W912LC-17-T-0117 – Advertising and KIOSKS at Colorado Shopping Malls

QUESTIONS (Q) & ANSWERS (A)

Q1. Will the National Guard be able to provide us with a copy of its sales tax exemption certificate for the state of Colorado?

A1: Sales to the Colorado National Guard are exempt from state sales tax. Certificate will be provided to the awardee.

Q2. Can we come up with an approach that integrates the federal prompt pay process with the need to pay first and last month’s rent to the five malls on signing their leases.

Can this be set-up as a direct payment by the National Guard? As an alternative, could we establish a deposit on signing the contract with the National Guard would pay to XXXX that XXXX could to then use to pay its contractual signing deposits to the malls?

A2. No. Unless the DoD Component is specifically authorized by law, legislative action or Presidential authorization, funds are not to be advanced to non-DoD federal entities, or be used to pay for advance billings without the receipt of goods or services"

Q3. Town Center and Mesa Mall want a certificate for Workman’s’ Compensation insurance. Given that the people working in the kiosk will be National Guard employees, we can’t cover this on our workman’s’’ comp plan. Is there a way for the National Guard to handle this?

A3. The Colorado Army National Guard is self-insured and personnel who will be work in the kiosk are covered by federal workers compensation programs. Specifically, dual status federal technicians are covered by the Federal Workers Compensation Act (FECA), and Active Guard and Reserve are covered by the military system.
