JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

a) CONTRACTING AGENCY: The requiring activity is OD-H, Surveying and

Mapping Branch also known as the Hydrographic Surveying Branch U.S. Army

Corps of Engineers, Jacksonville District.

1. DESCRIPTION OF ACTION: This action is in support of a service contract for software subscription for Sonarwiz. The contract is for a base plus four option years. The funds are O&M funds.

2. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:

b) The service is the provision of enterprise maintenance agreement (EMA) for Sonarwiz software, specifically for post processing magnetometer data, post processing sub-bottom profiler data, post processing side scan data, and post processing bathymetry. The quantity is for five

EMA licenses and for ensuing technical support.

c) The EMA includes direct support from the manufacturer Chesapeake Technology, which includes technical instant over the phone support five days a week during the company’s normal business hours. It also includes on-site support, which is needed once a year in order to assess the way data is being analyzed and to address the way updates effect the user interface.

3. AUTHORITY CITED: Identify the statutory authority, FAR/DFARS citation and

FAR/DFARS title permitting other than full and open competition.

"10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 and DFARS 206.302-1, for Only One

Responsible Source

4. REASON FOR AUTHORITY CITED:

a) There only one responsible source for Sonarwiz software, which is the manufacturer

Chesapeake Technology Inc. I have enclosed a letter from the manufacturer that supports this statement.

b) The way that the software post processes data is in compliance with the Hydrographic

Surveying Engineering Manual, 1110-2-1003.

c) The software works seamlessly with the existing sonar equipment (hardware) owned by the government.

d) While there are a variety of post processing software data on the market, the software used by

OD-H has to be one that complies with EM and works seamlessly, with the need for aftermarket connectors, with existing government owned equipment.

e) OD-H has invested $100,000 of training OD-H personnel in the use of Sonarwiz software since we had a Sonarwiz contract between fiscal year 2012 through fiscal year 2017.

http://www.arnet.gov/far/current/html/Subpart%206_3.html#wp1086841 http://www.acq.osd.mil/dpap/dars/dfars/html/current/206_3.htm

(2) Justification:

a) The proposed acquisition must be accomplished through other than full and open competition due to the need for OD-H employees to be efficient at hydrographic surveying, given a tight schedule and a limited training budget. Between fiscal year 2012 through fiscal year 2017, OD-H has accomplished over 120 hours of training and used $100,000 of training funds learning how to use Sonarwiz software efficiently and learning how to best apply it to projects unique to the

Jacksonville District. The Jacksonville District has a coastline that is unique to the south eastern region of the United States of America. Our coastline has unique qualities such as the biological importance or hard bottoms and grasses for sea turtles. The requirement to identify this is special to our District and does not apply to the Pacific Coast or to the northern region of the United

States of America.

b) Setting aside time for the geodesists and surveyors to learn new systems is a daunting task.

OD-H never has any scheduled downtime other than when the survey vessels require maintenance. The reason for this is because OD-H has a commitment to the Jacksonville District which includes the performance of 250 – 270 surveys per year. Some of our employees work 6 days a week on a regular basis in order to meet the deadlines of getting the surveys completed and mapped for our internal and external customers (i.e. Navy, bar pilots, ports, county officials, U.S.

Coast Guard). For this reason, time is a valuable resource in OD-H. As a program leader in OD-

H, I am a strong advocate of only introducing items that build on existing platforms in our existing workflow. Modern hydrographic surveying is highly technical. We incorporate GPS, satellites, geoid models, highly sophisticated sonar, and very sensitive instruments into our workflow. Each instrument creates a layer in our workflow and each layer has to be interoperable with the layers that precede it and follow on to it. If you have pieces that naturally work together, then the system works like clockwork. If you try to introduce something new that has not been tested before, then you will have to expect a lot of downtime to work out the bugs.

c) The proposed sole source vendor is shown below. OD-H has held a past contract with this vendor, W912EP-13-P-0011.

d) I performed market research to look at similar software. However, similar software is made for the U.K. Sweden, and Denmark markets.

(3) Impact: The detrimental effects to the navigation and coastal mission of the

Jacksonville District would be the lack of support. One of the Jacksonville District’s primary functions is the navigation and coastal mission. The navigation mission supports the O&M dredging of federal channels.

a) The coastal mission supports the beach nourishments. OD-H performs surveys that directly supports the Planning Division. Planning Division uses our surveys to create reports that are given to environmental agencies like FDEP and EPA. Based on their findings in our surveys, they make decisions on areas that can be dredged, not dredged, have pipeline laid, not have pipeline laid, or create an ODMDS (Ocean Dredged Material

Disposal Site). Due to the economic value that beaches play on Florida’s revenue from mailto:etgann@chesapeaketech.com tourism, the beach nourishment projects often receive high exposure in the press and from Congressmen.

b) The navigation mission supports the dredging of federal channels. OD-H’s customer in this instance is the construction area office that is administering the O&M dredging contract.

This project too generates high visibility in the press, typically from the U.S. Navy. Naval

Submarine Base Kings Bay for instance is the home to ballistic missile submarines armed with Trident nuclear weapons. It is an extremely high security area. They limit the amount of time that outsiders, including the U.S. Army Corps of Engineers surveying crew can spend there. In fact, when the OD-H surveying crew is inside the “secure area”, they have armed guns pointed directly at that while they are performing the survey. In a very high anxiety circumstance like this, it is important the surveyors are 100% confident and competent in the software that they are using.

(4) Alternatives:

While Alternatives to Sonarwiz exist, they would be complicated to implement. The primary reason for this is that the other software are designed and based outside of the United States of

America. Alternative software like EIVA and Deep Vision are primarily used in Denmark and

Sweden. Having to train our employees with non-USA products would be expensive due to having to consider the cost of international flights. Additionally, working with drastically different time zones is very challenging. Lastly, there is the difficultly with the language barrier.

In Denmark and Sweden, English is not the primary language.

5. EFFORTS TO OBTAIN COMPETITION:

A solicitation along with this Brand Name Justification will be made publicly available utilizing

Fedbizups otherwise known as FBO.

6. ACTIONS TO INCREASE COMPETITION:

OD-H would be willing to consider offers from 3rd party vendors that are authorized by

Chesapeake Technology, Inc.

7. MARKET RESEARCH:

Reference the enclosed market research document.

9. Other Facts:

W912EP-13-P-0011 was for the exact same scope of work. I have enclosed a copy with this procurement package. It was a five year contract consisting of base plus four option years. All four option years were exercised.
