JUSTIFICATION AND APPROVAL

SINGLE-SOURCE DETERMINATION

1. CONTRACTING AGENCY: US Army Corps of Engineers (USACE), Walla Walla District

(CENWW-CT), 201 North Third Avenue, Walla Walla, WA 99362.

2. DESCRIPTION OF ACTION: This request is to renew licenses and subscriptions for engineering design software. Specifically, USACE requires the following:

a. Renew licenses for two existing seats of SolidWorks Premium for X years,

b. Renew licenses for two existing seats of SolidWorks Premium with Simulation Premium for a period of 3 years,

c. Purchase two additional seats of SolidWorks Premium and two licenses for the two additional seats for a period of 3 years.

SolidWorks is used by Design Branch to create three dimensional models. In doing so, the design is modeled completely in a virtual environment allowing design engineers a means of checking all dimensions and fits throughout the system. The customer is able to view three-dimensional models for a full understanding of how the model will look in its final environment. Simulation Premium allows the designer to apply the expected real world loads on the model. The program utilizes an energy minimization method of finite elements. The result is a graphical representation of locations of high stress. Designers can utilize the high stress concentrated areas to test against their anticipated factor of safety and material strength.

The cost of this requirement is expected to be under the Simplified Acquisition Threshold.

3. DESCRIPTION OF SERVICES: Service includes all major SolidWorks® software upgrades released during the subscription term, telephone support services provided by Quest Integration, and comprehensive 24-hour by 7-days-a-week on-line web access to download priority enhancements for new software and other features.

4. AUTHORITY CITED

a. FAR 13.106-1 (b), Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

b. FAR 11.105-(a)(1): the particular brand name, product, or feature is essential to the

Governments’ requirements, and market research indicates other companies’ similar products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s need.

5. REASON FOR AUTHORITY CITED:

a. BACKGROUND: Quest Integration (“Quest”) is the current and sole license-holding company for SolidWorks software? and we view this as a new purchase and extension.

b. JUSTIFICATION Quest can extend the license for SolidWorks Premium and Simulation Premium on our existing network and add the two additional seats of SolidWorks Premium.

From an IT/Licensing perspective, it will be much easier to manage the license server if we are only dealing with one company when it comes to maintenance and annual license renewals. The licensed server controls the number of licenses that can be in use and what products can be used.

If we are dealing with additional companies at the point of license expiration, we will have to devise a way of switching the licenses from different vendors on one licensing server which will not only be labor/time intensive, it may NOT be technically possible. If it is not technically possible, we would need to set up an additional license server and the users of SolidWorks would have to be set up to use the new licenses. Only having to deal with one company for annual renewals of maintenance minimizes the complexity, ensuring quick and better service. Also the cost is being matched to GSA pricing so there is no advantage to go with any other vendor. Quest Integration is a small business in a local HUBZone area.

6. EFFORTS TO OBTAIN COMPETITION: Although there is another company who could provide this requirement (SolidWorks GSA vendor Lyme Computer Systems INC), the added burden and expense to USACE by awarding to a vendor other than Quest is not justified. See para. 5.b. Justification, above. Quest Integration, as the current account holder of USACE existing seats, gives Quest access to our account, something the GSA contractor would not have.

The complexities of switching to a new license holder would put current high priority work production at risk.

7. ACTIONS TO INCREASE COMPETITION: SEE Paragraph 5, 6 & 8

8. MARKET RESEARCH: See paragraph 6, above. Price comparison shows Quest Integration matches the current GSA pricing schedule on all items. There is no price advantage to switching vendors and a considerable disadvantage in resource costs to switch.

9. INTERESTED SOURCES: N/A

10. OTHER FACTS: USACE recently awarded a contract for all Information Technology (IT) services to Army Corps of Engineers-IT (ACE-IT). Walla Walla IT and Contracting Divisions believes it is in the best interest of the District to ensure the current contract is renewed and maintained until the responsibility of the service and equipment is transferred to ACE-IT. Current ACE-IT Interim Software Procedures notes that the District Project sites are still responsible for funding and renewal of existing and new maintenance contracts using local impact card or local contract office.

11. FAIR AND REASONABLE COST DETERMINATION: Price comparison shows Quest

Integration is matching on most items on the current GSA pricing schedule however, there are a few items on the schedule that are priced slightly higher than Quest Integration. There appears to be a slight decrease in Quest Integration pricing compared to the previous awarded Contract 15- P-0167. The cost savings may not reflect much of a decrease but still provides a cost savings to the government.
