SECTION 00 22 00

SUPPLEMENTARY INSTRUCTIONS

PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS

1. OVERVIEW

a. The intent of this solicitation is to select a responsible and responsive contractor for the Oceanside Harbor Maintenance Dredging San Diego County, CA.

b. The Source Selection Process is Lowest Price Technically Acceptable, IAW FAR 15.101-

2. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.

c. Proposals, (Price and Technical) should parallel the submission requirements identified in the paragraphs below.

2. REQUIREMENT FOR SEPARATE PRICE AND TECHNICAL PROPOSAL

a. Each offeror must submit both a Price Proposal and a Technical Proposal. The Price Proposal and the Technical Proposal must be submitted as separate (i.e., physically distinct) volumes. Both the Price Proposal and the Technical Proposal must be received by the closing date and time set for receipt of proposals.

b. The Price Proposal (Volume 1) must include the signed SF 1442, “Solicitation Offer and Award”, including acknowledgement of all amendments; the completed Solicitation, Contact Line Item Number (CLIN) Schedule; the Offeror’s official online System for Award Management (SAM) Representations and Certification; Bid Bond, and any other requirements described in paragraph 3 below.

c. The Technical Proposal (Volume 2) consists of all information and material submitted or provided for evaluation in response to the technical (non-cost) evaluation factors and any significant sub factors specified in both this Section and Section 00 22 16. The purpose of the technical evaluation is to assess the quality of each offer (i.e., the quality of the proposed product or service), to determine the capability of each offeror, and to determine the ability of each offeror to perform the perspective contract successfully.

Offerors submitting proposals for this project should limit submission to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing the information required herein. However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the offeror’s experience, technical approach and management capabilities to successfully complete the project. Proposals should follow the order sequence set forth in the RFP.

3. GENERAL INSTRUCTIONS

a. Who can submit: Any legally organized offeror may submit a proposal. Construction contractors that have associated specifically for this project, consortia firms or any other interested parties may submit proposals.

Any firm that contributed to and/or participated in preparation of this solicitation, whether as a Government contractor or as a subcontractor to a Government contractor, is not eligible to participate in this solicitation as a prime contractor due to a conflict of interest. The Government considers such firms to have an unfair competitive advantage, and therefore will not consider such firms if proposed.

b. Where to Submit Proposals:

Submit proposal packages to U. S. Army Corps of Engineers at the address shown in Block 7 of Standard Form 1442 in this solicitation. The Government must receive your proposal no later than the time and date specified in Block 13 of Standard Form 1442 in this solicitation. Any and all amendments shall be acknowledged by completion of Block 19 of the Standard Form 1442 and returned with your proposal.

c. Price Proposal and Technical Proposal (Volumes 1 and 2) shall be submitted in hard copy three ring binders. Do not use plastic multi-hole/spiral binding systems, heat binding systems, or other systems which do not facilitate the ready insertion of additional pages.

Proposals shall be tabbed and labeled in a manner to afford easy identification from a Table of Contents. Font size shall not be less than 10 point. Each page shall be identified with the appropriate page number centered at the bottom of the page. Sheet size of the proposal contents shall be 8-1/2 inches x 11 inches except for preliminary schedule which will be on 11 x 17 inches foldout.

d. Volume 2, Technical Proposal, shall not exceed 20 pages, excluding Table of Contents.

The Government will not be obligated to evaluate any information beyond the page limitation noted above. The offeror shall not submit verbatim sections of this solicitation as part of their proposal. Offerors that do not meet these requirements may be subject to rejection.

e. Proposal revisions shall be submitted as page replacements with revised text readily identifiable, e.g., bold face print or underlining. The source of the revision, e.g., Error, Omission, or Clarification, or amendment shall also be annotated for each revision.

Proposal replacement pages shall be numbered, shall be clearly marked “REVISED” shall show the date of the revision, shall be submitted in appropriate number of copies e.g., if two (2) copies of the original page were required, then two (2) copies of the revised page will also be required, and shall be a different color than the original page they are to replace.

f. Please ensure that the outside of each separate volume is clearly marked to indicate its contents and the identity of the offeror. Additionally, the original cost/price proposal and

00 22 00 - 3 Amendment 0001 original technical proposal should be clearly indicated on the outside cover. The technical proposal shall not contain any price proposal information.

g. “Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation purposes as specified herein can nonetheless be provided to the Government as part of the offeror’s technical proposal. Offerors that include in their proposals information that they do not want to disclose to the public for any purpose, or used by the Government except for evaluation purposes, must be clearly marked in accordance with the instructions at FAR 52.215-1, “Instructions to Offeror- Competitive Acquisition,” paragraph (3), “Restrictions on disclosure and use of data.”

4. SPECIFIC INSTRUCTIONS FOR THE PRICE PROPOSAL, VOLUME 1

a. Number of Sets of the Price Proposal

Submit the Original and one (1) additional set of the written Price Proposal (i.e., the Original and one (1) copy of all of the information required below, with each set separately packaged). Additionally, in the same envelope, the offeror is to provide the entire proposal (Volumes 1 and 2) in Portable Document File (PDF) format on compact disk. Provide one CD copy of each volume.*

b. Format and Contents of the Price Proposal/List of Tabs

The Original and all copies of the price proposal shall be appropriately labeled as such, shall be organized as indicated below, and shall be comprised of the following:

Proposal Cover Sheet. The proposal cover sheet is required by FAR 52.215-1(c) (2). This provision, entitled “Instructions to Offerors—Competitive Acquisition,” has been included in full text in Section 00 21 16. Provide the following information in the Proposal Cover Sheet:

• Solicitation number.

• Name, address, telephone and facsimile numbers of the Offeror (and electronic address if available).

• DUNS, CAGE, and tax identification numbers of the Offeror.

• Statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and the offeror’s agreement to furnish any or all items upon which prices are offered; at the price set opposite each item as reflected on the proposal schedule.

• Names, titles, telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the Offeror’s behalf with the Government in connection with this solicitation.

• Acknowledgment that the offeror is registered in the System for Award Management (SAM) database as required by FAR Clause 52.204-7, System for Award Management and DFARS 252.204-7004, Alternate A, System for Award Management.

TAB CONTENTS OF THE PRICE PROPOSAL

#1 Tab A shall contain a completed SF 1442, “Solicitation, Offer and Award” including the Certifications, Section 00 01 05. The SF 1442 and the Certifications shall be completed by the offeror and duly executed with an original signature by an official authorized to bind the company in accordance with instructions at FAR 4.102.

#2 Section 00 10 00, Solicitation, Contract Line Item Number (CLIN) Schedule. The complete Solicitation, Contract Line Item Number (CLIN) Schedule with the Offeror’s proposed contract line item prices inserted in the appropriate spaces. Prices must be proposed for all contract line items and prices sub-line items, if any. Unit prices are to be extended to the actual “dollar and cents” amounts (i.e., to two decimal places). Do not round off to the nearest dollar. Check your pricing submissions very carefully for mathematical and clerical errors prior to submission.

#3 Official Online System for Award Management Representations & Certifications

#4 A Bid Guarantee, Standard Form 24, “Bid Bond.”

#5 Pre-Award Survey Data Information (e.g. Bank and Supplier References)

In accordance with FAR 9.103(a)… contracts shall be awarded to responsible prospective contractors only. To be determined responsible, a prospective contractor must meet the standards at FAR 9.104 that requires a prospective contractor to have adequate financial resources to perform the contract or the ability to obtain them. As an aid in assessing responsibility, the offeror shall provide a letter from their bank or financial institution that contains the following:

Name and telephone number of bank and point of contact;

Number of year’s business has be conducted with each bank;

Types of open accounts (checking, loans, etc);

Balance of current accounts (the banks will provide a “range of figures” for this information, such as, medium five figures range);

Means by which loans are secured and if paid as agreed.

For the purpose of evaluating the pre-award survey information submitted hereunder:

Pre-award survey data information will be evaluated as it relates to the probability of the offeror successfully accomplishing the proposed effort.

The Government will use pre-award-survey data provided by the offeror and data obtained from other sources to perform this assessment.

5. SPECIFIC INSTRUCTIONS FOR THE TECHNICAL PROPOSAL, VOLUME 2

THE TECHNICAL PROPOSAL SHALL NOT INCLUDE ANY COST INFORMATION

AND SHALL NOT EXCEED 20 PAGES.

a. Number of Sets of the Technical Proposal

Submit the Original and three (3) additional sets of the written Technical Proposal (i.e., the Original and three (3) copies of all of the information required below, with each set separately packaged).

b. Format and Contents of the Technical Proposal/List of Tabs

The original and all copies of the technical proposal shall be appropriately labeled as such, shall be organized as indicated below, and shall be comprised of the following:

6. TECHNICAL PROPOSAL SUBMISSION REQUIREMENTS

Proposals will be evaluated in accordance with the factors listed below. Offerors are reminded to include their best technical and capability information in their initial offer and not assume that they will have an opportunity to participate in discussions or be asked to submit a revised proposal.

a) Where the word “similar” appears it is understood to mean equivalent in type, size, scope, schedule, and complexity as these project requirements.

b) Where the word “recent” appears it is understood to mean projects that have been 100% completed (final construction documents completed) within five (5) years of the RFP issue date. A “recent” construction type project is defined as a construction project for which design is 100% complete and the construction is a 100% complete (measured by performance period days) as of the RFP issue date or a construction type project that has been completed and turned over to the owner within five (5) years of the RFP issue date.

c). Where the word “relevant” appears it is understood to mean that project experience is similar and logically connected to the context of this solicitation in terms of scope (similar type of work, size, effort, complexities, and dollar value, etc) as the work described in this solicitation. Regarding “relevant” prime construction contractor work, the Government will consider the type of work features self-performed, on-site by the Prime Contractor’s own organization in addition to construction management effort. “Relevant” past performance information is one indicator of an Offeror’s ability to perform the contract successfully

FACTOR 1 – EXPERIENCE (Volume 2, Tab #1)

Submission requirements:

For this factor, the offeror shall submit two (2) project summaries of construction projects which best illustrate his/her experience on projects, preferably of a similar type as this project. Projects considered similar include: open ocean maintenance dredging projects.

Each project summary should consist of no more than a two (2) page narrative of the project that address the following:

Safely operating a piece of dredging equipment in an open ocean (beyond the line of demarcation), high wave energy environment (see para 1.14 of section 01 11 00), dredging an approximate average of 15,000 cubic yards per day. Additional information shall include the design and dredge depth of the project and final pay quantity for the project.

Dredging and placing material on adjacent downcoast beaches including the length and width of the beach created and distance of the pump to the discharge site.

Describe, in detail, the type of equipment used to perform the work including the dredge plant, support vessels, and earthmoving equipment. Specific information shall be included such as the name, size and freeboard of the dredge, along with the diameter of the discharge line.

No more than two (2) projects may be submitted. If more than two (2) construction projects are submitted from the offeror, only the first two (2) submitted for the firm will be evaluated, starting from the most recent and working backwards in time. Each project cited should have a construction dollar value ranging from $3,000,000 .00- $15,000,000.00, with one (1) project exceeding $5,000,000.00 and completed within five (5) years of the RFP issue date. An IDIQ contract may be submitted only if a single task order meets the requirements of this factor. Only projects that were constructed within the United States will be considered meeting the requirements of this section. Each project example shall demonstrate relevant experience to the proposed acquisition, with “relevant experience” being defined as experience on projects that are similar to this project. Summaries may also include non-government private sector projects of similar type. Each summary shall include the following: a description of the project; construction contract award amount;

final construction cost; location; date when the project was started; original contract finish date and actual finish date. All summaries shall contain the name, address, telephone and email address of a representative of the owner (as well as one alternate individual not affiliated with your firm) familiar with your firm’s experience on the project that can verify the experience cited. (Attachment No. 1 is provided for your use).

Only projects that were constructed within the United States will be considered meeting the requirements of this section.

FACTOR 2 – SCHEDULE (Volume 2, Tab #2)

Submission requirements:

Show a schedule (mobilization/dredging activities/demobilization) that demonstrates completing the project within the allotted period of performance (55 days) and complying with paragraph

1.19 section 01 11 00 of the technical specification that states “The Contractor will not perform any work on Oceanside beaches during the summer months, specifically starting from the Friday before Memorial Day up to the Tuesday following Labor Day”.

Include a narrative that describes the schedule, what pieces of equipment you propose to use to accomplish the work including the dredge plant, discharge pipeline, support vessels and earthmoving equipment (include dimensions of all equipment). All marine plants proposed to be used for the RFP project must comply with paragraph 3.13, section 35 20 23 of the technical specification.

For the purpose of developing the schedule, assume NTP is issued no later than 30 March 2017.

FACTOR 3 – PAST PERFORMANCE (Volume 2, Tab #3)

Submission requirements:

The Offeror shall demonstrate recent, relevant past performance on projects of a similar type as this project. The Offeror may use the Attachment (2) at the end of this section. The Offeror may identify state and local government and private contracts that are similar to the requirements of this solicitation. The projects submitted for Past Performance must include the projects submitted for Experience (Tab A - Factor 1).

a) Where the word “project(s)” appears in this RFP Section it is understood to mean a project, contract(s), task order(s), or any other contract document provided for by the Federal Acquisition Regulation (FAR 2.101). Examples of projects submitted by the Prime Construction Contractor may be projects performed for a State or Federal Government Agency; or for a commercial or private sector customer. If projects were design/build projects, so identify them.

There are two aspects to the past performance evaluation. The first is to evaluate whether the offeror’s past performance is recent and relevant or not to the context of this solicitation in terms of scope (similar type work, size, effort complexities). The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts.

(1) RELEVANT COMPANY EFFORT. The Offeror shall provide a list of two (2) of its most “recent”, relevant”, construction type projects performed as a prime construction contractor over the last five (5) years, so as to demonstrate construction type effort similar to the work required in this solicitation. For each “recent”, “relevant” project example, the Offeror shall furnish the information specified below, (Attachment 2 is provided for your use). At a minimum provide the following information:

(4) General Scope of Construction Project

(5) Your Role (Prime, Joint Venture, Subcontractor)

(6) Construction Type Work Features Your Company Self-Performed (other than construction management)

(7) Construction Cost (award, completion and explanation of any cost growth)

(8) Extent and Type of Work Subcontracted Out (identified in both dollars and trade)

(9) Construction Began and Completion Dates (Provide Month/Year and any explanation of any time growth)

(10) Your Performance Evaluation by Owner, if Known

(11) Termination or Liquidated Damages Information; Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.

(2) QUALITY OF PAST PERFORMANCE. The Offeror is to submit in its initial proposal a Past Performance Questionnaire, (see Attachment 2), fully completed by the project owners, for each of the projects being submitted in response to the submission requirements of this factor. CCASS/CPARS Reports and other types of performance survey forms, signed by a commercial customer or signed by a representative from another Federal or State agency, may be submitted as long as the information submitted has the same or similar information as indicated in the survey at the end of this section, documenting the quality of the Prime Construction Contractor’s performance for the projects submitted. Letters of Recommendation or Appreciation are considered

00 22 00 - 10 Amendment 0001 supplemental information to demonstrate customer satisfaction and are not considered equal to past performance surveys.

(a) The Offeror may also provide in its initial proposal, information (i.e., letters of appreciation, safety awards, customer awards, etc.) of other completed projects to further demonstrate owner satisfaction with the Offeror’s general trend in construction performance. Information submitted must be “recent” and “relevant” as previously defined.

(b) If an Offeror has been required to take corrective action for any substandard performance, the Offeror should explain the circumstances and the corrective actions taken. If an Offeror has experienced other performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc., the Offeror should explain.

(c) Verification: The Government reserves the right to verify the experience record of cited projects, or other recent projects not submitted by reviewing the Past Performance Information Retrieval System (PPIRS) or other Government appraisal systems or by interview of the owner or references. The Government may check any or all cited references to verify supplied information. An Offeror will be afforded the opportunity to reply to or explain adverse past performance information to which the Offeror has not previously had an opportunity to address.

PAST PERFORMANCE QUESTIONNAIRE INSTRUCTIONS

The Past Performance Questionnaire included in the solicitation (found at Attachment 3 2), is provided for the offeror or its team members to submit to the client for projects the offeror includes in its proposals for FACTOR 3, PAST PERFORMANCE. Ensure correct phone numbers and email addresses are provided for the client point of contact.

Completed Past Performance Questionnaires should be submitted with your proposal. If the offeror is unable to obtain a completed Past Performance Questionnaire from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the Past Performance Questionnaire (Attachment 2), which will provide contract and client information for the respective project(s). Offeror should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contract, Patricia Bonilla, via email at patricia.b.bonilla@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal Past Performance Questionnaires previously submitted for other RFPs. However, this does not preclude the government from utilizing previously submitted Past performance Questionnaire information in the past performance evaluation.

Also include performance recognition documents received within the last five (5) years such as awards, customer letters of commendation, and any other forms of performance recognition.

In addition to the above, the Government may review any other sources of information for evaluating past performance. SECTION 00 22 16

SUPPLEMENTARY INSTRUCTIONS TO PROPOSERS

PROPOSAL EVALUATION AND CONTRACT AWARD

1. GENERAL

a. A Source Selection Evaluation Board (SSEB) comprised of representatives of the Corps of Engineers, User/Customer, and other required personnel, will evaluate the proposals. Offerors are advised that the technical evaluation and rating of the proposals will be conducted in strict accordance in with Sections 00 22 00 and 00 22 16 of the solicitation. In addition, technical proposals are first reviewed and rated by the SSEB without knowledge of the price offered. The number and identities of offerors are not revealed to anyone who is not involved in the evaluation and award process or to other offerors. Proposals will be evaluated on the factors/sub-factors described herein. The lowest price technically acceptable source selection process will be used for this acquisition. This process allows the Government to select a technically acceptable proposal with the lowest evaluated price. Reference FAR 15.101.2.

b. Offerors are reminded to include their best technical and price terms in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer.

2. ELIGIBILITY FOR CONTRACT AWARD

In accordance with FAR 1.602-1(b), no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and other applicable procedures, including clearances and approvals, have been met. This includes the requirement of FAR 9.103 that no award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must meet the general standards in FAR 9.104-1 and any special standards set forth in the solicitation in accordance with FAR 9.104- 2.

3. EVALUATION PROCESS

The evaluation process essentially consists of three parts: proposal compliance review and responsibility determination, technical/ evaluation, and price evaluation.

a. Proposal Compliance Review: This is an initial review by Contracting Division on the basis of the Request for Proposals (RFP) requirements. This review may eliminate those proposals which fail to provide all required information and documents in the format and detail specified. This review is to ensure that all required forms are complete.

b. Technical Evaluation: The SSEB will evaluate and rate those proposals passing the first review, above. Proposals will be evaluated against the RFP requirements. Factors will be rated on an “acceptable or unacceptable” basis.

c. Price Evaluation: The SSEB, using price advisors as necessary, will evaluate the price proposals received in response to the solicitation. Prices will be evaluated for unbalancing of line items, fair and reasonableness and realism. Price will not be evaluated with a rating system, but will be evaluated through the use of cost/price analysis. To determine price reasonableness and affordability, the SSEB will compare the individual proposed price to the Government Estimate.

Prices will not be revealed to any SSEB members until completion of the technical evaluations, including consensus.

4. EVALUATION CRITERIA AND RATING SCHEMES FOR VOLUME 2

General Evaluation Criteria. The government will evaluate and rate Volume 2, non -cost/ price technical information, using the rating schemes described below:

5. PROPOSAL EVALUATION

ACCEPTABILITY STANDARDS: In order to be considered technically acceptable, proposals must be submitted in writing and must meet the following minimum requirements:

FACTOR 1 – EXPERIENCE (VOLUME 2, TAB #1)

Evaluation Criteria:

The Source Selection Evaluation Board (SSEB) will evaluate both the extent and quality of recent experience for compliance with the minimum requirements identified in the offeror’s non-cost/price proposal. To receive an “acceptable” rating, the offeror shall submit 2 projects that have been completed or substantially complete within the last five (5) years of the RFP issue date, which are similar to this project in size and complexity. Projects considered similar include:

maintenance dredging projects that have occurred in open ocean, high wave energy environments. Each project summary should consist of a one or two page narrative of the project that address the following:

Safely operating a piece of dredging equipment in an open ocean (beyond the line of demarcation), high wave energy environment (see para 1.14 of section 01 11 00), dredging an approximate average of 15,000 cubic yards per day.

Additional information shall include the design and dredge depth of the project and final pay quantity for the project.

Dredging and placing material on adjacent downcoast beaches including the length and width of the beach created and distance of the pump to the discharge site.

Describe, in detail, the type of equipment used to perform the work including the dredge plant, support vessels, and earthmoving equipment. Specific information shall be included such as the name, size and freeboard of the dredge, along with the diameter of the discharge line.

Each project cited should have a construction dollar value ranging from $3,000,000 .00- $15,000,000.00, with one (1) project exceeding $5,000,000.00 and completed within five (5) years of the RFP issue date. Prime contractor/subcontractor experience given that does not meet these requirements will be given a rating of “unacceptable” for this factor.

FACTOR 2 – SCHEDULE (VOLUME 2, TAB #2)

Evaluation Criteria:

In order to get an “Acceptable” rating on Factor 2, the offeror shall provide a schedule that shows the entirety of the work being completed, including mobilization and demobilization, within the 55 day period of performance and not working past the Friday before Memorial Day (paragraph 1.19, section 01 11 00). All marine plants proposed to be used for the RFP project must comply with paragraph 3.13, section 35 20 23 of the technical specification.

If the schedule shows the work not being completed within the 55 day period of performance, work on the beach past the Friday before Memorial Day or proposing to use marine plants that do not comply with paragraph 3.13, section 35 20 23 of the technical specification, this factor will be rated “Unacceptable”.

FACTOR 3 – PAST PERFORMANCE (VOLUME 2, TAB #3)

Evaluation Criteria:

The SSEB will assess how well the offeror performed on the projects submitted. To receive an “Acceptable” rating for this factor, the offeror’s past performance must be recent and relevant, as defined in Section 00 22 00, Factor 3. In addition, all projects listed must have received a rating of satisfactory or above. Any rating less than “Satisfactory” will result in a rating of “Unacceptable” for this factor.

In case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so spare that no meaningful past performance rating can be reasonably assigned; the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “Acceptable.”
