Justification for Other Than Full and Open Competition Contract No. W912ES19T0070

Contracting Division St. Paul District

U.S. Army Corps of Engineers

1. Nature or description of the action being approved: The St. Paul District received a request for emergency dredging at the Lost Island site along the Mississippi River. Multiple barge groundings have taken place in this location due to build-up caused by the spring flooding.

2. Description of the services required: The Contractor will be responsible for providing all plant, labor, material, and equipment necessary for dredging approximately 45,000 cubic yards of material and transporting the dredging material to the West Newton Chute Placement site.

3. Identification of the statutory authority: 10 U.S.C. 2304(c)(2) Unusual and Compelling Urgency. The current conditions on the Mississippi River have resulted in multiple barge groundings. In order to prevent further groundings which could result in further damage to barges and hampering transportation along the waterway, it is imperative that this situation be addressed immediately.

4. Demonstration of the proposed contractors’ unique qualifications: Dubuque Barge and Fleeting Service Company, doing business as Newt Marine Service, is currently near the Lost Island location performing work "unloading" Lost Island. Because their equipment has already mobilized to the area, they are the only dredging firm with the capability to meet this urgent requirement.

5. Description of efforts made to ensure offers are solicited from as many potential sources as is practicable: A formal solicitation of the requirements was not completed as required by FAR 5.2 because of the exception referenced in FAR 5.202(a)(2). See paragraph 3 above.

6. Determination of price fair and reasonableness: Once the proposed price is received, it will be evaluated against the Independent Government Estimate which has been developed by a Government cost estimator. The IGE was developed based on previous similar dredging efforts in the Mississippi River for channel maintenance and the Government's view of the types of equipment typically used for these types of efforts.

7. Market research: Research was based on experience and knowledge of contractors in the region.
