52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Technical Capability Documentation of offerors technical capability to provide and install the items specified. Provide capability statement (one page narrative addressing ability to provide, or purchase, and install required equipment), or any other documentation necessary for the government to make a determination of technical acceptability of the items quoted. Documentation of offerors best delivery/completion date to provide and install the supplies shall be included and annotated on the first page of submittal.

Past Performance

Offerors shall provide past performance questionnaires for at least (2) companies within the past thirty-six

(36) months demonstrating successful performance by the offeror that are similar in scope and specifications of this requirement. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will be evaluated as neutral on Past Performance, providing the offeror supplies a statement with their offer that no past performance information is available. (Past Performance Questionnaire is provided as an attachment)

Price Quotes will be evaluated by comparing offered prices to one another. Price quotes will be examined to determine the extent to which proposed prices are comparable with the Government estimates, and previous procurement history and a determination made of Price Reasonableness. The Government may reject any proposal that is determined to be Not Fair and Reasonable, unrealistically high or low in price when compared unbalanced, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the requirements.

Technical and past performance, when combined, are approximately equal to price

The factors to be applied in this evaluation are Technical, Past Performance, and Price. These factors will be evaluated against the requirements to determine the proposal is acceptable or unacceptable, using the following rating table:

Rating Definition Acceptable Proposal clearly meets the minimum requirements of the solicitation, with all required documents.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018)
