SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS

The following have been modified:

REQUEST FOR QUALIFICATIONS (RFQ)

1. Description of the procurement The U.S. Army Corps of Engineers (USACE), Walla Walla District has a requirement for a Design Build Construction Contract. This procurement will be conducted as a 100% Small- Business Set-Aside using the Best Value trade-off source selection process in FAR Part 15 and two- phase design-build procedures in FAR Part 36.3.

The primary NAICS code for work under this procurement is 237990 (Other Heavy and Civil Engineering Construction) with a small business size standard of $36.5 million. The Phase One solicitation will contain the Phase One evaluation factors identified below which will be based on the overall project scope of work. The Phase One evaluations of proposals will only be used for the selection of the most highly qualified offerors to proceed to Phase Two and will not be utilized in the Phase Two evaluations and Best Value determinations. Up to four of the most highly qualified firms will be selected to submit Phase Two proposals. Upon the conclusion of Phase One, the solicitation will be amended to include the Phase Two evaluation factors and the project scope of work.

Definition of Design-Build: Combining design and construction in a single contract with one contractor as defined in FAR 36.102.

Subcontractor: A concern that completes a minimum of 15% of the work under a contract that is being used for experience or past performance.

All contract requirements will be detailed in the RFP using the USACE Contract Format consisting of the following sections: 00010- Solicitation/Contract Form, 00100-Schedule/Instruction to Offerors/Evaluation Factors for Award, 00600C-Representations and Certifications, 00700-Contract Clauses, 00800-Special Contract Requirements, 01000- Division 1/General Requirements, and 16999-Division 2-16/Technical Provisions.

The contract will be awarded on a firm-fixed price basis.

2. Scope of Work The scope of the project is to modify the lower section of the 50-foot wide spillway chute and its spill deflector to a flatter ogee shape by adding concrete to the existing ogee shape and deflector. Design, fabricate, and place a bulkhead to isolate the construction area in the spill bay from the stilling basin from about 10-12 feet of water. The bulkhead design would be stamped by a licensed professional engineer. The contractor may use a barge mounted crane moored in the stilling basin outside the work area to set the bulkhead and support the construction work.

Remove some concrete from the face of the existing spillway, exposing the rebar and leaving a roughened surface for placement of the new concrete forming the flatter spillway chute and modified spill deflector. The estimated amount of concrete removal is 150 cy. The work may include drilling and grouting concrete anchors into the face of the spillway followed by installation of reinforcing steel. Install concrete formwork and place concrete for the final spillway chute and spill deflector surfaces. Place the concrete within a limited work window, and demonstrate concrete placement on a sloped surface.

Install a series of pass-over antennas (GFE) within the added spillway ogee surface. Cover the antennaes with a 6 inch non-metallic rebar and non-metalic aggregate concrete cap to isolate them from spillway flow during spillway operation. Aluminum shields, transceivers and the communication cables connecting them are also GFE.

Install associated cabling and conduit in the spillway surface to connect the antennaes to a climate controlled shelter provided by the contractor and ground the antennae and shields. Locate the electrical climate controlled shelter adjacent to spillbay one.

Communications cable includes copper antenna cables between the antennas and transceivers (GFE) and fiber optic cables from the transceivers back to the existing data system in the juvenile fish facility. Provide power for the electrical shelter.

Area of Responsibility: The work will be geographically located in the Garfield County and specifically at Lower Granite Lock and Dam, Pomeroy, Washington.

Project: During Phase Two of this solicitation, the Government intends to award Lower Granite PIT Tag Monitoring System design and construction of a project that may be representative of the general project scope of work as presented in Section 2. This project will be awarded on the basis of price and non-price factors. Project details along with the non-price evaluation factors will be provided in Phase Two.

PHASE ONE SECTION 00100, INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS

A. General Late Submissions will not be considered. Do not submit pricing information in Phase One. Electronic or faxed proposal submissions will not be considered. Phase One proposal must be clearly marked on the outside of the package with the solicitation number. The closing date annotated on the pre-solicitation notice via FedBizOpps is for FedBizOpps archiving purpose only.

The Phase One qualifications proposal due date and time is: May 23, 2017 at 3 p.m. Local Time

Up to four of the most highly qualified firms as evaluated in Phase One will receive the RFP amendment and be requested to provide Phase Two proposals.

B. Construction Cost Limitation

The target ceiling for contract award for design and construction is $6,000,000.00 based on the funds made available for this project. The Government cannot guarantee that additional funds can be made available for award. Offerors are under no obligation to approach this ceiling.

NOTE: It is the offeror’s responsibility to ensure that all past performance questionnaire surveys as outlined under Factor 2 are completed on or before the closing date and time of the Phase One Request for Qualifications.

D. Phase One Qualifications Proposal Format Qualifications in response to the RFQ shall be submitted in the following format:

Three ring binders or bound with tabs or separators dividing each of the sections noted below. Page limits, if stipulated under each evaluation factor must be adhered to. Proposals shall be submitted on 8.5” X 11” paper, utilizing both sides of the paper unless otherwise stated under each Factor. Page is defined as a single sheet of paper with text on both sides. The Government will not evaluate any material that exceeds the page limits specified herein.

The qualifications proposal shall be in the following order with tabs dividing each section:

1. Cover Letter

2. Joint Venture agreement (if applicable)

3. Letter of Commitment(s) (if applicable)

4. Factor 1- Design-Build Experience documents

5. Factor 2- Past Performance documents

6. Factor 3- Technical Approach documents

A total of one original and four hard copies of the complete Phase One qualifications proposal shall be submitted on or before the closing due date and time specified above.

E. Cover Letter

Include the following information in your cover letter:

1. Solicitation number

2. The name, address, telephone number, and email address of the prospective offeror

3. The DUNS number, CAGE Code, and TIN of the prospective offeror

4. Acknowledgement of any amendments issued (amendment number and date acknowledged by offeror)

All inquiries regarding this solicitation are to be submitted via Bidder Inquiry. Telephone and email inquiries will not be accepted. Bidder Inquiry is a web-based program that allows bidders to post questions regarding the solicitation and view all questions by other bidders and responses by USACE. Bidder Inquiry can be accessed through ProjNet at https://www.projnet.org/projnet/.

H. Amendments to the RFP Any and all amendments to this RFP will be issued electronically and be available via www.fbo.gov. It is the offeror’s responsibility to continuously check for any amendments to this RFP and acknowledge any and all amendments in the text of the cover letter (amendment number and date acknowledged by offeror) sent with their proposal package in response to this RFP.

I. Pre-proposal Conference/Site Visit No pre-proposal conference or site visit will be conducted during Phase One.

J. Joint Ventures (JV) A joint venture is defined as follows: A legal business entity formed between two or more companies (parties) to undertake the performance activities of a contract together. This does not include other arrangements such as “teaming agreements” or “strategic alliance”, which are not recognized as bona fide joint ventures for the purposes of this solicitation.

A company that is part of a joint venture must submit a legally binding joint venture agreement. The Government will not evaluate the capability of any contractors that are not included in the joint venture agreement. Joint ventures must include a copy of the legal joint venture agreement signed by an authorized officer from each of the firms comprising the joint venture with the chief executive of each entity identified.

If submitting a proposal as a joint venture, the experience, past performance, and technical approach of each of the joint venture partners can be submitted for the joint venture entity. The experience for each joint venture partner will be considered the experience of the joint venture entity. Page and project form limits apply to the joint venture as a whole. Prospective Offerors that submit Phase One proposals may not change their firm (including LOC’s and proposed sub-contractors) or their Joint Venture firms, if selected to submit Phase Two proposals.

K. Credit for Subcontractor Experience; Letter of Commitment (LOC) If an Offeror wishes to be credited with a construction subcontractor, supplier, or Engineering Firm experience, (i.e.

a firm that is not the prime contractor or part of the joint venture), a letter of commitment signed by the subcontractor and the prime contractor must be submitted. The commitment letter must be submitted even if the firm is in some way related to a joint venture partner (for example, the subcontractor is subsidiary of a joint venture partner, or a subsidiary of a firm to which the joint venture partner is also a subsidiary). The Proposers must submit at least one LOC from a Design Firm capable of performing engineering on the majority of project types listed in Section 2.

In regard to Experience, if an Offeror submits projects demonstrating experience in one of the factors, and that project was completed by a subcontractor, a subsidiary, or a supplier, as opposed to the prime or one of the joint venture partners, the Offeror MUST submit a signed letter of commitment from the contractor who performed and completed the work. If a letter of commitment is not submitted, the experience will not be considered. Prospective Offerors that submit Phase One proposals may not change their firm (including LOC’s and proposed sub-contractors) or their Joint Venture firms, if selected to submit Phase Two proposals.

M. Expenses Incurred The Government will not reimburse any costs incurred or associated with preparation and submission of any response(s) to this solicitation.

N. Discussions The Government intends to select up to four of the most highly qualified offerors in Phase One without conducting discussions, however, the Government reserves the right to conduct discussions as determined necessary by the Contracting Officer.

PHASE ONE EVALUATION FACTORS

1. Relative Importance of Phase One Evaluation Factors For evaluation purposes, all three Phase One evaluation factors are of approximately equal importance.

3. FACTOR 1: EXPERIENCE

The Government will evaluate and assess the extent of an offeror’s relevant construction and Design- Build experience and proposed team’s experience (design firm and major subcontractors) on projects completed in the last six years or at least 75% complete at the time proposals are due. The Government will evaluate the offeror’s depth and breadth of experience on different types of relevant design capability and construction types. The Government will evaluate no more than five projects for each prime contractor and 5 for each designer. Three projects for each major subcontractor (Mechanical, Structural, Electrical) will be evaluated as listed by the offeror on Attachment A, Experience Overview Sheet and as further described on Attachment B, Experience Information Form.

The following parameters apply for evaluation purposes:

A. Relevant projects should include the following to be considered fully relevant:

1. Are valued at $1,000,000 or larger; and

2. Include construction and/or design service requirements similar to the following construction or repair for:

a. structural concrete of civil works projects such as dams, barge moorage facilities, or pumping plants;

b. structural concrete that ties into an existing structural concrete system;

c. work performed in a marine environment;

d. work with a completion schedule subject to constraints with work window such as fish migration seasons, inclement weather conditions, or other restrictions;

e. work that contains installation of fall protection equipment and elevation work platforms/access;

f. work on electrical systems may include: Telecom/CCTV systems, fiber optic, instrumentation and controls (e.g., PLC, SCADA), and medium voltage distribution (less than 5Kv).

B. Experience provided for proposed design firm and major subcontractors will only be evaluated if a letter of commitment is signed by each proposed firm and submitted with the proposal. A letter of commitment is not required if the offeror is a joint-venture and the firm is part of the joint-venture agreement.

Submission Requirements:

Offerors shall submit a complete Attachment A, listing a total of up to five construction project type work that best represents the offeror’s experience. The listing shall include relevant Design-Build experience for projects completed in the last six years.

For each project listed on Attachment A, the offeror must provide an Experience Information Sheet, Attachment B. On Attachment B, identify the design disciplines that performed and the percentage of design completed by the offeror. Offerors are responsible for providing project descriptions in sufficient detail to permit evaluation of project relevancy. Offerors are encouraged to provide additional descriptive information on projects in addition to the attachments, but any additional information must pertain to the projects listed.

Clearly identify design disciplines (eg Civil, Structural, Mechanical, Electrical, Hydraulics) directly employed by the Offeror that performed engineering or design on the project. For design by subcontract, identify the contractual arrangement (ie subcontract, Joint-Venture, Limited Partnership, etc). For major project elements, clearly define who performed the design and the relationship to the Engineer/designer. Include description of the engineer/designer involvement during construction.

The offeror should also describe the type and percentage of construction trades performed by the contractor, or as a subcontractor, for each project.

Offerors may attach one additional page to Attachment B if necessary.

Rating Description

Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.

Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.

Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is not awardable.

4. FACTOR 2: TECHNICAL APPROACH

The government will evaluate and assess the offeror’s understanding of the requirements, feasibility of the proposed technical approach, and risks and mitigation in the execution of the project wherein the Government provides minimal or limited design consisting of informational drawings and functional/performance specifications. The purpose of this factor is to determine whether the offeror has appropriate understanding of the design-build process and is not intended to limit an offeror to any proposed technical solution or to allow an offeror to provide less than the minimum requirements for Phases One and Two of the solicitation.

(The Technical Approach proposal may not exceed 15 pages.)

Based on your understanding of the scope of work, describe your technical approach for design-build projects wherein the Government provides minimal or limited design consisting of informational drawings and functional/performance specifications. Address the following areas in your technical approach to include any risks and the proposed approach for risk mitigation:

Organization. Provide an organizational chart showing the reporting structure and lines of authority for the proposed team key functions such as project manager, superintendent, lead designer, safety manager, and others.

Without identifying by name, describe the role of the key functional members during design and construction.

Expedited completion. Describe your approach to streamlining design and construction resulting in reduced costs and achievement of aggressive schedules with consideration to operational or environmental restraints.

Communication and coordination. Describe your communication and coordination approach within the design-build team, and with the government during the design and construction phases. Describe your approach to facilitate design and construction submittal reviews. Describe in detail the Designer of Record’s involvement throughout the entire project period.

Quality control. Describe your approach for quality control for both design and construction. Include: quality control organization; review of design; verification of construction materials; construction inspection; permit compliance; project documentation; and change request process.

5. FACTOR 3: PAST PERFORMANCE

A. The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the scope of work.

B. The Government will focus its inquiries on the offeror’s (and major subcontractors’) record of performance as it relates to all solicitation requirements, including price, schedule, performance and management of subcontractors. Major subcontractors are defined as members of an offeror’s overall team who are expected to perform ten (10) percent or more of the proposed effort. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process.

Therefore, offerors are reminded to include the most current and relevant past efforts (within the past six years) in their proposal. The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System NAICS 237990, Other Heavy and Civil Engineering Construction. Data used in conducting performance risk assessments shall not extend past six years prior to the issue date of the RFP, but may include performance data generated during the past six years without regard to the contract award date.

C. Offerors shall submit all Government and/or commercial contract numbers and descriptions for the prime offeror and each major subcontractor in performance or awarded during the past six years, from the issue date of this RFP, which are relevant to the efforts required by this RFP. The Government may consider a wide array of information from a variety of sources, but is not compelled to rely on all of the information available.

D. The past performance factor considers each offeror’s demonstrated current and relevant past record of performance in supplying products and services that meet the contract requirements. There are two aspects to the past performance evaluation: relevancy and performance confidence assessment.

(i) RELEVANCY: The Government will conduct a performance assessment based on the relevancy of the Offeror's current and past performance, as well as that of its major subcontractors, as it relates to the probability of successful accomplishment of the required effort. These efforts include all aspects of schedule, performance and customer support, including the Offeror’s submitted subcontracting plan for this project and the Offeror’s record of: 1) Conforming to specifications and standards of good workmanship; 2) Maintaining program execution within price; 3) Adherence to contract schedules, including the administrative aspects of performance; 4) Ability to resolve technical and manufacturing problems quickly and effectively; 5) Businesslike concern for the interest of its customers; 6) Establishing and maintaining adequate management of subcontractors; and 7) Compliance with subcontracting plans submitted on previous projects.

(ii) PERFORMANCE CONFIDENCE ASSESSMENT: The final step is for USACE to arrive at a single consensus performance confidence assessment for the offeror, selecting the most appropriate rating from the chart below. This rating considers the assessed quality of the relevant/current efforts gathered (documented results from Past Performance Questionnaires, interviews, CPARS, and other sources form the support and basis for this assessment).

The offeror shall provide the NAVFAC/USACE Past Performance Questionnaire (Form PPQ-0) at Attachment C to clients for each project the offeror (and proposed team) included in response to Factor 1, Experience. Ensure correct phone numbers and email addresses are provided for the client point of contact.

Completed PPQ-0s should be submitted with your proposal therefore, offerors should follow-up with clients to ensure timely submittal of questionnaires.

If the offeror is unable to obtain a completed PPQ-0 from a client before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ-0, which will provide contract and client information for the respective project. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Mr. Kent Bernard, via email at Kent.R.Bernard@usace.army.mil prior to the proposal closing date. The offeror must submit, with its proposal, a list of all the POC’s who were sent questionnaires.

The POC List shall be submitted in Word for Windows Table Format to include the following fields: Solicitation Number; Company Name; Contract Number; Government Agency; POC Last Name, First Name; POC Title; POC Telephone Number; POC E-mail Address; and Date E-Mail to POC (month/day). Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

6. INFORMATION ONLY-PHASE TWO REQUEST FOR PROPOSALS (RFP)

The following is a brief overview of the Phase Two process for your information and only applicable to those offerors who are selected to submit proposals in Phase Two. Do not submit Phase Two documentation during Phase One. Phase One submissions and evaluations will not be carried over into Phase Two. All Offerors selected to propose for Phase Two will be evaluated on only the Evaluation Factors outlined in the Phase Two

RFP.

In Phase Two, an RFP amendment will be issued to up to the four highest qualified firms and will consist of all contract requirements for Lower Granite PIT Tag Transponders. In addition, this RFP will also include the informational plans (floor plan, cross section, and elevation), Statement of Work, and the specifications. The contract amount for design and construction shall not exceed $6,000,000.00 for this project. Offerors are under no obligation to approach this amount.

Evaluation Criteria will be:

A pre-proposal conference/site visit may be conducted during Phase Two.

Phase Two offerors will have not less than 30 days to provide their proposals. Phase Two of the solicitation shall require submission of a technical and price proposal based on the project. Technical adjectival ratings used for Phase I will also be used for Factors 1-3 in Phase II.

Proposals received in response to the Phase Two RFP will be evaluated in accordance with source selection procedures outlined in FAR Part 15. The government plans to make one contract award, and it will be made to the offeror whose total evaluated price and technical proposal provide the best value to the Government.

The Government reserves the right to accept other than the lowest priced offer or to reject all offers. The Government will not award a contract to an offeror whose proposal contains a deficiency, as defined in FAR 15.001.
