1.2 NOTES

NOTE 1: Bidders shall furnish unit prices for all items listed on the schedule of bid items, which require unit prices. If the bidder fails to insert a unit price in the appropriate blank for required items, but does furnish an extended total or an estimated amount for such items, the

Government will deem his unit price to be the quotient obtained by dividing the extended estimated amount for that line item by the quantity. IF THE BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED

ESTIMATED AMOUNT FOR ANY ITEM, THE BID WILL BE DECLARED NONRESPONSIVE.

Any bid price for items indicated above which are unbalanced as to price may be rejected as non-responsive. An unbalanced bid is one which is based on price significantly less than cost for some work and price which is significantly overstated for other work.

Award will be made as a whole to one bidder.

SECTION F - DELIVERIES OR PERFORMANCE

The following Delivery Schedule item for SUBCLIN 0001AA to 0001AD has been changed from:

POP 01-MAY-2018 TO 01-DEC-2018

The following have been modified:

DELIVERIES AND PERFORMANCE

DELIVERIES AND PERFORMANCE

PART 1 GENERAL

1.1 CLAUSE PART 3

EXECUTION

3.1 COMMENCEMENT, PROSECUTION AND COMPLETION

3.1.1 Commencement

Upon receipt of Notice of Award, the Contractor shall proceed with preparations for performance of the contract which do not interfere with the removal of the previous Contractor's equipment or the removal of existing mats, such as making arrangements for the procurement of materials and supplies required for the work. The Contractor shall furnish his proposed sources of concrete aggregates and a plan for batch plant erection, including but not limited to type of plant and proposed location on the field, within 10 days after receipt of Notice of Award. Upon receipt of the Notice to Mobilize, the Contractor will have unrestricted access to the field to assemble and make ready for operation all necessary plant and equipment. The Contractor shall maintain the field in accordance with Paragraph 1.8.2, "Casting Field" in Section H. Any aggregate delivered to the site of the work shall not be removed therefrom without the written consent of the Contracting Officer. The Notice to

Proceed for Casting will not be issued prior to 15 days after the

Contractor receives Notice to Mobilize unless mutually agreed upon by the parties. The Contractor shall commence casting operations within 15 calendar days after the date of receipt by him of the Notice to Proceed for

Casting. It is anticipated that the Notice to Proceed for Casting will be issued between 1 May 2018 and 30 May 2018.

3.1.2 Prosecution

3.1.2.1 Base Period

During the casting process the Government may be removing existing mats from the casting field. The removal of mats should not be interfered with by the Contractor. The Contractor shall prosecute the work at an average rate of not less than 910 squares per calendar day during the payment period. Based upon an average of 910 squares per day the performance period of the Base Contract Line Item 0001, will be 170 calendar days.

The number of calendar days during the period shall be extended by the number of days of excusable delays which occurred during that period.

Excusable delays for weather do not occur until the number of actual days of delay exceed that shown in Section H, paragraph 1.25, "Time Extensions for Unusually Severe Weather". The Contractor shall cast at no less than the minimum rate until the entire quantity (basic and option) has been delivered.

3.1.2.2 Option Period

The Contractor will be notified of the Government's intent to exercise

Option CLIN 1001 within 14 calendar days of contract completion. The

Contractor shall prosecute the option period work at the same average rate as the base contract period, 910 squares per day. Based upon this average rate, the performance period of the Option Period will be 60 calendar days. The number of calendar days in the Option CLIN performance period shall be extended by the number of days of excusable delays which occurred during that period. Excusable delays for weather do not occur until the number of actual days of delay exceed that shown in Section H, paragraph

1.25, "Time Extensions for Unusually Severe Weather". The Contractor shall cast at no less than the minimum rate until the entire quantity (base and option) has been delivered.

3.1.3 Completion

3.1.3.1 Assessing Retainages

For purposes of assessing retainages, the average calendar day rate shall be computed at the end of each pay cycle over the preceding pay period.

The production days will be computed using the calendar days in that period reduced by the number of excusable delay days. The average production shall be determined by dividing the number of acceptable squares cast during the period by the number of production days. If the

Contracting Officer finds that satisfactory progress was achieved during the period, the Contracting Officer shall authorize payment to be made in full. However, if satisfactory progress has not been made during the period, the Contracting Officer may retain a maximum of 10 percent of the amount of the payment. When the work is substantially complete, the

Contracting Officer may retain from previously withheld funds and future progress payments that amount the Contracting Officer considers adequate for protection of the Government and shall release to the Contractor all the remaining withheld funds.

3.1.3.2 Computing Liquidated Damages

If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the Government liquidated damages of $3,095 per calendar day of delay.
