52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
All quotes submitted will be evaluated for (1) Technical Acceptability, (2) Satisfactory Past Performance & (3) Price. The government will issue award to the vendor whose quote provides the overall best value to the Government. Vendor’s price quote will be evaluated to determine price reasonableness. Prices which are excessively high or low may be considered unrealistic, unreasonable, and may receive no further consideration.
1. Technical Acceptability - is defined as the capability to provide the supplies/services as specified in this Solicitation and the attached performance work statement (PWS), ability to meet or exceed the specified period or performance.
To be determined Technically Acceptable vendors shall submit the following with their quote package;
Examples of recent and relevant experience with motor vessel engine repairs and equipment upgrades as specified in the PWS. Vendors must submit make and model of proposed equipment if offering alternative makes and models than equipment listed in the PWS. All quoted equipment must be compatible with existing equipment. Vendors should submit product descriptions, technical specification sheets, product drawings and/or any other documentation necessary for the government to make a determination of technical acceptability of the item quoted. Must provide comparable warranty.
Vendors shall submit with their quote- periods of performance for engine repair/overhaul activities.
2. Satisfactory Past Performance – To demonstrate satisfactory past performance the vendor shall provide documentation of satisfactory performance on contracts of similar type work, size, scope and complexity, as well as, provide reference, including names and contact information of references who can verify their past performance. CPARS data and relevant and recent past performance history in Government databases will be queried. In the case of a vendor without a record of relevant past performance history for the services being purchased, the vendor may not be evaluated favorably or unfavorably for its past performance history.
3. Price - Price quotes will be examined to determine the extent to which proposed prices are comparable with the Government estimates, previous procurement history, and a determination made of Price Reasonableness. The Government may reject any proposal that is determined not to be Fair and Reasonable, unrealistically high or low in price when compared to Government estimates, or are unbalanced, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the requirements.
4. Exchanges with Vendors after Receipt of Quotes - Contractors may be asked to clarify certain aspects of their quote. Clarification conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for revision. The Government intends to award a contract without discussions with respective contractors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
Technical and past performance, when combined, are more important than price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
