STATEMENT OF WORK

Statement of Work Deformation of Expended Small Arms Cartridge Casings (ESACCs)

1. The purpose of this Statement Of Work (SOW) is to perform the destruction/deformation of Expended Small Arms Cartridge Casings (ESACCs) and small arms brass gleanings from range clearance operations at Fort Chaffee Maneuver Training Center (CMTC) and at Camp Robinson Maneuver Training Center (RMTC).

THIS STATEMENT OF WORK (SOW) IS FOR DEFORMATION / DESTRUCTION OF

ESACCs ONLY AND NOT THE SALE OF THESE ITEMS .

2. “Small Arms” are defined by DoD Manual 4160.21-M as: Hand guns, shoulder-fired weapons; and light automatic weapons up to and including .50 caliber (12.7mm) machine guns.

3. Expended Small Arms Cartridge Casings (ESACCs) are defined as: The components, parts, accessories and attachments of small arms ammunition, to include: Cartridge cases, bullets, jackets, cores, shells (excluding shotgun shells) projectiles (including canister rounds and sub munitions), boosters, firing components, primers, and other detonating devices used in live-fire training or testing and collected after use. ESACCs are generally referred to as “fired cartridge cases.”

4. Destruction / deformation is defined as: rendering useless for use as a cartridge by heating, mangling, or crushing in accordance with Department of Defense (DoD) Manual Number 4160.28, Volume 1, “Defense Demilitarization,” dated 7 June 2011.

5. Prior to the destruction / deformation, all ESACCs and gleanings must be properly inspected and certified as inert by government Ammunition Supply Point (ASP) personnel.

6. ESACCs, until deformed or destroyed, must be controlled as a Commerce Control List (CCL) Item, demilitarization (DEMIL) code Q6, rather than a US Munitions List (USML) item and are subject to DoD Trade Security Controls as outlined in DoDI 2030.08, “Implementation of Trade Security Controls for transfers of DoD US Munitions List Items and Commerce Control List Personal Property to Parties Outside DoD Control.” In other words, ESACCs must not be moved or transported from the installation prior to destruction / deformation. Offerors must demonstrate they have the ability to destroy/deform the ESACCs on the site of the two installations (CMTC and

RMTC).

7. Deformation / destruction will be performed at intervals not to exceed 12 months, and will be performed when the estimated weight of ESACCs is between 75,000 and 150,000 lbs. Estimated total weight of ESACCs to be deformed each year will not exceed 250,000 lbs.

8. This Statement Of Work DOES NOT include NON-BRASS casings.

9. THIS STATEMENT OF WORK (SOW) IS FOR DEFORMATION / DESTRUCTION OF

ESACCs ONLY AND DOES NOT GUARANTEE AUTOMATIC RIGHT TO THE SALE OF THE

DEMILED MATERIAL TO THE SUCCESSFUL OFFEROR . THE SALE OF THE MATERIAL

WILL BE THROUGH A DIFFERENT PROCESS THAN THIS STATEMENT OF WORK

ALLOWS FOR. Statement of Work Deformation of Expended Small Arms Cartridge Casings (ESACCs)

10. The resulting contract from this Statement of Work (SOW) will be a Base Period with four (4) one year option periods.

11. Successful offeror is responsible for the supplies, materials, equipment, labor, transportation, oversight, and documentation for the deformation/destruction of ESACCs on site.

12. Successful offeror is responsible to coordinate with each installation Ammunition Supply Point (ASP) prior to deformation /destruction procedures to ensure qualified personnel will be present to certify the destruction/deformation in accordance with Department of Defense (DoD) Manual Number 4160.28, Volume 1, “Defense Demilitarization,” dated 7 June 2011. In no event will ESACCs be destroyed or deformed without ASP personnel present.

13. The Government is responsible for furnishing proper containers for the collection of destroyed/deformed ESACCs.

14. ESACCs and gleanings inspection: Successful offeror must inspect the ESACCs prior to destruction/deformation to satisfy them as to safety and to ensure ESACCs are certified inert by a government Ammunition Supply Point (ASP) inspector. In no event shall the failure to inspect the merchandise constitute grounds for a claim afterward resulting from this Statement of Work (SOW).

15. Upon completion of deformation/destruction operations, ESACCs must remain in a controlled environment, to prevent introduction of live rounds into the deformed and certified inert ESACCs collection. Successful offeror is responsible to ensure security and control of ESACCs until completion of deformation/destruction operations. Upon completion of the operation, deformed ESACCs will be moved inside the ASP, and remain under control of ASP personnel until sold.

16. The Government will provide a forklift and personnel at both installations to assist in loading of ESACCs into containers. Successful offeror must coordinate ten (10) days prior to pickup to verify personnel and equipment are available.

17. Onsite destruction /deformation operations must be completed Monday through Friday during normal business hours (0700-1400), excluding Federal and Arkansas State Holidays.

18. Successful offeror will be allowed to store deformation/destruction equipment onsite at each installation. All liability for deformation/destruction equipment during storage shall be the responsibility of the successful offeror. Access to the storage area must be coordinated with COR.

19. The successful offeror assumes complete liability for all taxes applicable to its property, income and all of its transactions arising out of or in connection with the performance of this Statement Of Work (SOW). The successful offeror will not be reimbursed for any direct or indirect tax imposed on it by reason of this Statement Of Work (SOW) or otherwise.

20. Indemnity. The successful offeror agrees to indemnify and hold harmless the Qualified Recycling Program, the Arkansas National Guard, the National Guard Bureau, and the United States (including its agencies and instrumentalities), and their officers, agents and employees against liability and against any and all claims for loss, death, injury, or property damage (including costs and expenses incidental thereto), arising out of or in connection with (i) the performance of this Statement Of Work (SOW), (ii) any of the activities or actions of the successful offeror’s subcontractors, representatives, agents, or employees while performing this Statement Of Work (SOW), or (iii) any of the successful offeror’s activities or actions.

21. Damage to government property. Any damage to government property during the successful offeror’s deformation operations is the responsibility of the successful offeror, if deemed by the contracting officer that the successful offeror or his/her employee was at fault. It will be repaired at the successful offeror’s expense to its original state or a reasonable facsimile thereof to the satisfaction of the contracting officer.

22. Operator Licensing and Insurance. All successful offeror personnel shall have a valid driver’s license, other permits required by local or State Authorities, and have proof of liability insurance in the vehicle when entering each Government Installation.

23. Weapons/Firearms Control. Successful offeror personnel will not transport, possess, or use privately owned dangerous weapons on government-operated installations or facilities. “Dangerous Weapons” include all forms of firearms, missile-throwing devices (e.g. Bow and arrow), switch blade or automatic blade knives, knives with blades in excess of three inches, ammunition and pyrotechnics, fireworks, bludgeons (e.g. “Num-chucks”), brass knuckles, shooting pens, and similar devices. Unauthorized dangerous weapons will be confiscated and impounded by government law enforcement and security personnel. A state weapon permit does not supersede this provision.

24. Dangerous property. The successful offeror is cautioned that articles or substances of a dangerous nature may remain in the property regardless of the care exercised to remove same. The Government assumes no liability for damages to the property of the successful offeror for personal injuries, disabilities or death of the successful offeror, his/her employees or to any other person arising from or incident to the deformation of ESACCs. The successful offeror shall hold the Government harmless from any and all demands, suits, actions, or claims of whatsoever nature arising from or out of the deformation of ESACCs or this Statement Of Work (SOW).

25. Safety and Security Regulations. During the course of performance of this Statement Of Work (SOW), the contractor, its agents, servants or employees shall conform to all safety and security regulations which are in effect at the time. All contractor personnel must pass a security screening / police background check in accordance with AR 190-11. Contractor is responsible for providing certification documents to COR.

26. Military Security and safety regulations prohibit contractor’s personnel from being on site at the Ammunition Supply Point (ASP) during ammunition issuing and receiving operations. Although all efforts will be made to schedule deformation operations during off peak times, contractor’s personnel may be asked to temporarily cease operations and move to a safe area until the issue/receipt of ammunition is complete

27. Contractor Manpower Reporting. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Arkansas Army National Guard via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address:

http://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30.

While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. Contractors may direct questions to the help desk at help desk at: http://www.ecmra.mil .

CLAUSES INCORPORATED BY FULL TEXT

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.

Additional copies will be issued for a fee.
