SUBJECT:

Justification for other than full and open competition – Brand Names for W912NR-19-Q-0011 (Instruments)

1. Contracting Organization: Louisiana Army National Guard Purchasing and Contracting Office, 420 F Street, Pineville, LA 71303.

2. Description Of Action: This contract will be a Small Business Set Aside.

3. Description Of Services: Musical Instruments for the 156th Army Band.

4. Authority: 10 U.S.C. 2304 (c) (1) and 6.302-1(c) application of brand name descriptions, is the statutory authority permitting other than full and open competition.

5. Applicability Of Authority: The 156th Army Band requests brand name specifics for the instruments for technical reasons. The Band has an inventory of musical instruments that are all considered, “Very Fine Professional Grade” instruments. Introducing a “comparable” instrument would not be an ideal situation. For each instrument, they have only one brand. They do not own two brands of the same of instrument. Many instrument manufacturers create their instruments in a particular manner which create certain tendencies with each instrument type.

Introducing a different "comparable" instrument would not match the pitch tendencies and characteristic tones made by the specific instrument brands that are on hand. The same can be said for all of the instruments on this list. Not only will pitch tendencies be different but also key placement and particular options specifically made for this brand will be different and this affects each individual musician. Introducing a different brand will most likely Also, the 156th Army Band has a current stock of repair parts for their existing instruments and have a local vendor that keeps a stock level on the shelf that can furnish repair parts immediately. This vendor provides repair parts that are underneath the Micro-Purchase Threshold. Having to locate another vendor who can provide repair parts for comparable brands may not be local, adding to the length of time that an instrument may be inoperable, and causing the band to have to cancel an event.

6. Efforts To Obtain Competition: There will be a solicitation on FBO for a SB set aside. The only limiting factor will be the brand names of the instruments.

7. Fair and Reasonable: All quotes will be evaluated for their representation of a fair and reasonable market price.

8. Market Survey: Using the Dynamic Small Business tool, a search was done to find a vendor that had the NAICS code of 339992 (Musical Instrument Manufacturing), which will be used on the solicitation and contract. 160 vendors were found. We also did a search for 451140 (Musical Instrument and Supplies Stores), which will not be on the contract. In past experiences, vendors that I’ve worked with had used this NAICS code, feeling that it more appropriately aligned with their concern. This search resulted in 253 vendors
