PERFORMANCE WORK STATEMENT (PWS)

Life Support and Logistical Services

Part 1

General Information

1. Introduction: This is a non-personal services contract to provide life support and logistical services at Dolaszewo, Poland (33U XU 10598 90707; Lat/Long 53° 9.255' N 16° 39.238' E) for US military forces operating in Poland. The Government shall not exercise supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Contractor, in turn, shall be accountable to the Government for Contractor or subcontractor personnel.

1.1 Background: 10th SFG (A) requires logistics support services at Dolaszewo, Poland from 18 May 2018 – 9 June 2018.

1.2 Responsibilities: The Contractor shall assume total responsibility for all requirements stated herein on the commencement date of the performance period. The Contractor shall perform as specified in this Contract and under the direction of the Contracting Officer (KO).

1.2.1 Work Responsibility: The Contractor shall perform all work and assume responsibility for planning, programming, administering, managing, and executing all functions necessary to provide the services specified in this PWS. The Contractor shall conduct work in accordance with this PWS and all applicable United States (U.S.), Polish, and local laws, regulations, standards, provisions, and directives to include applicable publications in Section C-6. The Contractor shall ensure that all work meets the level of service, performance standards, or tolerances specified in the PWS or in applicable referenced documents. Some services under this Contract may be performed at designated facilities, or portions of installations, by in-house Government personnel or by other contractors.

1.2.2 Administrative Responsibility: The Contractor shall perform all related administrative actions required to provide services or perform work such as material requisitioning, quality control (QC), financial control, meetings, and correspondence. The Contractor shall also maintain accurate and complete records, files, and libraries of documents to include all U.S.

Polish, and local regulations, standards, provisions, codes, laws, technical manuals, and manufacturers’ instructions and recommendations that are necessary and related to the functions being performed. The Contractor shall compile historical data, prepare required reports, and submit information as specified by the Deliverable List presented in this PWS.

1.3 Objectives: Provide Life Support and Logistical Services to allow soldiers to live and work at the Dolaszewo, Poland from 18 May – 09 June 2018.

1.4 Functional Areas: Dolaszewo, Poland (33U XU 10598 90707; Lat/Long. 53° 9.255' N 16° 39.238' E)

1.5 Period of Performance: The Contractor shall furnish all personnel, tools, transportation, equipment, maintenance of facilities, supervision and any other items necessary to provide life

Page 2 of 19 Rev 2-Feb 2015 support and logistical services for US military forces. Current template of personnel is 350 personnel.

The period of performance shall begin 21 May 2018 and be completed on 09 June 2018, Except for item 5.6 (Reefers) which will need to be delivered on 18 May 2018.

1.6 Management and Administration:

1.6.2 Contractor Management: The Contractor shall perform continual management of the functional areas contained in this PWS and shall provide a Project Manager physically present on-site during normal duty hours. The Project Manager shall conduct overall management coordination and shall be the central point of contact (POC) with the Government for performance of all work under the PWS. At the Post Award conference, the Contractor shall submit to the COR, in writing, the name, title, office, home and mobile telephone number of the Project Manager (Deliverable 103R003). A Contractor employee shall be designated to act for the Project Manager when work is being performed outside of duty hours, or during the Project Manager’s absence. Both the Project Manager and the Contractor employee filling in for the Project Manager, shall have full authority to act for the contractor on all Contract matters relating to daily operation of this Contract.

1.6.3 Contractor Responsiveness: The Project Manager or designated alternate shall be available for telephone communication or site attendance, with the COR, as required by the COR, 24 hours a day, 7 days a week. A personal answering service is permitted at other than normal Contract workdays and work hours for receipt of COR emergency response work requirements, provided that the Project Manager or designee responds to all calls within a time not to exceed two hours after notification of the call by the answering machine and/or service.

The Project Manager and any individuals designated to act in that capacity shall have full authority to contractually bind the Contractor for prompt action on matters pertaining to execution of the PWS.

1.6.4 Meetings, Conferences, and Briefings: The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Project Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter. Meetings may start or end outside of regular duty hours.

1.6.5 Hours of Operation: The contractor is responsible for conducting business as necessary in order to ensure space is available 24-hours a day every day during period of performance beginning at 0700 on 21 May 2018 at times to be coordinated between the COR and contractor except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.

For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.6.6 Recognized Holidays: The contractor is required to perform services on holidays and weekends from 21 May 2018 – 09 June 2018.

1.6.7 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract The contractor will provide a copy of the Contractor Quality Control Plan (CQCP) annotated with the contract number to the COR at least 20 days working days prior to contract start date. The COR will submit an approved copy to the contracting officer at the below listed address not later than two (2) weeks after contract start date:

In addition to any requirements in the specification or statement of work, the contractor's quality control plan must have as a minimum:

- Identification and clearly defined authority of key personnel under the contractor's organization.

- A quality inspection system covering all general and specific tasks included in the contract scope of work. It should specify tasks or areas to be inspected on either a scheduled or unscheduled basis, or the manner in which inspections are to be conducted.

- The names of firms or individuals tasked to perform inspections and the extent of their authority. This may be in the form of an organization chart or other form approved by the COR.

- Proposed test methods, including names of technicians or qualified testing laboratories to be used, if applicable. Tests must be specified.

- A method of identifying deficiencies in the quality of services or construction performed before the level of performance becomes unacceptable.

- A method of documenting and enforcing quality control operations of both prime and subcontractor work, including inspection and testing.

- Key control, internal control or security procedures, if applicable.

- Any winterization plans and procedures for outdoor and exposed contractor and Government furnished equipment, if applicable.

- A method of identifying deficiencies in the quality of manufacturing, services, or construction performed before the level of performance becomes unacceptable.

- Detailed information specifying the types of action the contractor will take to correct deficiencies and prevent their recurrence.

- Detailed information on the inspection methods used and proposed test methods, including names of technicians or qualified testing laboratories to be used, if applicable. Tests must be specified.

After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

1.6.8 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.9 Place of Performance: The work to be performed under this contract will be performed at land base Dolaszewo, Poland (33U XU 10598 90707).

1.6.10 Type of Contract: The government will award a Firm-Fixed Price contract in support of this requirement.

1.6.11 Security Program: N/A

1.6.12 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.6.13 Key Control: The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor. The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer. The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan.

1.6.15 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.16 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies;

coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.6.17 Key Personnel: N/A

1.6.18 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.6.21 Data Rights: N/A

1.6.22 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting

Officer may effect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

1.6.23 Safety: Contractor’s work environment(s) and labor shall meet all Occupational Safety and Health Administration (OSHA) requirements. For any work performed, the contractor shall be responsible for all damages to persons or property that occur as a result of the contractor’s fault or negligence. The contractor shall also be responsible for all material needed and work performed until completion and acceptance of the entire work.

1.6.23.1 Safety Plan and Program: RESERVED

1.6.24 Environmental Compliance: The contractor shall be familiar with and comply with all applicable environmental laws and regulations to maintain a clean and safe work environment, to include secondary containment under all equipment requiring refuel, petroleum and chemical storage, and retail activities.

Contractor shall be liable for costs caused by Contractors failure to comply with pertinent laws and regulations

PART 2

DEFINITIONS & ACRONYMS

2. Definitions and Acronyms:

2.1 Definitions:

Contractor - A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

Contracting Officer - A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note:

The only individual who can legally bind the government.

Contracting Officer's Representative (COR) - An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

Defective Service - A service output that does not meet the standard of performance associated with the Performance Work Statement.

Deliverable - Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

Key Personnel - Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

Physical Security - Actions that prevent the loss or damage of Government property.

Quality Assurance - The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

Quality Assurance Surveillance Plan (QASP) - An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

Quality Control - All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

Subcontractor - One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

Work Day - The number of hours per day the Contractor provides services in accordance with the contract.

Work Week - Monday through Friday, unless specified otherwise.

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. Contractor Furnished Items And Responsibilities:

4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2 Secret Facility Clearance: N/A

4.3 Materials:

18Mar18: 1x 20’ Cold Storage Reefer and 1x 20’ Frozen Storage Reefer are delivered and operational at Dolaszewo for the purpose of storing food products.

SPECIFIC TASKS

5.1 Basic Services: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, utilities, and other items and non-personal services necessary to provide life support and logistical services, as defined in this Performance Work Statement (PWS), except for those items specified as government furnished property and services. The Contractor shall perform in accordance with (IAW) the terms and conditions of the contract and consistently with the established standards in this PWS and contract.

5.1.1 Facilitate access to facilities from 21 May to 09 June 2018, to include requirements for badging and escorts.

5.1.2 Accommodation Areas: Provide rental of 150 bunk beds and 50 single-beds with mattresses and linen sets for 350 personnel and 350 lockable wall locker (approx.. 1.8m high x 1m wide)(wardrobes). The beds shall be twin sized- no specific standard is required whether it is US or Polish. There are existing hard stand buildings on Dolaszewo, Poland. Customer will provide a POC to direct placements of beds and wardrobes. Installation and removal is required.

5.1.3 Ablution units: Provide shower and latrines with sink units to support a 1/10 population ratio. Dolaszewo does not have power generation provided. Ablution units shall have contractor provided power generation. Contractor will clean Ablution units daily. Cleaning will consist of cleaning showers, floors, sinks, refilling soap dispensers, restocking toilet paper, cleaning toilets and removing trash from bins. Bins shall be provided. Boilers for hot water shall be located outside of the ablution units for safety reasons. Water from the base is provided. Sewer for waste water is provided by the base.

5.1.4 Refrigerated Containers (REEFER): Provide one (1) refrigerated freezer container (Reefer) for frozen Class I food and provide one (1) reefer for perishable Class I food.

Dolaszewo does not have power generation provided. Reefer units shall have contractor provided power generation.

5.1.5 Fuel Point: Provide a designated area with a spill kit to position a unit provided fuel truck or tank so that the units have refueling capability for vehicles. Spill kit shall be for JP8 fuel.

5.1.6 Trash and Trash removal: Provide at least one 6 cubic meters trash dumpster for food trash, two 6 cubic meters trash dumpsters for general trash and one 6 cubic meters trash dumpster for recyclable trash to be emptied twice a week on Tuesdays and Fridays.

5.1.7 Hazardous Materials: Provide disposal on 9 June 2018 of an estimated 37-58 Liters of petroleum based products produced by the unit during equipment maintenance. This type of material is oils and transmission fluid, from routine maintenance of vehicles.

5.1.8 Grey Water Tank and Removal: Provide Gray Water tank of at least 2000L and the removal of up to 2000L of Gray water daily NLT 2100 from 20 May – 09 June 2018. REMOVED

5.2 Enterprise-Wide Contractor Manpower Reporting Application (eCMRA): The contractor shall ensure ALL contractor labor hours (including subcontractor labor hours) required for the performance of services provided under this contract are reported via a secure data collection site.

The contractor (and all subcontractors providing direct labor under this contract) shall report complete and accurate data for the labor executed during the period of performance during each Government fiscal year (FY), which runs from October 1 to September 30. The Contractor shall input the data into the appropriate eCMRA reporting tool, which can be accessed via a secure web site at http://www.ecmra.mil/. There are four separate eCMRA tools: Army, Air Force, Navy and All Other Defense Components. The appropriate eCMRA reporting tool to use is determined by the requiring activity being supported (e.g., if DISA awards a contract for an Air Force requiring activity, the contractor shall load the required reporting data in the “Department of Air Force CMRA” tool). While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. The contractor shall completely fill in all required data fields. The contractor shall enter initial data into the appropriate eCMRA tool to establish the basic contract record no later than 15 working days after receipt of contract award or contract modification incorporating this clause. The contractor shall notify the COR when the basic contract record has been established in the appropriate eCMRA tool.
