FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: United States Property and Fiscal Office for Rhode Island
2. Description of Action: United States Property and Fiscal Office for Rhode Island requests a firm-fixed price contract with Cox Rhode Island Telecom, LLC, 9 James P.
Murphy Industrial Highway. The Government projects award for August 2018 and fiscal year 2018 operations and management funds will be used.
An acquisition plan is not required since this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d)(i)(B).
3. Description of Supplies/Services: Redundant Network Connectivity and Business Internet Backup System for data circuits for all Rhode Island Army National Guard (RIANG) locations throughout Rhode Island (see Attachment “A”). This requirement (mandatory) for a backup network is to ensure at least 99% availability of Non-Secure Internet Protocol Router NETwork Data and Voice over IP (VoIP) phone data for daily business operations/mission support in the event that the primary system should fail or experience an unscheduled extended outage.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.
5. Reason for Authority Cited: Presently, there are only two terrestrial network providers, Verizon Wireless and Cox Rhode Island Telecom, LLC that possesses the physical infrastructure to provide the required services throughout the state of Rhode Island. Verizon Wireless is the Rhode Island Army National Guard (RIANG) primary network provider. Therefore, Cox Rhode Island Telecom, LLC is the only other source that possesses the capability to meet the mandatory requirement of backup redundancy

Version – August 2015 services in accordance with DoD 8570.01-M, Information Assurance Workforce Improvement Programed, dated December 19, 2005.
As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.
Because this is a sole source action, effective competition is not applicable.
Subcontracting competition will be achieved by recommending that the Contractor’s Small Business Liaison meet with the Rhode Island Procurement Technical Center (PTAC), an organization that assists small businesses find subcontracting opportunities with large prime contractors find small businesses interested in competing for subcontracting opportunities under the proposed contract.
7. Actions to Increase Competition: Encourage prime contractor to participate in various Small Business Administration (SBA) Matchmaker events that is conducted by the U.S. Small Business Administration. These events bring prime contractors and small businesses together in one location to meet and discuss subcontracting opportunities.
Our agency typically sends two contracting representatives to the SBA Matchmaker events so we may also meet with small businesses (old and new) to discuss potential contracting and subcontracting opportunities.
8. Market Research: In 2017 and 2018, market research was conducted on the local, regional and national market. Cox Rhode Island Telecom, LLC and Verizon continue to be the only terrestrial network providers owning physical fiber and copper based infrastructures in Rhode Island that possess full statewide telecommunications frame coverage. Satellite vendors, including Verizon, do not provide solutions that meet the bandwidth and network latency requirements with comparable costs to the terrestrial solutions. In addition, satellite based network links introduce unacceptable levels of latency for effective IP based network data transport.
A waiver to the requirement to post a sources sought or request for information as required by DFARS 206.302-1(d) and DFARS Procedures, Guidance and Information 206.302-1(d) was approved on __________ by ___N/A_________________________.

None. On 29 July 2018, a source sought notice was posted to www.fbo.gov . The posting did not result in any interest and/or responses to the contracting officer.
