embassy Bogota Regional Security Office hotel list. If the offeror is not included in this list, it will not be considered for award. The quote shall reflect vendor's address and physical location and certify that hotel shall be located within Medellin-Antioquia near to the metopolitan area and within reasonable walking distance to eateries . If the offeror's physical location does not meet these criteria, it will not be considered for the award.

2. Price - Price will not be assigned an adjectival rating; however, proposed prices evaluated as unreasonably high may be grounds for eliminating an offer from the competitive range. Price will be evaluated to determine if the offeror’s proposed price is fair, reasonable, and balanced utilizing price analysis techniques in accordance with the guidelines in FAR 15.404-1(b). The Government will award contracts to offerors whose technically acceptable proposal represents the lowest price to the Government. Unless otherwise specified, offerors shall submit prices for all CLINs. Failure to submit a price for any CLIN/sub-CLIN shall result in the offer being considered unacceptable
Award will be made to the lowest priced technically offer.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (APR 2016)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.
(a) Definitions. As used in this provision --
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
Subsidiary means an entity in which more than 50 percent of the entity is owned--
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.
The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
Veteran-owned small business concern means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
"Women-owned small business concern" means a small business concern--
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or
(2) Whose management and daily business operations are controlled by one or more women.
Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127)”, means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
