TECHNICAL SPECIFICATIONS
TRI RIVERS NATURAL RESOURCE MANAGMENT
26’ WELDED ALUMINUM PATROL BOAT WITH TRAILER
1.0 INTENT
These specifications cover the manufacture, outfitting, and delivery of one new 26 foot welded aluminum patrol boat with at a minimum two four stoke 200HP outboard engines. The contractor shall provide all labor, material, equipment, and engineering necessary to build and deliver a boat meeting the specifications below.
2.0 SCOPE
2.1 The vessel shall comply with all current U.S. Coast Guard Regulations, US Army Corps of Engineers Safety Manual EM 385-1-1 Section 19, and Federal and State environmental requirements with respect to a vessel’s function, construction and equipment outfitting.
2.2 The vessel shall be newly manufactured and shall be built entirely of aluminum by a proven manufacturer regularly engaged in the manufacture of welded aluminum boats.
2.3 All welding shall be accomplished in accordance with the recommendations of the manufacturer of the material used in the construction of the vessel. All sharp and /or rough edges shall be ground round and smooth and all weld splatter and slag shall be removed. All exterior seams and butts shall be flush and smooth and the hull plating shall be shrunk as required to remove all ripples and make fair.
3.0 26 FOOT ALUMINUM PATROL BOAT MINIMUM REQUIREMENTS
3.1 Hull and Hardtop:
3.1.1 Length: 26 feet
3.1.2 Beam: 102 inches wide
3.1.3 Bottom hull and transom thickness will be at least 0.25 inch and 5086 Marine Alloy will be used for the entire hull
3.1.4 Bow anchor storage compartment

5.0 TRIALS
5.1 At 70-80 percent completion the contractor shall coordinate an on-site meeting at their facility with the technical expert to go over the boat build to that point to assure all aspects of the contract are being met. The government will at its own expense sent the technical expert and 1-2 other employees for the on-site meeting.
5.2 The vessel must undergo in-water trials. The trials must demonstrate that hull, mechanical, and electrical systems function properly and that the vessel meets minimum requirements. Trials shall be conducted on the day of delivery with the contractor and the on-site technical expert present. Any failure will be repaired by the contractor.
6.0 POST-AWARD SUBMITTALS:
The contractor shall furnish one electronic copy of the general arrangement plan and profile of all major equipment layouts of the boat to the Contracting Officer and the Contracting Officer Representative.
7.0 WARRANTY:
Builder to warrant workmanship and equipment installation for a minimum of one (1) year (longer if builder’s standard practice). Builder to provide all equipment and materials warranty/guarantee documents to purchaser at point of delivery.
8.0 ANTITERRORISM/OPERATION SECURITY REQUIREMENTS
8.1 All contractor and all associated sub-contractor employees who will require entry onto McNary Lock and Dam property shall comply with applicable access and security policies and procedures (provided by Government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
9.0 SHIPMENT AND DELIVERY: All items shall be delivered FOB destination to McNary Lock and Dam within 180 days of contract award. The contractor shall be responsible for packing and shipping the boat in a manner that will ensure undamaged and complete arrival to McNary Lock and Dam. All deliveries shall be coordinated with the on-site technical expert and Contracting Officer Representative Brandon Frazier. No shipments are allowed other than normal business hours of Monday through Thursday 7:00 a.m. - 4:00 p.m., excluding Federal holidays unless coordinated at least 10 working days in advance.

This contract is subject to the written approval of the Contracting Officer and shall not be binding until so approved.
52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (MAR 2020)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at http://www.sba.gov/content/table-small-business-size-standards.
(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.

52.246-18 WARRANTY OF SUPPLIES OF A COMPLEX NATURE (MAY 2001)
(a) Definitions.
"Acceptance," as used in this clause, means the act of an authorized representative of the Government by which the Government assumes for itself, or as an agent of another, ownership of existing and identified supplies, or approves specific services rendered, as partial or complete performance of the contract.
"Correction," as used in this clause, means the elimination of a defect.
"Supplies," as used in this clause, means the end items furnished by the Contractor and related services required under this contract. The word does not include "data."
(b) Contractor's obligations. (1) The Contractor warrants that for a minimum of one (1) year (longer if builder’s standard practice). Builder to provide all equipment and materials warranty/guarantee documents to purchaser at point of delivery. All supplies furnished under this contract will be free from defects in material and workmanship and will conform with all requirements of this contract; provided, however, that with respect to Government-furnished property, the Contractor's warranty shall extend only to its proper installation, unless the Contractor performs some modification or other work on the property, in which case the Contractor's warranty shall extend to the modification or other work.
(2) Any supplies or parts thereof corrected or furnished in replacement shall be subject to the conditions of this clause to the same extent as supplies initially delivered. This warranty shall be equal in duration to that set forth in paragraph (b)(1) of this clause and shall run from the date of delivery of the corrected or replaced supplies.
(3) The Contractor shall not be obligated to correct or replace supplies if the facilities, tooling, drawings, or other equipment or supplies necessary to accomplish the correction or replacement have been made unavailable to the Contractor by action of the Government. In the event that correction or replacement has been directed, the Contractor shall promptly notify the Contracting Officer, in writing, of the nonavailability.
(4) The Contractor shall also prepare and furnish to the Government data and reports applicable to any correction required (including revision and updating of all affected data called for under this contract) at no increase in the contract price.
(5) When supplies are returned to the Contractor, the Contractor shall bear the transportation costs from the place of delivery specified in the contract (irrespective of the f.o.b. point or the point of acceptance) to the Contractor's plant and return.
(6) All implied warranties of merchantability and "fitness for a particular purpose" are excluded from any obligation contained in this contract.
(c) Remedies available to the Government. (1) In the event of a breach of the Contractor's warranty in paragraph (b)(1) of this clause, the Government may, at no increase in contract price--
(i) Require the Contractor, at the place of delivery specified in the contract (irrespective of the f.o.b. point or the point of acceptance) or at the Contractor's plant, to repair or replace, at the Contractor's election, defective or nonconforming supplies; or
(ii) Require the Contractor to furnish at the Contractor's plant the materials or parts and installation instructions required to successfully accomplish the correction.
(2) If the Contracting Officer does not require correction or replacement of defective or nonconforming supplies or the Contractor is not obligated to correct or replace under paragraph (b)(3) of this clause, the Government shall be entitled to an equitable reduction in the contract price.
(3) The Contracting Officer shall notify the Contractor in writing of any breach of the warranty in paragraph (b) of this clause within 45 days after discovery of defect. The Contractor shall submit to the Contracting Officer a written recommendation within 30 days as to the corrective action required to remedy the breach. After the notice of breach, but not later than 30 days after receipt of the Contractor's recommendation for corrective action, the Contracting Officer may, in writing, direct correction or replacement as in paragraph (c)(1) of this clause, and the Contractor shall, notwithstanding any disagreement regarding the existence of a breach of warranty, comply with this direction.
If it is later determined that the Contractor did not breach the warranty in paragraph (b)(1) of this clause, the contract price will be equitably adjusted.
(4) If supplies are corrected or replaced, the period for notification of a breach of the Contractor's warranty in paragraph (c)(3) of this clause shall be 30 days from the furnishing or return by the Contractor to the Government of the corrected or replaced supplies or parts thereof, or, if correction or replacement is effected by the Contractor at a Government or other activity, for 30 days thereafter.
(5) The rights and remedies of the Government provided in this clause are in addition to and do not limit any rights afforded to the Government by any other clause of the contract.
