NEW JERSEY AIR NATIONAL GUARD
HEADQUARTERS 177TH FIGHTER WING

MEMORANDUM FOR 177 MSG MSC
FROM: 177 FW CES CEE
SUBJECT: JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
1. PROJECT: Provide Eleven Megadoor Control Panels for Megadoor Overhead Fabric Doors
2. AGENCY AND CONTRACTING ACTIVITY:
2.1. Contracting Agency: 177th Fighter Wing MSG MSC
400 Langley Rd.
Egg Harbor Township, NJ 08234
2.2. Requiring Agency: 177th Fighter Wing CES
400 Langley Rd.
Egg Harbor Township, NJ 08234
3. NATURE AND/OR DESCRIPTION OF ACTION BEING PROCESSED: The government intends to award a sole source, firm-fixed price contract to Assa Abloy Entrance Systems (Megadoor USA, Inc.) to provide and install eleven Megadoor control panels for the overhead fabric door assemblies. The supplies are best provided from the original equipment manufacturer due to the proprietary components, programs, and installation required to repair and maintain the existing specialized Megadoor system. Award to any other source would result in increased cost and time to the government and mission degradation due to lack of reliability that will not be recovered through competition.
4. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE CUSTOMER’S
NEEDS: Eleven Megadoor overhead door control panels are required to replace the failing panels at the 177th Fighter Wing. The existing panels are pressurized through a centralized compressed air system to meet explosion proof requirements. The pressurization system has contaminated the interior of the panels with particulate matter and moisture causing corrosion of the interior electrical components and a loss of reliability. Complete failure of the system is imminent rendering the doors in-operable. Note: since the original installation, the unique Air Force explosion proof requirements for the shelters has been revisited and written to adhere to the National Electric Code (NEC) requirements for Class 1 Division 2 environment. The location of the panels falls outside the Class 1 Division II area. The control panels associated with this acquisition are not required to be explosion proof.
The existing panels will be replaced with new non-explosion proof overhead fabric door control panels.
The new panels must be fully compatible with the existing Megadoor door system. The panels must receive several types of inputs from not only the door push buttons, but also the North Eastern Air Defense (NEAD) Aircraft Alert System. The control panels must be fully capable of, to include but not limited to;
operating the dual motor belt drive system, monitoring phasing, providing regulated voltages, motor jam & loss of motor protection, and emergency stop / interposing relays. Supple of the panels will include control panel installation, testing, and commissioning of the system to include all relevant documentation.
5. STATURORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION:
FAR6.302-1 and 13.106-1(b)(1). Only one responsible source and no other supplies or services will satisfy the agency requirement. Competing the requirement will result in substantial duplication of costs to the government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency’s requirements. (See 10 U.S.C. 3304 (b) (2) or 41 U.S.C. 253 (d)(1)(B).
6. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE
OF THE ACQUISITION REQUIRES THE USE OF “OTHER THAN FULL AND OPEN”
AUTHORITY: Assa Abloy Entrance Systems (Megadoor USA, Inc.) is the original equipment manufacturer (OEM) for the Megadoor overhead fabric door system. Assa Abloy designed, engineered, fabricated, and installed the existing Megadoor system. The existing panels must be replaced with OEM panels to ensure full capability, functionality, reliability, and safety. Market research revealed, and is documented in the contract file, that commercial off the shelf (COTS) control panels are not compatible with the Megadoor system. An attempt to execute this acquisition through full and open competition would require the existing panels to be “reverse-engineered”. The additional cost and time delays would not be recovered by the Government.
7. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE: No other offers were solicited.
Based on the market research, no other sources were able to meet the Government’s requirement.
7.1. Sources Sought for the purchase of eleven Megadoor overhead door system control panels was posted to FBO.gov on May 31, 2017. Two small business vendors responded. Neither vendor responded with the similar work experience Megadoor control panel required by the governments notice for successful completion.
7.2. This office conducted additional market research with the 177th Engineering Squadron to determine the availability of the panels in the commercial marketplace.
7.2.1. Conference calls were held with the original equipment manufacturer, Megadoor; the 177th Engineering Squadron, and this office to determine: the technical requirements of the replacement panels; the method by which the panels interfaced with the physical doors; and the installation / commissioning / testing requirements to provide a safe fully functioning to system meeting mission requirements.
7.2.2. Based on these requirements numerous vendors and local supply houses were contacted.
7.3. It was determined that commercially available off the shelf (COTS) items were not compatible with the
Megadoor Overhead door system.
7.3.1. The COTS items contained many of the same components: i.e. Micologix controllers, NEMA 3R enclosures, I/O card slots, power supplies & inputs / puts.
7.3.2. The Megadoor components contain parts, safety interfaces, and programming in a configuration unique to the manufactures control panels.
7.4. The Market Research conducted by this office concluded that the appropriate acquisition strategy to fulfill this requirement was to purchase the eleven control panels and incidental installation from the original equipment manufacturer.
8. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO
THE GOVERNMENT WILL BE FAIR AND REASONABLE: In accordance with FAR 6.303- 2(b)(7), the Contracting Officer has determined that the anticipated price to the Government is fair and reasonable. A detailed Independent Government Estimate (IGE) was constructed by the Engineering Squadron. The IGE utilized industry standard equipment pricing, rates, and mark-ups. The IGE was with-in 3% of the offerors proposal
9. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION: No other sources expressed interest in the requirement.
10. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING ANY SUBSEQUENT
ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED: The Technical Requirements were clear and concise and explained the requirement without any ambiguities or restrictions. It is commercial practice to replace major system components with original manufacturer’s parts to ensure safety, compatibility, and reliability.
11. CONTRACTING OFFICER’S CERTIFICATION: I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
12. TECHINAL REQUIREMENTS PERSONNEL CERTIFICATION: I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
