REQUIREMENT SPECIFICATIONS
Non-Tactical Vehicle Contract for AFSBn-Germany Żagań, Lubuskie, Poland
1. Introduction: This is a fixed price supply contract to provide eight (8) Five-Passenger Sport Utility Vehicles (SUVs) within Poland. The Contractor shall provide all equipment and transportation necessary to provide the non-tactical vehicles as required by the CLIN Description, ELINs, Delivery Schedule and Requirement Specifications.
The Contractor shall perform to the standards in this contract and the requirements stated herein.
1.1. Background: US Soldiers and Department of the Army (DA) civilians in Poland and adjacent training areas require transportation assets to support training initiatives with the host nation beginning 15 March 2019.
1.2. Objectives: The objective of this contract is to provide a sustainable and economical non-tactical vehicle fleet to US Soldiers and DA civilians in Poland. These vehicles must be capable of meeting mission requirements, to include engine size, ground clearance, passenger seats, and storage space. The contract must also provide vehicle pick-up and delivery services to the specified locations. The contract shall also provide vehicle recovery and assistance for the U.S. Soldiers and DA civilians. The contractor must maintain an outside of normal duty hours helpline for emergency assistance. The contract must also provide flexibility to allow U.S. Soldiers and DA Civilians to trade vehicles as mission dictates.
1.3 Functional Areas: The contract shall include delivery, insurance, maintenance and vehicle recovery and assistance for all NTVs supplied under this requirement. Details on the complete scope of the NTV requirements are outlined in Parts 4 and 5.
1.4. Period of Performance: The period of performance shall be 12 months, with two one-year option periods. The periods are as follows:
Base Year: 15 March 2019 – 14 March 2020 Option Year 1: 15 March 2020 – 14 March 2021 Option Year 2: 15 March 2021 – 14 March 2022
1.5. Management and Administration:
1.5.1. Contractor Management: The Contractor shall perform continual management of the functional areas contained in this Requirements Specifications and shall provide a Contract Manager who shall be responsible for the requirements. The Contract Manager shall conduct overall management coordination and shall be the central point of contact (POC) with the Government for performance of all work under these Requirement Specifications. An alternate Contractor employee shall be designated to act for the Contract Manager when work is being performed outside of duty hours, or during the Contract Manager’s absence. Both the Contract Manager and alternate shall have full authority to act for the Contractor on all contract matters relating to this requirement. The Contractor shall submit to the Unit POC, in writing, the name, title, mobile telephone number and e-mail address of the Contract Manager and alternate within 72 hours after contract award.
1.5.2. Contractor Responsiveness: The Contract Manager, or designated alternate, shall be available for telephone communication with the Unit POC, as required by the Unit POC, 24 hours a day, 7 days a week. A personal answering service is permitted at other than normal contract workdays and work hours for receipt of Unit POC emergency response work requirements, provided that the Contract Manager or designee responds to all calls within a time not to exceed two (2) hours after notification of the call by the answering machine and/or service. The Contract Manager and any individuals designated to act in that capacity shall have full authority to contractually bind the Contractor for prompt action on matters pertaining to execution of the Requirement Specifications.
1.5.3. Hours of Operation: The Contractor is responsible for conducting business as necessary in order to meet the requirement outlined in these Requirement Specifications. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within these Requirement Specifications. The Contractor shall provide a contact number with 24-hour availability for emergency maintenance issues within 72 hours after contract award.
1.5.4. Recognized Holidays: See clause 5152.204-4000 “U.S. and Host Nation Holidays”.
1.5.5. Quality Control: The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with the Requirement Specifications. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which he assures that his work complies with the requirements of the contract.
1.5.6. Quality Assurance: The Unit Point of Contact specified below will monitor the Contractor’s performance under this contract to ensure that the Contractor has performed in accordance with the performance standards. See Paragraph 1.5.15.2. for Unit Point of Contact functions.
1.5.7. Place of Performance: The work to be performed under this contract shall be performed at the place of business of the Contractor or appropriate service provider for procurement, insurance and maintenance as necessary.
All delivery dates and times for initial NTV fleet and replacements shall be coordinated with the Unit POC. The NTVs will be operated in Poland and Germany.
1.5.8. Type of Contract: The Government will award a Firm Fixed Price type contract.
1.5.9. Antiterrorism/Force Protection:
The Contractor and all associated employees will comply with applicable installation, facility, and area commander installation/facility access and local security policy and procedures (provided by Government representative). The Contractor will also provide all information required for background checks to meet installation-access requirements to be accomplished by the installation provost marshal office, director of emergency services, or security office. The Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA, and local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the force protection condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
1.5.10. Physical Security: The Government will provide physical security of the vehicles to ensure that only authorized and licensed drivers operate vehicles.
1.5.11. Key Control: The Government will develop key control procedures to ensure that only authorized and licensed drivers have access to vehicle keys for operation.
1.5.12. Post Award Conference, Briefings and Periodic Progress Meetings: The Contractor agrees to attend, participate in, and furnish input to any post award conference, briefings and meetings convened by the contracting activity or Unit POC in accordance with Federal Acquisition Regulation Subpart 42.5 that relate to the functions and services herein, as required by the Government, to provide effective communication and impart necessary information. The Contracting Officer and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor's performance, and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.
These meetings shall be at no additional cost to the government.
1.5.13. Identification of Contractor Employees: All Contractor personnel attending meetings or working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.
1.5.14. Contracting Officer Representative (COR): A specified Unit Point of Contact will monitor the technical aspects of this requirement in lieu of a COR. See Paragraph 1.5.15.2. below.
1.5.15. Key Personnel: The following individuals are considered Key Personnel by the Government in support of this requirement.
1.5.15.1. Contract Manager: The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work under this Requirement Specifications. The name of this person, and an alternate who shall act for the Contractor when the Contract Manager is absent, shall be designated in writing to the Contracting Officer within 72 hours after contract award. The Contract Manager or alternate shall have full authority to act for the Contractor on all contract matters relating to the daily operation of this contract. The Contract Manager or alternate shall provide a reliable contact number and be able to respond to Government inquiry within 24 hours of inquiry.
The Contract Manager must be capable of speaking and reading English.
1.5.15.2. Unit Point of Contact (POC): The specified Unit POC (Joseph Balum) will monitor all technical aspects of the contract and assists in contract administration. The Unit POC is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; monitor Contractor’s performance and notifies both the Contracting Officer and Contractor of any deficiencies; and provide site entry of Contractor personnel. The Unit POC IS NOT authorized to make changes to the contract especially with regard to changes in cost or price, estimates, or changes in delivery dates.

1.5.16. Contractor Travel: The Contractor will be required to travel to the training area listed in Paragraph 4.2.2. in order to deliver NTVs, conduct maintenance, and meet with the Contracting Officer or Unit POC, as necessary.
Contractor travel shall be at the contractor’s expense.
1.5.17. Other Direct Costs: Vehicle shipping expenses, vehicle recovery and roadside assistance shall be at the Contractor’s expense. Damage identified as originating from normal operation, fair wear and tear, or from operation over rough terrain shall be expensed by the Contractor provided insurance, and is not billable to the requesting unit.
PART 2
DEFINITIONS & ACRONYMS
2. Definitions and Acronyms:
2.1. Definitions:
Contractor - A supplier or vendor awarded a contract to provide specific supplies or service to the government.
The term used in this contract refers to the prime.
Contracting Officer - A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
Defective Service - A service output that does not meet the standard of performance associated with the Performance Work Statement.
Deliverable - Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
Key Personnel - Contractor personnel that are required to be used in the performance of a contract by the Key Personnel listed in the Requirement Specifications.
Physical Security - Actions that prevent the loss or damage of Government property.
Quality Assurance - The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
Quality Control - All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
Subcontractor - One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor
Unit Point of Contact (POC) - Requiring activity representative. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
Work Day - The number of hours per day the Contractor provides services in accordance with the contract.
Work Week - Monday through Friday, unless specified otherwise.

PART 3
GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3. Government Furnished Items and Services:
3.1. Services: Maintenance shall be provided by the Contractor
3.2. Fuel: The U.S. Government (USG) shall be responsible for providing fuel for all vehicles after delivery. There are no minimum fuel requirements upon vehicle turn-in pursuant to this contract.
3.3. Drivers: The USG shall be responsible for providing licensed drivers for all vehicles after delivery.
3.4. Tolls: The USG shall be responsible for all tolls incurred from use of the vehicles.
3.5. Cleaning: After initial delivery, the USG will not be responsible for the cleanliness of the vehicles. Cleaning will be conducted by the Contractor after final turn in.
PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. Contractor Furnished Items and Responsibilities:
4.1. General: The Contractor shall provide specified vehicles and all services required to keep the vehicles in a safe, operational condition. Vehicles shall be delivered within the timeframe agreed to in this contract and must meet the minimum acceptance criteria provided herein.
4.2. Vehicles: The Contractor shall provide initial delivery of all vehicles and subsequent delivery of replacement vehicles to the location stated below. Vehicles shall be available for exchange within 24 hours of notification by the Unit POC in accordance with Paragraph 5.7.
4.2.1. Poland and Germany: The Contractor shall provide the following vehicles:

4.2.2. Delivery and Turn-in Location: The location for delivery and turn-in will be coordinated through the Unit POC and will occur at Żarska 1, 68-120 Żagań, Poland (Military Base). The Contractor shall ensure that all vehicles are available for pickup on 15 March 2019 no later than 3:00 PM and be turned-in 14 March 2020 no later than 4:00

4.3. Vehicle Details: When the vehicles are issued they shall be no more than three (3) years old from the date of manufacture at the beginning of the period of performance. Vehicles shall not have more than 80,000 kilometers at the time of issue. The color requested (in order of preference) is gray, blue, white, or black. Vehicles shall not have any reflective or distinctive markings. Vehicles shall be in compliance with all appropriate registration and insurance requirements throughout the entire period of use. Vehicles shall have Polish license plates.
4.3.1. Air Conditioning/Heater: Vehicles shall have fully functioning air conditioning and heaters.
4.3.2. Kilometers: The U.S. Government requires unlimited kilometers of usage per month for each vehicle throughout the lifespan of the contract.
4.3.3. Fuel: All vehicles shall be Diesel Fuel. In the event that diesel fuel vehicles are unavailable, petrol vehicles may be accepted by the Unit POC until a diesel vehicle becomes available. The Contractor shall make every attempt to immediately replace the petrol vehicles with diesel vehicles as soon as they become available. All vehicles will be delivered to the U.S. Government with a full tank of fuel.
4.4. Vehicle Condition: Vehicles provided shall be in good working condition and without any visible damage that could potentially degrade the safety of the vehicles. Both the interior and exterior shall be free of excessive soil, rust, damage, and without excessive wear and tear. All required safety restraints and devices shall be functional. Vehicles shall be clean and serviceable at the time of delivery, and a joint inspection with the vendor and Unit POC will occur at time of delivery (see Paragraph 5.2.). THE JOINT INSPECTION SHEET SHALL HAVE THE PRINTED NAME, DATE and SIGNATURE OF THE SOLIDER SIGNING. The Contracting Officer shall receive a copy of the joint inspection within 5 days after delivery. If the Contracting Officer does not receive a copy of the joint inspection from the drop off and turn in dates, future damage claims CANNOT be submitted.
4.5. Safety Standards: The Contractor shall comply with all applicable local safety standards. Vehicles shall meet all European Union vehicle safety requirements. Vehicles shall also meet all European Union environmental compliance requirements. Additionally, each vehicle shall have the following items in serviceable condition:

4.6. Maintenance: The Contractor shall perform both scheduled and unscheduled maintenance as needed to ensure that vehicles stay 100% operational. Contractor vehicle maintenance shall take place at a facility verified by the Unit POC. When the contractor deems that maintenance is required due to timing, mileage, or vehicle deficiencies, the Contractor shall provide all parts, labor, and expertise necessary to complete the required maintenance tasks. Parts shall include those items that must be replaced due to fair wear and tear, such as (but not limited to): windshield wipers, tires, headlights, filters, fluids, and lubricants. The Contractor shall be responsible for all scheduled and unscheduled maintenance. The U.S. Government will not be responsible for any maintenance or expenses associated with the maintenance for any vehicles. A copy of Vehicle Maintenance schedule shall be turned in accordance with Part 6 deliverables schedule.
4.7. Insurance: The Contractor shall provide full insurance coverage for all vehicles (incl. Euro 800.00 self retainment). In the event of loss or damage to a vehicle, the Government will pay a deductible up to Euro 800.00.
The contractor is responsible for all third party claims of injury or property damage resulting from operation of the vehicles by the U.S. Government. The Contractor shall maintain public liability and property damage insurance during the period of performance at a level sufficient to cover all claims for injury and/or damage referenced above.
4.8. Records: The Contractor shall maintain records of transactions with the U.S. Government and, upon request, make such records available to the Contracting Officer within a 24-hour period.
4.9. Permits: Without additional cost to the U.S. Government, the Contractor shall obtain all permits, licenses, and appointments required for this contract; all documents shall be in compliance with applicable local and country laws.
License plate country origin is immaterial, but all vehicles shall be registered to enter and operate within Germany and Poland. US Government is responsible to pay for vignettes.
4.10. Legal Compliance: The Contractor shall be responsible for compliance with all pertinent local laws concerning the rental or lease of motor vehicles.
PART 5
SPECIFIC TASKS
5. Basic Services: The Contractor shall maintain an available fleet of all non-tactical vehicles for the use of U.S.
Soldiers in accordance with the requirements below. The Contractor shall provide all labor, materials, equipment, services, documentation, and insurance to support the vehicle requirements in the Schengen countries including the Baltic areas (Lithuania, Latvia, Estonia), Germany, Poland, Hungary, Bulgaria, and Romania. The primary purpose of these vehicles is to provide transportation of personnel and equipment over long distances, to include crossing borders. Vehicles will be operated primarily in Germany and Poland but may be required for operation in the countries listed above for extended periods of time (over 30 days). Vehicles will be utilized on paved and unpaved road surfaces.
5.1. Delivery: The Contractor shall provide delivery of all vehicles (and subsequent delivery of replacement vehicles) to the location specified in Paragraph 4.2.2.
5.1.1. Deliveries shall occur no later than 3:00 pm on the specified delivery date(s) and turn-ins shall be scheduled no later than 4:00 PM on the specified date(s).
5.1.2. All coordination for delivery and turn-in of vehicles shall be made between the Unit POC and Contractor.
Should a vehicle delivery conflict arise which cannot be resolved between the Unit POC and Contractor, the Contracting Officer shall be notified immediately.
5.1.3. All vehicles delivered to the U.S. Government shall be clean and have a full tank of fuel.
5.1.4. Within 24 hours after delivery, the Contractor shall provide a full list of all vehicles delivered and the list shall include the make, model, year, vehicle color and license plate number to the Contracting Officer.
5.2. Delivery Inspection: Upon vehicle delivery to the U.S. Government, the Unit POC and the Contractor shall conduct a joint inspection to determine if the vehicle meets the requirements of Part 4.
5.2.1. The Contractor shall document all Contractor and user identified discrepancies on the Contractor’s applicable form(s) or on Technical Exhibit 1 – U.S. Government Vehicle Inspection Checklist. THE JOINT INSPECTION SHEET SHALL HAVE THE PRINTED NAME, DATE and SIGNATURE OF THE SOLIDER SIGNING.
5.2.2. The Contractor and the user shall sign and date the joint inspection form.
5.2.3. The Contractor shall provide a legible copy of the joint inspection form to the Unit POC.
5.2.4. The Government may document identified discrepancies on a separate form and take pictures of the vehicle’s condition. (See Technical Exhibit – 1)
5.3. Monthly Joint Inspection: The Contractor shall support the Unit POC’s request to conduct a monthly joint inspection with the Contractor on all vehicles.
5.3.1. The joint inspection shall be performed in accordance with the procedures stated in Paragraph 5.2.
5.3.2. The Contractor shall process damages in accordance with Paragraph 5.5.
5.4. Turn-in Inspection: Upon vehicle turn-in, the Unit POC and the Contractor shall conduct a joint inspection to identify any new discrepancies that were not previously noted in Paragraph 5.2.
5.4.1. The Contractor shall document all Contractor and user identified discrepancies on the Contractor’s applicable form(s) or on Technical Exhibit 1 – U.S. Government Vehicle Inspection Checklist. THE JOINT INSPECTION SHEET SHALL HAVE THE PRINTED NAME, DATE and SIGNATURE OF THE SOLIDER SIGNING.
5.4.2. The Contractor and the user shall sign and date the joint inspection form.
5.4.3. The Contractor shall provide a legible copy of the joint inspection form to the Unit POC.
5.4.4. All vehicles turned-in by the U.S. Government shall be free of any trash. There are no minimum fuel requirements upon vehicle turn-in pursuant to this contract.
5.4.5. The Government may document identified discrepancies on a separate form and take pictures of the vehicle’s condition. (See Technical Exhibit – 1).
5.5 Damages: Within three (3) work days after damages are discovered, the Contractor shall notify the Unit POC to validate the damages.
5.5.1. The Contractor shall provide the Unit POC a legible copy of the joint turn-in inspection form, photographs, repair estimate, and any other object evidence to substantiate the claim.
5.5.2. The Unit POC will verify the validity of the claim by signing and dating the joint inspection form.
5.5.3. If the Unit POC cannot verify the claim, the Contractor shall contact the Contracting Officer for resolution.
5.6. Speeding or Parking Ticket(s): Within three (3) work days after the Contractor’s receipt of speeding or parking ticket(s), the contractor shall notify the Traffic Violation POC to validate the ticket(s). (See Technical Exhibit – 2)
5.6.1. The Contractor shall provide the Traffic Violation POC a legible copy of the speeding or parking ticket(s), photographs, cost of the ticket, and any other objective evidence to validate the ticket(s).
5.6.2. The customer unit / requiring activity (or individual responsible for the ticket assuming the unit can determine this) is responsible for payment of the violation(s); no contract funding will be provided for these tickets, and the contracting officer and contract specialist have no responsibility/liability.
5.7. On-Demand Services:
5.7.1. Recovery: Within 24 hours of notification by the Unit POC, the Contractor shall recover disabled vehicles and provide a serviceable vehicle in exchange. This service shall be available seven (7) days a week, 24 hours a day.
All replacement vehicles shall be of the same specifications as the vehicle being replaced and in accordance with the specifications listed in Part 4.
5.7.2. Replacements: Replacement vehicles shall be provided for all vehicles that are out of service or exceed 80,000 kilometers. Vehicle replacements for a disabled vehicle shall take no longer than 24 hours from notification by the Unit POC. All replacement vehicles shall be of the same specifications as the vehicle being replaced and in accordance with the specifications listed in Part 4. If a vehicle is replaced, the Contractor shall notify the Contracting Officer and provide an updated vehicle list which identifies which vehicle was exchanged and the new vehicle provided with 24 hours.
