SECURITY REQUIREMENTS

The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the Technical Point of Contact NLT 5 calendar days after the completion of the training.

The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the Technical Point of Contact no later than 3 business days after the initial contract award.

PERFORMANCE WORK STATEMENT

U.S. ARMY CORPS OF ENGINEERS CAPE

COD CANAL BUZZARDS BAY, MA

A. General

1. Performance Requirements – Provide all labor, materials, and equipment necessary at the Cape Cod Canal to clean four (4) buildings and remove all trash and recycling items from the field office compound year round, remove all trash and recycling items from eight (8) recreation areas seasonally, clean the Sandcatcher recreation area comfort station for a short period seasonally, deep clean the Cape Cod Canal Field Office Ranger Station and Administration building once a year and deep clean the Visitor Center twice a year. All work will be completed to the satisfaction of the Technical Point of Contact.

2. Locations – The Cape Cod Canal Field Office is located at 40 Academy Drive in

Buzzards Bay, MA. The recreation areas are located within the towns of Bourne and Sandwich MA along both sides of the Canal. The Canal Visitors Center is on Ed Moffitt drive in Sandwich, MA.

3. Site Visit – To arrange a visit contact the Technical Point of Contact, Park Ranger

a. SITE VISITS ARE HIGHLY RECOMMENDED DUE TO THE SCOPE OF

THE REQUIRED SERVICES

4. Schedule – The period of performance will be from Contract Award through 03

March 2020. In addition, the Government may exercise two (2) optional years with the same scope of services. The optional years would include a period of performance from 04 March 2020 through 03 March 2021, and from 04 March 2021 through 03 March 2022.

5. Safety – The contractor will comply with all pertinent provisions of the latest edition of the U.S. Army Corps of Engineers Safety and Health Requirements COE EM 385-1-

1. A copy of COE EM 385-1-1 is available for reference at the project office or may be ordered from Superintendent of Documents, PO Box 371954 Pittsburgh, PA 15250- 7954 (Tel: 202 783-3238). In addition, the manual may be viewed at the following link: http://www.usace.army.mil/SafetyandOccupationalHealth/SafetyandHealthRequir ementsManual.aspxl. The contractor shall also comply with all OSHA work safety standards. The project staff can and will order the cessation of work at any time should the safety of employees and visitors become jeopardized.

6. Security – The contractor will comply with all established security policies at the

Cape Cod Canal. Due to periods of heightened security that may affect the access to the areas covered under this contract, areas may be subject to periodic closures, which in turn may reduce or inhibit the Contractor’s ability to access certain areas. During periods of heightened security, the Government reserves the right, at any time, to close any property or portion of property and reschedule and/or cancel any subsequent service in an area. The Contractor shall be given at least 24 hour notice of any such closure.

7. Hazardous Weather- The Contractor shall comply with established hazardous weather policies at the Cape Cod Canal. In the event of hazardous weather areas may be subject to periodic closures or evacuations. The Government reserves the right, at any time, to close any property or portion of property and reschedule and/or cancel any subsequent service in an area. The Contractor shall be given at least 24 hour notice of any such closure.

8. Permits – The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses, permits, and letters of certification. The Contractor shall comply with any applicable Federal, State, County, and Municipal laws, codes, and regulations in connection with the performance of the work specified under this contract.

9. Contractor Conduct – The Contractor and employees shall not use or be under the influence of drugs or alcohol at any time while performing the obligations under this contract. Firearms are prohibited on project grounds. Contractor and employees must comply with CFR 36 Rules and Regulations. The Contractor and employees will promote and maintain a favorable image of the Corps of Engineers through their personal appearance, demeanor, and actions. Examples of unbecoming actions or conduct include but are not limited to the following:

a. Cursing, harassment, discrimination of and/or unwarranted physical contact with visitors, Corps personnel or contractors.

b. Recurring written and/or verbal complaints from visitors, Corps personnel, or contractors.

c. Unsafe operation of vehicles or equipment while on Corps property.

10. Payment – The contractor shall furnish the Technical Point of Contact with one invoice per month, identifying the contract number, stating the amount of services completed during the month, identified by Item Number and quantity. Payment shall be made monthly for the actual services performed at the applicable contract unit price.

11. Pre-Work Conference – The Contractor, upon award of this contract, shall contact the

Technical Point of Contact to arrange a pre-work conference. At this meeting, contract requirements will be discussed and any problems resolved. The successful bidder is required to attend this pre-work conference.

12. Environmentally Preferred Products

Federal contracts for janitorial services require contractors to use or supply products covered by the following environmental programs:

9.1. Safer Choice (formerly DfE) - Includes all-purpose and specialty cleaners, hand soaps, odor removers, and more (https://www.epa.gov/saferchoice/products).

9.2 BioPreferred - Includes air fresheners, cleaners, floor protectors, and more

(https://www.biopreferred.gov/BioPreferred/faces/pages/ProductCategories.xhtml).

9.2. CPG - Includes toilet paper, plastic trash bags, recycling containers, and more (https://www3.epa.gov/epawaste/conserve/tools/cpg/products/index.htm).

Products that are identified as “environmentally preferable”, products that have a lesser or reduced effect on human health and the environment when compared with competing products that serve the same purpose, and bio-based will be selected over those which do not carry such designations. This comparison may consider raw materials acquisition, production, manufacturing, products and chemicals, packaging, distribution, reuse, operation, maintenance, or disposal of the product. The following factors to consider when selecting products include:

environmental performance, cost performance, bio-based, recycled content, biodegradability, technical performance, and availability.

B. Technical Requirements

General Requirements:

1. Summary – Provide all labor, materials, and equipment necessary at the Cape Cod Canal to clean four (4) buildings and remove all trash and recycling items from the field office compound year round, and deep clean two (2) buildings once (1x) a year; remove all trash and recycling items from eight (8) recreation areas seasonally; clean the Sandcatcher recreation area comfort station twice daily for seven (7) days in October; and deep clean the Visitors Center twice a year. All work will be completed to the satisfaction of the Technical Point of Contact. Contractor’s work and responsibility shall include, but not be limited to, all job planning, programming, scheduling, administration, inspection, personnel, equipment, vehicles, fuel, materials, supplies, supervision, and quality control necessary to perform the various services required herein.

2. Requests for information – Requests concerning the work of this project should be directed to the Technical Point of Contact, at 978-318-8531 or Ann.LeBlanc@usace.army.mil.

3. Schedule – The following schedule will be utilized for the duration of the Contract: The summer period for each year starts the second to last full weekend in April and ends on Columbus Day in October. The winter period for each year starts the day after Columbus Day and ends the Friday before the last two full weekends in April.

a. For 2019 the winter period is contract award to 19 April 2019, then from 15 October 2019 to 03 March 2020. The summer period is 20 April 2019 to 14 October 2019

b. For 2020 the winter period is 04 March 2020 to 24 April 2020, then from 13 October 2020 to 03 March 2021. The summer period is 25 April 2021 to 12 October 2021

c. For 2021 the winter period is 04 March 2021 to 22 April 2021, then from 12 October 2021 to 03 March 2022. The summer period is from 23 April 2021 to 11 October

Holidays: The contractor shall provide recreation area trash and recycling removal services on all holidays that occur during the schedule for those requirements. All other service requirements herein will not be performed on federal holidays. All quantities in this table are for the base year. Please see the bidding schedule for the two option year quantities.

Service Requirements

1. Materials & Supplies:

a. The Government will supply basic cleaning materials, supplies and tools of the trade such as basic disinfecting and cleaning products; sponges, mops, brooms, and buckets; trash and recycling receptacles, trash bags and securing rubber bands; and consumable soap, paper towels, and toilet tissue for stocking restrooms. Materials provided by the U.S. Army Corps of Engineers will only be used at the Cape Cod Canal. Contractor will obtain supplies from the Technical Point of contact and from designated storage areas.

b. The Government will provide dumpsters for disposal of trash and recycling materials from the service areas. Contractor will use dumpsters designated by the Technical point of contact for each recreation area.

Government provided dumpsters will only be used for Canal trash and recycling items.

c. The Contractor will supply all necessary personal protective equipment, vacuuming equipment, and commercial grade cleaning equipment and cleaning products for carpets/upholstery and vinyl tile flooring. Contractor will also provide a vehicle capable of hauling trash and recycling items to designated dumpsters.

Note: The contractor shall submit one copy of the manufactures Material Safety Data Sheet for each chemical proposed for use.

2. Service Description:

a. ITEM NO. 1 -Field Office Buildings Cleaning: The following services shall be performed as part of the daily scheduled Cleaning of the four (4) Field Office Buildings:

i. Empty all trash and recycling receptacles, insert new liners and dispose of items properly in dumpsters designated by the Technical Point of Contact

ii. Clean and sanitize restrooms, scrub and disinfect toilets, urinals, showers, sinks and countertops, clean and polish all stainless steel, clean stall partitions, mirrors, hand dryers doors and door vents, sweep and wash all floors, moldings and woodwork, restock paper tissue, soap, air freshener, and paper towels, and wash all shower stalls and shower curtains

iii. Clean and sanitize kitchenette areas, wash all counters, floors, woodwork and table tops, scrub and disinfect sink, restock soap and paper towels. Polish refrigerator exterior. Wipe down exterior of cabinet doors.

iv. Clean office spaces. Wash moldings, woodwork, door frames, walls and partitions, etc. Remove cobwebs from ceilings, ceiling vents, corners, etc. Dust the surfaces of all display items/cabinets in reception area. Clean all glass doors and sliding glass doors.

Vacuum all rugs and carpeted floors. Sweep/vacuum and wash all vinyl, tile and cement floors

v. Perform periodic maintenance to vinyl tile (machine scrub or strip as needed, rinse, apply floor polish and buff to a uniform glossy appearance)

vi. Clean and sanitize drinking fountains

vii. Fully clean, organize, and stock all utility and cleaning storage areas

viii. All dirtied mop water will be placed in a location identified by the

Technical Point of Contact the kitchen, and bathroom sinks may not be utilized

b. ITEM NO. 2- Canal Field Office Annual Deep Cleaning:

The following services shall be performed in two (2) buildings as part of the scheduled Annual Deep Cleaning:

i. A top-to-bottom Deep Cleaning after Columbus Day of all

Ranger Offices and Administration Building spaces including but not limited to surface cleaning and treating, wiping, dusting, vacuuming, and polishing all surfaces of:

1. Glass surfaces, hallway doors and walls, exterior and interior entryway enclosure glass and Plexi-glass,

2. Office walls, trim, woodwork, storage spaces, doors, door frames, heat registers and ceilings including vents and overhead light fixtures

3. All desks, tables, counters, flat surfaces, shelves, cabinets, bookcases, display cabinets, light shades, and other furniture and office machine surfaces

4. Kitchen and bathroom spaces, including scrubbing and disinfection of toilets, sinks, and countertops, washing all mirrors, cabinets, walls, trims, and polishing and cleaning appliances inside and out, sweeping/vacuuming and washing and properly treating floors, and restocking soap, paper tissue, and paper towels

5. Entryways and hallways to include stripping, cleaning, waxing, and buffing of tile floors in all areas of each building

6. All windows on the first floor interior and exterior

7. Empty all trash and recycling receptacles, wash the receptacles inside and out and insert new liners and dispose of trash properly in dumpsters

ii. Carpet and Upholstery Cleaning/Shampoo: Vacuum, treat, and extract all designated carpeting and upholstered chairs. Contractor shall accomplish all cleaning/shampoo by “steam cleaning or hot water” deep dirt extraction methods.

c. ITEM NO. 3- Visitor Center Bi-Annual Deep Cleaning: The following services shall be performed as part of the scheduled Bi-Annual Cleaning:

i. A top-to-bottom Deep Cleaning of all visitor center spaces including but not limited to surface cleaning, wiping, dusting, vacuuming, and polishing all surfaces of:

1. Exhibit and display items and display cabinets including all computer monitors, glass surfaces, the interior and exterior of the patrol boat, picture frames, etc.

2. Walls, trim, woodwork, doors, door frames, heat registers and ceilings including vents and overhead light fixtures and fans

3. All desks, tables, counters, flat surfaces, shelves, cabinets, bookcases, display cabinets, light shades, and other furniture and office machine surfaces

4. Kitchenette and bathroom spaces, including scrubbing and disinfection of toilets, sinks, and countertops, washing mirrors, cabinets and appliances, sweeping/vacuuming and washing of floors, and restocking soap, paper tissue, and paper towels

5. Entryways, hallways, attic and storage spaces

6. All windows on the first floor (interior and exterior) and all attic windows (interior only)

7. Empty all trash and recycling receptacles, insert new liners and dispose of trash properly in dumpsters

ii. Carpet and Upholstery Cleaning/Shampoo: Vacuum, treat, and extract all designated carpeting and all upholstered chairs.

Contractor shall accomplish all cleaning/shampoo by “steam cleaning or hot water” deep dirt extraction methods.

d. ITEM NO. 4- Sandcatcher Restroom Cleaning: The following services shall be performed as part of the scheduled twice daily Comfort Station Restrooms Cleaning:

i. Clean and sanitize restrooms, scrub and disinfect toilets, urinals, sinks and countertops, clean and polish all stainless steel, wash mirrors, sweep and wash all floors, and restock paper tissue, soap, and paper towels

ii. Clean stall partitions, doors and door vents. Remove cobwebs from ceilings, ceiling vents, corners, etc.

iii. Empty all trash and recycling receptacles, insert new liners and dispose of items properly in dumpsters designated by the Technical Point of Contact

iv. Fully clean, organize, and stock all utility and cleaning storage areas

v. All dirtied mop water will be placed in a location identified by the Technical Point of Contact. The kitchen, and bathroom sinks may not be utilized

vi. Open restrooms to the public after completing the morning service

e. ITEM NO. 5- Recreation Areas Outside Trash/Recycling Removal:

The following services shall be performed as part of the outside trash collection at eight (8) recreation areas:

i. Within the designated recreation areas, contractor shall empty all open outside trash and recycling receptacles, insert and secure new clean liners and dispose of all items properly in the dumpsters designated by the Technical POC for each site

ii. Pick up all litter/recyclables on the ground with a 15 foot radius of all recreation area trash and recycling receptacles.

3. Service Locations – Services shall be performed at various sites at the Cape Cod

Canal located in the towns of Bourne and Sandwich Massachusetts.

ITEM NO. 1- Canal Field Office Cleaning- four (4) buildings located at 40 Academy Drive, Buzzards Bay, MA

a. Administration Building: Single story building with utility areas in the basement. Total Floor Space is approximately 3,980 square feet. The service areas include:

i. Ten (10) Offices, Two (2) Visitor Reception Areas (~495 ft2 total) (carpeted)

ii. One (1) Marine Traffic Controller Center (~315 ft2) (carpeted)

iii. One (1) Conference Room (~315 ft2) (carpeted)

iv. Two (2) hallways and one (1) entryway (vinyl tiled)

v. One (1) Kitchen with full appliances (vinyl tiled)

vi. Three (3) Restrooms; one (1) large single handicapped, and two (2)

Multi-stalled (tiled)

vii. Multiple paper shredder bins

viii. Five (5) single, two (2) double and one (1) sliding glass doors.

ix. Two outside cigarette receptacles

x. Multiple wastebaskets and recycling receptacles in each office space, Marine Control Center, Conference Room, and the kitchen

b. Ranger Station: Single story building with office spaces, a theater, and a garage/workshop. Total Floor Space is approximately 880 square feet.

Service areas include:

i. One large office with two (2) desks (~180 ft2) (carpeted)

ii. Two (2) large office areas with eight (8) total cubicle office spaces and two (2) small office rooms, all with one occupant each (~472 ft2) (carpeted)

iii. One (1) single bathroom with an adjacent hallway (tiled)

iv. One (1) Theater with fifty (50) chairs (~605 ft2) (carpeted)

v. Multiple wastebaskets and recycling receptacles in each cubicle, office, and the shop/garage

vi. One (1) paper shredder bin

vii. Two (2) outside 55 gallon trash barrels.

c. Maintenance Building: Single story building with office spaces and workshops. Total Floor Space is approximately 1288 square feet. Service areas include:

i. Eight (8) workshop areas

ii. One (1) Duty Office, Kitchenette/Break Area –consisting of two

(2) rooms

iii. Two (2) bathrooms: a men’s room with a large locker room, two

(2) shower stalls, two (2) toilet stalls, and a urinal; and a women’s room with one (1) shower stall, two (2) bathroom stalls, and a locker area

iv. Rugs in entryway, maintenance office, marine engineering shop, and Marine Operations offices for a total of (~192 ft2 )

v. Five (5) to seven (7) outside 55 gallon trash barrels

vi. All floors including living areas, entries and hallways, bathrooms, locker rooms and shops for a total of ~1288 ft2

d. Warehouse Building: Single story building with office spaces and large and small storage areas. Total Floor Space is approximately 4007 square feet. Service areas include:

i. One (1) office area (~200 ft2) (half Pergo flooring, half carpeted)

ii. One (1) entryway (carpeted)

iii. One (1) small storage area (~200 ft2) (carpeted)

iv. One (1) ½ glass door.

e. Schedule- Canal Field Office Cleaning service schedule:

i. Daily Monday through Friday, excluding federal holidays, year round

ii. Contractor shall coordinate the time of day allowed for performing required cleaning tasks with the Technical Point of Contact. Field office daily cleanings are scheduled during the early morning

iii. All required services to be performed daily Monday through Friday except vacuuming, mopping and periodic tile maintenance.

Floor cleaning/care will be performed according to the minimum schedule below, with additional cleanings on an as needed basis to keep floors clear of dirt and debris as follows:

1.Vacuum all carpeted areas and sweep and wash designated floors twice a week

2.Perform periodic tile maintenance to designated floors once a month

ITEM NO. 2- Canal Field Office Deep Cleaning- two (2) buildings located at 40 Academy Drive, Buzzards Bay, MA:

a. Administration Building-Service areas include:

i. Conference Room (~315 ft2 )

ITEM NO. 3- Visitor Center Bi-Annual Deep Cleaning- one (1) building located at 60 Ed Moffitt Drive, Sandwich, MA:

a. Visitors Center-Two story building. Total floor space is approximately

4,502 square feet. Service areas include:

i. One (1) attic storage area (subfloor)

ii. Two (2) office areas (carpeted)

iii. One (1) kitchenette (tiled)

iv. One (1) bathroom (tiled)

v. One (1) Theater (carpeted)

vi. Four (4) exhibit areas (carpeted and painted wood floors)

vii. One (1) full size steel patrol boat (separates the 2nd and 3rd exhibit areas)

viii. Multiple trash and recycling receptacles

b. Schedule - Visitor Center Bi-Annual Deep Cleaning service schedule:

The contractor shall perform the top-to-bottom Deep Cleaning (including carpet and upholstery cleaning) twice (2x) annually in April and July. The Contractor shall coordinate the exact dates and time of day allowed for performing required cleaning tasks with the Technical Point of Contact.

ITEM NO. 4- Sandcatcher Recreation Area Comfort Station Cleaning- one

(1) building located at 60 Ed Moffitt Drive, Sandwich, MA

a. Sandcatcher Recreation Area -Single story building. Total floor space is approximately 800 square feet. Service areas include:

i. Men’s and Women’s bathrooms with multiple stalls, sinks and trash receptacles open to the general public (concrete floors)

ii. Supply closet (concrete floor)

b. Schedule - Sandcatcher Recreation Area Comfort Station Cleaning service schedule: Twice daily to be scheduled four (4) hours apart, seven days a week beginning the day after Columbus Day and ending the day after the last Sunday in October in October. The Contractor shall coordinate obtaining keys and the exact time of day allowed for performing required cleaning tasks with the Technical Point of Contact.

Sandcatcher comfort station cleanings are scheduled in the early morning and mid-day.

ITEM NO. 5- Recreation Areas Trash & Recycling Disposal Services- A total of eight (8) recreation areas with up to thirty (30) receptacles are located at the Canal in the towns of Sandwich and Bourne MA.

a. North Side Recreation Areas –

i. Buzzards Bay Recreation Area located at 80 Main St. Buzzards Bay, MA; includes three (3) receptacles

ii. Herring Run Recreation Area located at 830 Scenic Highway, Bourne, MA; includes four (4) receptacles

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018)

ALTERNATE I (OCT 2014)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u)) of this provision.

(a) Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Veteran-owned small business concern” means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern --

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
