Section C - Descriptions and Specifications

DEFINITIONS

CONTRACTING OFFICER: The term “Contracting Officer” means the person with authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the Contracting Officer acting within limits of their authority as delegated by the Contracting Officer. “Administrating Contracting Officer (ACO)”refers to a Contracting Officer who is administrating contracts. “Termination Contracting Officer (TCO)” refers to a Contracting Officer who is settling terminated contracts. A single Contracting Officer may be responsible for duties in any or all of these areas.

CONTRACTING OFFICER AUTHORITY: The term “Contracting Officer Authority” means the Contracting Officer who signs this contract will be the primary Contracting Officer for this contract. However, any Contracting Officer assigned to the Albuquerque District, contracting within his or her authority, may take formal action on this contract when a contract action needs to be taken and the primary Contracting Officer is unavailable.

POINT OF CONTACT: The term “Point of Contact” means the Government’s employee assigned to the project to act as a liaison between the Government and the Contractor. A Point of Contact has no authority to enter into, administer, modify or terminate contracts.

TECHNICAL POINT OF CONTACT: The term “Technical Point of Contact” means the government’s employee assigned to the project to act as a liaison between the Government and the Contractor on technical issues.

U.S. ARMY CORPS OF ENGINEERS SAFETY AND HEALTH REQUIREMENTS MANUAL, EM 385-1-1

AND OSHA REQUIREMENTS: means that the contractor will be required to comply with all pertinent provisions of the latest version of the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of contract award. EM 385-1-1 and its changes are available at http://publications.usace.army.mil/publications by selecting Engineer Manuals, EM 385-1-1 “Safety and Occupational Health”. The Contractor must also comply with Occupational Safety and Health Act (OSHA) standards. OSHA standards are subject to change. It is the Contractor's responsibility to maintain familiarity with current OSHA standards.

ZERO ACCIDENT PROGRAM: The term “ZERO ACCIDENT PROGRAM” means the Albuquerque District, in its continual pursuit of excellence in safety has established a goal of zero contractor injuries. To attain this goal it will be necessary for the Contractor management personnel to communicate to the workers an expectation of zero injuries; that it is no longer acceptable to take chances; that shortcuts taken because of laziness or even while trying to do an efficient job are no longer welcomed; that praise for shortcuts or chance-taking will not exist. It is imperative that Contractor management clearly sets forth the expectation for zero injuries so that the workers can begin to believe that the company is truly serious about safety. From the standpoint of worker psychology, zero is the only supportable goal. In attaining zero-injury performance, there is no substitute for the concept of setting and communicating safety performance expectations to the workers.

SCOPE OF WORK

INSTALLATION of TELECOMMUNICATIONS INFRASTRUCTURE & REMOVAL of

EXISTING AD-HOC INFRASTRUCTUE WIRING

GENERAL: The United States Army Corps of Engineers, Albuquerque District, Trinidad, Colorado, Resident Office, in accordance with UFC 3-580-01, Change 1, dated 01 June 2016, requires a complete turn-key solution including (Power (A/C), HVAC, Lighting, Telecommunications Design/Build-Out of a Government Furnished 8’x 10’Closet with Structured Telecommunications cabling, implementing TIA 568-C.0, T568A configuration Standards based (36) Cat 6A (UTP) facility infrastructure wiring -- home-running back to designated telecommunications area, adjacent to existing communications equipment area. This requirement includes a 6-Strand Multi-Mode Dark Fiber to the Front Entrance false ceiling area for future initiatives as identified in Attachment-2; and a 6-Strand Single-Mode Fiber backbone that extends communications from the main facility telecommunications area to the Trinidad Lab Facility, approximately 550’ from the main facility that shall follow along the exterior compound chain-link fence in a hardened electrical conduit with appropriate pull boxes to meet industry stand bend radius. The Contractor shall implement standards based (6) Cat 6A within the LAB Area located as identified in Attachment-3, home-running back to a Wall-Mount Equipment Rack along with the Fiber and GFE. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

BACKGROUND: The Trinidad Resident Office has an ad-hoc telecommunications infrastructure currently home-runned back to an area within the shop & storage area, see Attachment-2. Current equipment and patch panel are located on a 2-Post non-secured floor rack that houses the sites Cisco router, switch, & UPS adjacent to the sites telecommunications wiring & MPO area. The Minimum Point of Entry (MPOE) is located on the North corner side of main facility identified on Attachment-1. There is no formal telecommunications closet, only an ad-hoc area which requires an all-in-one solution that includes the relocation of existing telecommunications equipment approximately 20’feet from current location to the new designated location. The Contractor shall coordinate with the commercial telecommunications vendor to relocate existing MPO equipment. Throughout the facility, there is an approximately 24” depth/height of false ceiling structure with multiple panels of 2’x 4’ ceiling tiles throughout the Front Office, Break-Room and Hallway areas that provides access to the above ceiling area.

Ad-Hoc infrastructure wiring is loosely directed to specific locations (not in conduit), just penetrating down the walls to desk locations. Currently there is no Fiber located throughout the facility, only Cat 5e.

SITE VISIT: The Government POC – Jack W. Ramsey III, 505-217-8309, will be on-site August 3, 2017, from 10:00AM – 2:00PM to allow contractors to view the site and submit potential questions. Questions and requests for clarification shall be submitted to the Contract Specialist Stephanie Parra, Stephanie.N.Parra@usace.army.mil, within 5 calendar days.

SCOPE: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision to perform to perform the requirements below. Due to the nature of work by the government at this location, the existing infrastructure telecommunications wiring must stay in place and operational until cutover date, which will be determined by agreement of both the Contractor and government POC, at which time, the Contractor shall remove and properly dispose of all the old infrastructure wiring and associated abandoned material used to support their travel path.

Installation & Delivery of Professional Services require prior coordination with the Government POC: Jack W. Ramsey III, 505-217-8309 & the District Security Personnel listed.

All actions are to be completed within 180 Calendar Days after contract award. The Contractor shall document “ALL” Test results, and submit prior to invoice.

Turn-Key – All in One Complete Solution:

TELECOMMUNICATIONS CLOSET: As stated above, currently there is an ad-hoc telecommunications area located in the Storage/Shop bay. The District has designated a Government Furnished 8’ by 10’ room with external access (North Side) as the new location to formalize a Telecommunications Room (TR). The Contractor shall design & install a standard based Cat 6A infrastructure using ANSI/TIA/EIA-569-A standards based Telecommunications Closet baseline that facilitates 36 Cat 6A, six (6) Multi-Mode Fiber, & six (6) Single-Mode “Dark Fiber” connections to include the MDF, Cross-Connects, Patch Panels on one (1) Fire Resistant ¾” plywood mounting board (width of the closet, not to exceed 8’). The Contractor shall work with the Local Exchange Carrier (LEC) POC to coordinate the relocation of existing Telecommunications equipment to include the relocate & extension to the right side of the telecommunications closet (Data, Fiber, Digital Voice Circuits and Analog Lines). All internal telecommunications distributed wiring will be installed on the left side of the Telecommunications Closet with sufficient patch panels to house the necessary wiring. The following shall be included:

POWER: The Contractor shall assess and leverage existing facility power to install two (2) 20-AMP /110 AC Dual Outlets within the Telecommunications Closet. Location of those (2) 20-Amp/110 AC outlets will be installed according to local & national building codes. The Contractor shall also install the necessary power for sufficient lighting and the HVAC requirements on separate circuits. Location of Facility Electrical Panels are identified in Attachment-2.

NOTE: Power Panels are approximately 150’feet away from the new Designated Telecommunications area in which the Contractor will have to extend as appropriate using Local and National building codes. The electrical panels are located in the drive-in garage bay that has 30’ high walls with concrete and metal beams spaced every 15’ relating to pathway. The electrical pathway shall be securely attached to predetermined ceiling beam.

HVAC: The Contractor shall install a ~10,000 BTU or equivalent wall-mounted HVAC Cooling & Venting System sufficient to maintain 65-to-72-degrees year round.

LIGHTING: The Contractor shall install two (2) Auto-Motion 4’ x 1’ LED Lights facing installed wall-mounted equipment within the Telecommunications Closet.

STRUCTRURED TELECOMMUNICATIONS: The Contractor shall install the necessary components (MDF/IDF) to support 36 Cat 6A Infrastructure wiring & 6-Strand Multi-Mode Dark Fiber that shall be distributed throughout the main facility as depicted in Attachment-2.

The Contractor shall utilize available wall conduits where applicable, and shall plan to use color coordinated wall Panduit for most installations of Cat 6A. The Dark Fiber will run from the Telecommunications Room (TR) to the Front Entrance ceiling area with a 25’Service Loop coiled up & labeled in the ceiling awaiting future initiatives. The Contractor shall provide the necessary patch cables needed to complete connection from wall port to device endpoints. The Contractor shall use multiple flexible non-metallic conduit with J-Hook and Velcro for all pathways located within the false ceiling areas. Within the drive-in garage area, the Contractor shall utilize the appropriate electrical conduit & support, to securely fasten the infrastructure wiring conduit. The Contractor & Government POC shall determine the most appropriate pathway, note, requested pathway is identified in Attachment-2, but can be altered.

The Contractor shall also install six (6) Strand Single-mode Fiber in 1” metal conduit from the TR to the Lab Facility (external) approximately 550’ running along the path of the compound chain link fence with four (4) Pull-Panels strategically positioned to ensure bend radius requirements are maintained, Attachment-1. The Contractor shall install 1” metal conduit for external penetration to fence line, buried 18” under surface with appropriate bend radius considered. At opposite end going into the Lab facility, the Contractor shall bury the 1” conduit a minimum of 18” below the surface with appropriate bend radius considered to enter the facility where the Contractor shall install the necessary 36” Wall Mount Cabinet (front opening) to house the Fiber connections, and GFE equipment.

STRUCTURED INFRASTRUCTE WIRING – LAB FACILITY: The Contractor shall install six (6) Cat 6a infrastructure wiring with associated parts/material throughout Lab Facility, as identified on Attachment-3, home-running back to a Port Patch Panel secured in a Key-Lock Wall Mount “Swing Access” Communications Rack. The Contractor shall determine appropriate size sufficient to house the incoming Fiber & associated parts/material from the main facility and the copper internal wiring of the lab facility.

The Contractor shall utilize wall conduit, where available. When not present, the Contractor shall use color coordinated Panduit.

NOTE: Attachment-2 identifies location, number of connections and depicts the desired backbone path for the flexible conduit required. The use of flexible conduit must be securely attached to facility frame, where possible. Where the Cat 6A wiring transitions from the false ceiling into an office area, Panduit raceway shall be used in the corners to provide an aesthetically integrated path to the wall mounted dual or single faceplate connection. All cabling shall be tested and documented for operability & historical reference and provided prior to invoicing.

LABELING: All newly installed wiring shall be labeled at both ends and documented on As- Builts. Labeling of Wall-Jacks shall correspond appropriately with patch panel. Black Labeling with white background.

DOCUMENTATION: The Contractor shall provide a One (1)-Year warranty for (Parts/Workmanship); The Contractor shall provide three (3) As-Built drawings (Hardcopy) & one (1) Electronic PDF format on a CD-ROM or flash drive to be included with invoicing actions.

REMOVAL of AD-HOC INFRASTRUCTURE WIRING: The Contractor and Government POC shall cutover to the new infrastructure on a pre-agreed date; once work has been accepted, the removal & disposal of AD-HOC Wiring and associated material shall commence and be removed from government property by the Contractor. Final inspection and sign-off will be within one (1)-week after completion of all tasks.

INVOICING: This requirement may require multiple invoicing for completed stages of work (25%, 50%, 75% & 100%) after validation & concurrence with Site Manager & Government POC of stated milestones. Invoices shall be sent to the USACE Finance Center by mail to the address in Block 15, or they may be e-mailed to CEFC-L4Invoices@usace.army.mil along with Jack Ramsey, Jack.W.Ramsey@usace.army.mil, and Bernadine Cisneros, Bernadine.B.Cisneros@usace.army.mil.

PERIOD OF PERFORMANCE: All actions shall be completed within 180 Calendar Days from time of award; then one (1)-Year of warranty on material & and workmanship.

HOURS OF OPERATION: The Contractor is responsible for conducting business between the hours of 0800-1630 Hours, Monday thru Friday, accept Federal holidays or when the

Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

SECURITY REQUIREMENTS: Contractor personnel performing work under this contract must have a Valid Driver’s License and (1) Photo ID when checking into Trinidad’s Front Office with prior Security Desk approval. Once verified, the Contractor shall be assigned a daily security badge to allow access. Upon the completion of duties, the Security Badge is returned to Site Manager for accountability. Check-In with local Tech support is mandatory prior to any support activity beginning --- to discuss planned actions. Notification of at least 48-hours prior to commencement of Professional Services is mandatory.

ACCESS AND GENERAL PROTECTION/SECURITY POLICY AND PROCEDURES:

All Contractor and all associated subcontractor employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The Contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. The Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes.

SUSPICIOUS ACTIVITY REPORTING TRAINING (CORPSWATCH): The Contractor and all associated subcontractors shall receive a brief/training on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after contract award, http://corpslakes.usace.army.mil/visitors/corpswatch.cfm.

ESCORTING: All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

PHYSICAL SECURITY: The Contractor shall be responsible for safeguarding all Government equipment, information and property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured, access badges turned in to security and signed out by District assigned sponsor.

SPECIAL QUALIFICATIONS: Contractor employees will work with the local IT Staff for related issues requiring any special certification requirements for employees, if deemed appropriate. The Contractor is responsible for ensuring all employees that support this contract, at a minimum, are Vendor specific Certified Technicians to ensure timely service and repair to minimize installation time for this mission critical system, this is to include man-hole safety training and certification.

POST AWARD CONFERENCE/PERIODIC PROGRESS MEETINGS: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work. The name of this person, and an alternate who shall act for the Contractor when the manager is absent, shall be designated in writing to the Contracting Officer. The Contract Manager, or alternate, shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The Contract Manager, or alternate, shall be available between 0800-1600 Monday thru Friday except Federal holidays or when the Government facility is closed for administrative reasons.

IDENTIFICATION OF CONTRACTOR EMPLOYEES: All contract personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed. The Contractor will be required to sign-in and obtain a security badge that must be displayed at all times.

DATA RIGHTS: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government.

These documents and materials may not be used or sold by the Contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

52.203-19 PROHIBITION ON REQUIRING CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS OR

STATEMENTS (JAN 2017)

(a) Definitions. As used in this clause-- Internal confidentiality agreement or statement means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.

Subcontract means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.

Subcontractor means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.

(b) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

(c) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.

(d) The prohibition in paragraph (b) of this clause does not contravene requirements applicable to Standard Form 312 (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(e) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015, (Pub. L. 113-235), and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions) use of funds appropriated (or otherwise made available) is prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.

(f) The Contractor shall include the substance of this clause, including this paragraph (f), in subcontracts under such contracts.

The Contractor's representations and certifications, including those completed electronically via the System for Award Management (SAM), are incorporated by reference into the contract.

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 120 calendar days from receipt of notice to receive. The time stated for completion shall include final cleanup of the premises.
