SCOPE OF WORK
STATEMENT OF WORK
Removal of Dead and Dying Ash Trees at Goose Island Near La Crosse, Wisconsin
BACKGROUND
This scope of work describes the requirements of a contract to remove an estimated 100 dead and dying trees at Hunters Point on the south end of Goose Island in Vernon County, Wisconsin. Ash mortality has been occurring here for the last few years due to the emerald ash borer and most ash trees on the site are dead, though a few trees may retain a few live sprouts.
The entire project area is located on Federal land that is owned by the US Army Corps of Engineers (USACE). The land in the treatment area is also incorporated in the US Fish and Wildlife Service (USFWS) Upper Mississippi River National Wildlife and Fish Refuge, La Crosse District. In addition, the La Crosse County Facilities Department manages a portion of the area for recreational activities, including hiking, skiing, and boating. All activities associated with this scope of work must adhere to all applicable policies for the USACE, the USFWS and La Crosse County.
The work to be performed under this contract consists of furnishing all equipment, supplies, labor, supervision, and transportation and performing all work as required by the Contract Line Items Schedule (CLIN) of the contract, including disposal of plant material, in strict accordance with this Statement of Work (SOW) and attachments, all of which are made part hereof. All work materials and services not expressly called for in the scope of work or shown on the attachments, but which are necessary for completion of the contract requirements shall be performed and furnished by the Contractor at no increase in cost to the Government. It is expected that the Contractor will utilize their knowledge, skills, and abilities to plan work around weather forecasts and moisture conditions.
Contract Period: The contract term is for one (1) base year, with no additional option years.
SITE DESCRIPTION
Project Area and Access The treatment area is located in Vernon County, WI, approximately ¾ mile south of the La Crosse and Vernon County line on Goose Island. Goose Island is approximately 2 miles south of the City of La Crosse. The approximate coordinates of the center of the project area is located at 91°13’53.86”W, 43°42’59.38”N. Treatments cover a total of approximately 5.7 acres.
Vicinity and site-specific maps are attached (Attachment 1). The site is accessed via County Road GI, with the treatment area accessible either from County Road GI on the south or via cleared recreational trails on the north side of the treatment area. It is the Contractor’s responsibility to determine appropriate access to the site to complete the requirements of this SOW.
An additional rock delivery contract will likely be occurring at the site for up to two weeks during the performance period described in this scope of work. The Contractor will be responsible for coordinating with the Government to ensure that the site is accessible when the Contractor would like to begin work.
Vegetation An estimated 100 ash trees have died or are in the process of dying from emerald ash borer are distributed throughout the treatment area, along with one (1) dead silver maple. The average diameter at breast height (dbh) of these trees is 15.6 inches, with an average height of about 55 feet. Almost 60% of trees are between 12 and 24 inches dbh, with just over 25% between 6 and 12 inches and just over 10% of trees greater than 24 inches. The largest tree is 42 inches in diameter.
PRESCRIPTIONS
Prescriptions Tree Felling (CLIN 0001) All dead tress (an estimate of 100) of all species within the treatment area and need to be removed, as should any remaining live ash trees. No live trees of any other species should be removed. Trees for removal will be marked prior to contract implementation. Removal shall consist of felling all marked trees to a stump height not to exceed 12 inches above soil level. If snow is present at the time of cutting, stump height shall still be measured from the soil surface. Stumps will not be removed and will be left in place. Trees shall be felled in a manner that minimized residual damage to adjacent live trees; if it is not possible for a tree to be felled without damaging adjacent live trees, the contractor must receive clearance from the Government before proceeding with felling.
Material Removal (CLIN 0002) All other material from the felled trees must either be removed from the site or chipped in place. If chipped, material may be distributed within the interior of the treatment areas but must be distributed in a way that the depth of wood chips should not be greater than 1 inch above the soil surface. Small branches (1 inch or less in diameter) may be left within the treatment area though they should be crushed or otherwise compacted to a height no more than six inches above the soil surface. Any material from felled trees that falls outside of the treatment area must be cleared from the adjacent areas.
Frozen ground restrictions All work must be conducted during winter months when the ground is frozen. No work may be conducted if the ground has thawed to minimize the potential for soil disturbance.
Disposal of emerald ash borer infested material All material removed from the site must be disposed of according to any specifications related to Federal, State or County quarantines of emerald ash borer infested material.
Quality Assessment Work shall be considered acceptable if the following are true:
- 100% of marked trees have been felled (CLIN 0001)
- 100% of stumps have been cut to a height of 12 inches above soil level or less (CLIN 0001)
- 100% of tree boles, branches, or other material greater than 1 inch in diameter have been either removed from the site or chipped (CLIN 0002)
- 95% of branches or other material less than 1 inch in diameter that are sampled are less than 6 inches above the soil surface (CLIN 0002)
- 95% of chip depth samples are less than 1 inch above the soil surface (if applicable) (CLIN 0002)
To assess tree felling (CLIN 0001), each marked tree that has not been felled according to specification will be tallied. Each stump greater than 12 inches above the soil level will also be tallied. A GPS location will be recorded for each tree or stump not meeting specifications. A GPS location will also be taken for any area where material removal or crushing has not been treated according so specification. Rework will be required for any trees not felled according to specifications or for any stump not cut to less than 12 inches, and no payment will be made for work until rework is completed.
Up to 20 points will be sampled to assess the removal and compaction of woody material (CLIN 0002). The depth of branches or other material less than 1 inch diameter and chip depth (if applicable) will be measured at each point.
The percentage of points not meeting specifications may be used either to assess whether rework will be required or whether a performance penalty will be levied. The decision whether to levy a performance penalty or to require rework is solely at the discretion of the Government.
If a performance penalty will be levied for unacceptable work for CLIN 0002, the penalty will be equal to the percentage of points not meeting contract specifications.
Treatment Schedule Treatments must be while the ground is frozen to prevent soil disturbance. Begin and end Dates for each treatment in each area are provided in the Contract Line Items table in the measurement and payment section below. No treatments may begin prior to the Begin Date and all treatments must be completed by the End Date. The Contractor may select any date between those two dates to perform work, given that site conditions are appropriate, and that the Government has given approval to proceed. In addition, upon contract award, the Contractor shall submit to the
COR a tentative work schedule for the contract period. The Contractor submitted work schedule is not binding and may be updated as needed but is intended to allow the Government to plan according to the Contractor’s work schedule. The Contractor’s tentative work schedule shall in no way supersede the dates provided in this contract. To ensure no potential conflicts with other contracts occurring in the same area, the Contractor must provide the Government with two weeks notice that they intend to begin work.
POST-AWARD MEETINGS
A post-award meeting shall be scheduled within 10 business days after contract award and may be held in person or by conference call. Government inspection procedures will be reviewed at that time. The Contractor will be notified by the COR of the meeting time. A follow-up on-site meeting will be required prior to work beginning on the contract.
GOVERNMENT POINT OF CONTACT

ENVIRONMENTAL PROTECTION
Should a spill of petroleum, pesticide, or other contaminant occur, the Contractor's immediate response shall be to proceed with measures to limit the further spread of contamination. Immediately following this initial response, the Contractor shall notify the local Fire Department, Contracting Officer, and appropriate local, state, and federal officials. This may include the National Response Center (1-800-424-8802) if a reportable quantity is released to the environment.
Subsequent to these actions, the Contractor shall take actions to clean up the spill at no cost to the Government.
Should a personnel contamination occur, the Contractor shall take immediate actions as prescribed by chemical manufacturer to protect the safety and health of the contaminated individual(s).
SAFETY
Notwithstanding any other provisions of this contract, the Contractor shall comply with all safety and health requirements as outlined in the Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1) and OSHA Safety Standards to ensure the safe working conditions for his employees and Government workers.

INSPECTIONS AND ACCEPTANCE
Work will be inspected periodically for conformance with these specifications for timeliness, safety and results achieved.
LIABILITY OF AND DAMAGES TO THE GOVERNMENT
Insurance
The Contractor will carry liability insurance that will cover tree felling and material removal as defined in this specification. The amount of coverage this insurance will provide will not be less than $1,000,000 per incident. A Certificate of Insurance form signed by the insuring agency shall be provided to the contracting officer within 10 business days after contract award. The insurance must provide coverage for the entire contract period. The insurance policy shall state that it cannot be cancelled without 30 days written notice to the COE Contracting Officer. Failure to secure and maintain insurance may be grounds for termination during the performance period of this contract.
Government Liability
The Government assumes no liability from the Contractor's performance of the contract work. The Contractor shall hold and save the Government harmless from any and all liability to others arising from the performance of the contract.
Responsibility for Damages
The Contractor is responsible for all damages to persons and property resulting from performance of the contract work.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) Definitions. Commercially available off-the-shelf (COTS) item, component, domestic end product, foreign end product, qualifying country, qualifying country end product, South Caucasus/Central and South Asian (SC/CASA) state, South Caucasus/Central and South Asian (SC/CASA) state end product, and United States, as used in this provision, have the meanings given in the Buy American and Balance of Payments Program--Basic clause of this solicitation.
(b) Evaluation. The Government--
(1) Will evaluate offers in accordance with the policies and procedures of Part 225 of the Defense Federal Acquisition Regulation Supplement; and
(2) Will evaluate offers of qualifying country end products without regard to the restrictions of the Buy American statute or the Balance of Payments Program.

(a) Definitions. As used in this clause--
Contract financing payment means an authorized Government disbursement of monies to a contractor prior to acceptance of supplies or services by the Government.
(1) Contract financing payments include--
(i) Advance payments;
(ii) Performance-based payments;
(iii) Commercial advance and interim payments;
(iv) Progress payments based on cost under the clause at Federal Acquisition Regulation (FAR) 52.232-16, Progress Payments;
(v) Progress payments based on a percentage or stage of completion (see FAR 32.102(e)), except those made under the clause at FAR 52.232-5, Payments Under Fixed-Price Construction Contracts, or the clause at FAR 52.232-10, Payments Under Fixed-Price Architect-Engineer Contracts; and
(vi) Interim payments under a cost reimbursement contract, except for a cost reimbursement contract for services when Alternate I of the clause at FAR 52.232-25, Prompt Payment, is used.
(2) Contract financing payments do not include--

Electronic form means any automated system that transmits information electronically from the initiating system to affected systems.
Invoice payment means a Government disbursement of monies to a contractor under a contract or other authorization for supplies or services accepted by the Government.
(1) Invoice payments include--
(i) Payments for partial deliveries that have been accepted by the Government;
(ii) Final cost or fee payments where amounts owed have been settled between the Government and the contractor;
(iii) For purposes of subpart 32.9 only, all payments made under the clause at 52.232-5, Payments Under Fixed- Price Construction Contracts, and the clause at 52.232-10, Payments Under Fixed-Price Architect-Engineer Contracts; and
(iv) Interim payments under a cost-reimbursement contract for services when Alternate I of the clause at 52.232-25, Prompt Payment, is used.
(2) Invoice payments do not include contract financing payments.
Payment request means any request for contract financing payment or invoice payment submitted by the Contractor under this contract or task or delivery order.
Receiving report means the data prepared in the manner and to the extent required by Appendix F, Material Inspection and Receiving Report, of the Defense Federal Acquisition Regulation Supplement.
(b) Except as provided in paragraph (d) of this clause, the Contractor shall submit payment requests and receiving reports in electronic form using Wide Area WorkFlow (WAWF). The Contractor shall prepare and furnish to the Government a receiving report at the time of each delivery of supplies or services under this contract or task or delivery order.
(c) Submit payment requests and receiving reports to WAWF in one of the following electronic formats:
(1) Electronic Data Interchange.
(2) Secure File Transfer Protocol.
(3) Direct input through the WAWF website.
(d) The Contractor may submit a payment request and receiving report using methods other than WAWF only when-
(1) The Contractor has requested permission in writing to do so, and the Contracting Officer has provided instructions for a temporary alternative method of submission of payment requests and receiving reports in the contract administration data section of this contract or task or delivery order;
(2) DoD makes payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System);
(3) DoD makes payment on a contract or task or delivery order for rendered health care services using the TRICARE Encounter Data System; or
(4) The Governmentwide commercial purchase card is used as the method of payment, in which case submission of only the receiving report in WAWF is required.
(e) Information regarding WAWF is available at https://wawf.eb.mil/.
(f) In addition to the requirements of this clause, the Contractor shall meet the requirements of the appropriate payment clauses in this contract when submitting payment requests.
