ERDC Control No. ERDC-18-0024

SOLE SOURCE JUSTIFICATION

1. Agency/Contracting Activity: Engineer Research and Development Center – Cold Regions Research and Engineering Laboratory (ERDC – CRREL)

2. Description of Action:

Nature: New Requirement Follow-On Requirement

Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time and Materials

Funds: OMA Other Funds: RDT&E

3. Description of Supplies/Services: The total estimated dollar value of the proposed action is . The Remote Sensing/GIS Center of Expertise in Hanover, New Hampshire requires procurement of a mobile laser scanning system to support research and development activities related to the rapid collection and processing of multi-temporal 3D and 4D high-resolution point-clouds in urban landscapes. The proposed mobile laser scanning system and accessories will enhance in-house research capabilities to support algorithm development related to 3D laser streams and near-realtime feature extraction.

The mobile laser scanning system and accessories must have the following minimum specifications:

Minimum of 1 laser scanning head with a 360 degree scanning capability Scan range of at least 420 meter with an achieved accuracy 5mm Adaptable GiGE camera interface to support a variety of cameras 1MHz or better maximum effective measurement rate (250 scan lines/sec min) Support onboard IMU characteristics of roll/pitch accuracy of 0.005deg and heading accuracy of at least0.015deg Include acquisition interface hardware for realtime diagnostics of data Software for post processing, registration and analysis Class 1 laser characteristics for safety System must be compact and total sensor head dimensions should be less than 500 x 400 x 520mm for low profile use.

Online waveform processing for realtime waveform data

4. Authority:

Actions using Simplified Acquisition Procedures under the authority granted by 41 U.S.C.

FAR 13.501(a)(1)(i): Contracting Officers must conduct sole source acquisitions, as defined in FAR 2.101 (including brand name), under FAR Subpart 13.5 only if the need to do so is justified in writing and approved at the levels specified in paragraph (a)(2) of this section.

FAR 13.501(a)(2)(i) – For a proposed contract exceeding $150,000, but not exceeding $650,000, the contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.

5. Reason for Authority Cited: Riegl USA, Inc. has been identified as the only company capable of offering a product meeting the requisite specifications and interoperability requirements of CRREL’s existing Riegl hardware and CRREL’s in-house designed software.

The capabilities listed in Section 3 above are beyond typical ground based LiDAR, pulsed laser diode imaging systems. ERDC-CRREL already owns and operates numerous Riegl related laser hardware and software products, and CRREL’s research requires a system that is fully interoperable with CRREL’s existing in-house software uniquely designed to specifically work with Riegl equipment; full interoperability is required to allow the system to take accurate LiDAR measurements and function seamlessly while deployed in field experiments alongside other Riegl equipment. Riegl maintains proprietary rights to the scanners necessary to fulfill the Government’s requirements; continuity between equipment and specially designed software is vital to preserve the validity of the Contractor’s warranty and ensure successful operations.

6. Actions to Increase Competition: A notice of intent to sole source was posted to the Government Point of Entry (GPE), Federal Business Opportunities (FBO) 14 November 2017 in accordance with FAR Part 5.2. OGI Inc. submitted two specification sheets on 17 November 2017. The specification sheets were submitted to the program office (Mr. David Finnegan and Mr. Adam Lewinter) for technical review. Both were deemed to have significant deficiencies that did not meet the salient features of the Government’s requirement as delineated in the notice.

As of the notice closing, no other responses were received. Future requirements will be evaluated for competition and procured in a manner befitting the circumstances.

7. Market Research: Market research was conducted by both the technical team and the contracting office in accordance with FAR part 10. There are numerous manufacturers of laser systems across the world, but Riegl USA, Inc. is currently the only vendor producing a high-speed, full-waveform, mobile laser scanning system with the size, weight and capabilities of acquiring data at the speeds necessary to meet the Government’s requirement. Furthermore, when compared to other laser hardware manufacturers, such as Trimble and Optech, Riegl is currently the only vendor on the market offering a near-realtime online processing, full-waveform solution.

Additionally, the mobile laser scanning system developed by Riegl is the only system with a laser head that will seamlessly cross-integrate with our existing airborne, UAV and software architectures currently in use at the ERDC CRREL RS/GIS COE. The contract specialist performed a basic web search and searched GSA Advantage, but was not able to find any other distributors of Riegl USA, Inc. equipment.

8. Procurement History:

Previous Purchase Orders(s) or Contract(s): Yes No

Purchase order or contract number: W913E5-15-P-0013 and W913E5-16-P-0065.

Was action competed? Yes No If action was not competed, state the cited authority, summarize rationale: 13.501(a)(1)(i)

9. Additional information to support the justification: Technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available because the ERDC- CRREL technical team has a requirement for laboratory equipment with very specific capabilities that cannot currently be met by any vendor other than Riegl USA, Inc. This not a follow-on acquisition. This is a new requirement and has not been previously acquired. The ERDC/CRREL LiDAR team currently has several Riegl products and interoperability is vital to the success of the research.

10. Technical/Requirements Certification: I certify that the supporting data under my cognizance which is included in the abbreviated J&A is accurate and complete to the best of my knowledge and belief.

11. Fair and Reasonable Price Determination: As Contracting Officer, I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.

Basis for the determination: Price Analysis Techniques.

12. Contracting Officer’s Approval:

I hereby certify that this Justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this sole source justification subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition
