Quick Start Alarm Panel Maintenance

PERFORMANCE WORK STATEMENT

SECTION 1 GENERAL

1.1. This contract is a fixed-price, performance-based service contract. The Contractor shall maintain elevators, equipment appurtenances, and accessories so as to comply with the requirements of the latest editions of the elevator codes. The Elevator Inspector’s Manual, ASME A17.2 shall be followed for required inspection and maintenance procedures to ensure safe operation of all elevators covered under this contract. All elevators require a 5 year test during the contract’s 2nd option year. Additionally, the contractor will perform testing, maintenance and emergency call out service on the powerhouse elevator fire panel, Quickstart Fire Alarm Panel Model # QS1-1-G-1, in accordance with NFPA 70 National Electric Code and NFPA 72 National Fire Alarm and Signaling Code.

1.2. CONTRACTOR PERSONNEL

1.2.1 The Contractor shall have a current State of Washington Elevator Journeyman License. The Contractor shall perform all work under this Contract with his/her own forces except as provided in the section titled Subcontracting. Employees who perform this work shall be qualified persons on the Contractor's own payroll.

Only persons directly involved with accomplishment of the Contractor’s operations are allowed on the project.

1.2.2 Contractors and subcontractors must maintain a neat and clean appearance and must wear supplied Government badges marked with their picture, name, and the company’s name.

1.2.3. The Contractor employees must be skilled in and capable of performing the work under this contract. All employees of the Contractor or subcontractors shall be 18 years of age or older and must be able to fluently read, write, speak, and understand English.

1.2.4. Subcontractors. No work may be subcontracted without written approval of the Contracting Officer (KO).

Compliance with the provisions of this contract by subcontractors shall be the responsibility of the Contractor.

1.2.5. Licensing. The Contractor must ensure that all employees and subcontractors have a current State of Washington Elevator Journeyman License. Contractors must also have safety training covering Safe Work Practices, Personal Protective Equipment, Proper House Keeping and Fire Protection. Additionally, the Contractor must ensure that all employees have necessary certificates as required by state. The Contractor must apply risk management strategies to ensure personnel safety, and must comply with safety requirements articulated in EM 385- 1-1, the US Army Corps of Engineers Safety Manual, and 29 CFR 1910 - Occupational Safety and Health Act (OSHA). 1.2.6 LOCKOUT/TAGOUT (LOTO)-SAFE CLEARANCE OR HAZARDOUS ENERGY CONTROL (HEC)

PROCEDURES

All contractor work on site shall meet the requirements of "Safety and Occupational Health Office; Safe Clearance Program for the Control of Hazardous Energy, NWWOM 385-1-20. A digital copy may be obtained at the web address shown below in paragraph, Safe Clearance Training. Safe Clearance procedures are used by Project and Contractor personnel to protect personnel, equipment and the environment as well as ensuring continuity of service.

Any work performed by the Contractor that requires taking project operated equipment out of service shall be done only after a formal clearance is obtained through the government. Violations will be reported to the Issuing Authority and violations may result in disciplinary action ranging from retraining to removal of safe clearance authorization.

For jobs with multiple tasks that require AHA's, the Contractor shall prepare and submit an Activity Hazard Analysis (AHA) on the first feature of work that requires a clearance request. A comprehensive AHA is required for smaller jobs. AHA requirements will be verified at the Pre-construction meeting.

The following applies to LOTO and HEC procedures:

a. The government will provide Safe Clearance Tags and will issue Isolation Locks to Contractors for clearances using the Government Safe Clearance Procedures. The contractor shall provide their own personal safety locks, meeting OSHA standards, for use with the government's safe clearance procedures.

b. Government HEC procedures shall be used on equipment/systems owned by the Government. It shall also be used on all points interfacing with Government owned equipment/systems. In instances where equipment is owned by the Contractor, not yet turned over to the Government, or Equipment which is not tied into Government energy sources, the Contractor may use their own Lockout/Tagout Program. Contractor Programs shall be pre-approved by the Contracting Officer.

c. The names of Authorized Individuals shall be submitted to the Contracting Officer prior to the Pre-Construction Meeting. Project-specific training will be given by the Operations Chief or designee and will be no more than 30 minutes in length. Project-specific training will be provided only to the Contractor's Authorized Individuals. The Authorized Individuals shall be required to brief their work crews and subcontractors of any project-specific clearance information. Training is only required once per year and is, with the exception of project-specific training, valid for every facility within the Walla Walla District.

1.2.7 Safe Clearance Training. Contractor, subcontractor, vendors and visitors shall take the appropriate level of HECP training commensurate with their job duties. Contractors shall have, at a minimum, two individuals per shift trained as Authorized Individuals. All contractor personnel working in areas under a Safe Clearance shall be trained as Affected Persons. Any non-working personnel, vendors and visitors, that will be entering an area under Safe Clearance shall take awareness level training. Training and written tests for the modules below shall be completed on-line. Time estimates for training follow:

a. Awareness Level Training: Approximately 15 minutes (vendors and visitors).

b. Affected Persons: Approximately 30 minutes in addition to Awareness Level training.

c. Authorized Individuals: Approximately 1 hour in addition to Awareness Level training and Affected Personnel Training.

1.3 AT Level I awareness training All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities and controlled access areas shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within 5 calendar days after completion of training by all employees and subcontractor personnel. The contractor shall maintain a personnel sign in/out log in the Project control room lobby. The contractor and his personnel shall sign in when they come on project and when they leave the project. The Government will furnish a logbook for this purpose and it will remain the property of the Government as a permanent record. In addition, when work is to be done during non-normal work hours, the contractor will notify an operator at ext. 231 or 80-111, before entering the project and upon leaving the project.

1.31 Access and General Protection/Security Policy and Procedures All contractor and all associated sub‐contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes

1.3.2 iWATCH and/or CorpsWatch Training The contractor and all associated sub‐contractors shall brief all employees on the local iWATCH, Corps Watch, or See Something, Say Something program (training standards provided by the requiring activity ATO). This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after contract award.

1.3.3 Required OPSEC Training All new contractor employees will complete Level I OPSEC training within 30 calendar days of their reporting for duty. Additionally, all contractor employees must complete annual OPSEC awareness training."

1.3.4 Escort Requirements All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas. For the purposes of this contract, the restricted areas are the control room & the Electrical Equipment Room, El. 500. See Technical Exhibit 2.13.

1.3.5 Contractor shall obtain a Facility Clearance and individual clearance at the appropriate level The Prime Contractor Company must have (or will have) a Facility Clearance (FCL) at the appropriate level (IAW the NISPOM DOD 5220.22‐M and AR 380‐49) prior to the start of the contract awarded period of performance.

Contractor personnel performing work under this contract must have the required security clearance, per AR 380‐67, at the appropriate level at the start of the period of performance. Security Clearances and FCL requirements are required to be maintained for the life of the contract IAW the DD254 attached to the contract. If no FCL, the supporting Government Contracting Activity will sponsor the prime contract company in obtaining the FCL.

1.3.6 Pre-screen using E-Verify Program The Contractor must pre‐screen Candidates using the E‐verify Program (http://www.dhs.gov/E‐Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E‐verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

1.3.7 Elevator Control Key. Keys for elevator work access will be provided by the Government. All keys issued by the project shift operator shall be signed for by the Contractor or Contractor’s employee upon each visit. The Contractor or Contractor’s employee shall return the keys at the end of the day or upon completion of the maintenance, whichever is first. No keys issued to the Contractor or Contractor’s employees by the Government shall be duplicated. If keys are lost or duplicated by the Contractor or Contractor’s employees and, in the opinion of the Government it is necessary to replace or re-code any or all locks for reasons of security, the direct cost of such replacement or re-coding will be charged to the Contractor. The Contractor or Contractor’s employees shall report the occurrence of a lost key immediately to the COR. Use of keys by any person other than the Contractor’s employees is prohibited. The Contractor or Contractor’s employees are prohibited from opening any unauthorized areas.

1.4 Quality Assurance (QA). The Government will evaluate the Contractor’s performance under this contract for those tasks listed on the Performance Work Statement. The COR evaluators will follow the methods of surveillance specified in the Performance Requirements Summary (PRS), generally periodic inspection will be employed. The COR will record and retain all COR inspections.

1.5 Quality Control Reports. The Contractor shall submit a quality control report for each day work is performed.

The reports shall include: compliance with the maintenance/repair schedule; reasons for noncompliance with the maintenance schedule; safety problems identified; corrective actions taken to correct safety problems; elevator repairs required, but outside the regular maintenance work; parts repaired or replaced; and all maintenance/repair work performed. Quality control reports shall be provided to the COR or designated representative no later than 8:00 a.m. on the following business day that the work was performed and inspected. Forms used for quality control reports are subject to the approval of the COR. A completed checklist shall be submitted for the monthly, yearly and five-year inspections. Note that a five-year inspection is required for this contract.

1.6 Assessment Site Visit. After award is made, a site visit will be scheduled at Lower Monumental for the Contractor to verify site conditions. During the site visit the Contractor should look for deficiencies and non compliances to be noted and submitted as a maintenance report at the pre-work meeting.

1.7 Post Award

1.7.1. Submittals. The Contractor shall complete and submit to COR, the following items seven (7) days prior to the pre-work meeting:

• Certificate(s) of Insurance.

• Certificates showing the current State of Washington Elevator Journeyman License, inspection and maintenance of elevators, safety training covering Safe Work Practices, Personal Protective Equipment, Proper House Keeping and Fire Protection. (1.2.5.)

• The qualifications of the Contractor’s crew supervisor.

• The name, address and telephone number(s) (not to exceed three) where Contractor’s crew supervisor can be reached.

• A list of all employees that will be working on this contract and their vehicle identification. (1.2.7.).

•A list of any subcontractors to include names, phone numbers, and addresses of all employees who will be working for the Contractor.

• Detailed Quality Control Plan and Inspection Checklist.

• In draft form, a Maintenance and Inspection Schedule including any suggested modifications which may be in the interest of practicality, efficiency, economy or effective use of time, including any deficiencies, or items not up to code with elevators inspection schedule.

• List of any non-US citizens.

1.7.2. Pre-Work Meeting. After all post award submittals have been reviewed and approved by the Government a pre-work meeting date and time will be established. The pre-work meeting will be scheduled no later than 15 days after contract award. At this meeting, the COR will establish lines of authority and Government procedures for contractual administrative and work issues. The schedule of required submittals and reports will also be discussed. The Contractor shall submit the deficiency and noncompliance report obtained from the Assessment Site Visit (1.5) at the pre-work meeting. The Contractor will be responsible for all maintenance, replacement of parts, etc. unless noted in the deficiency report. The Government will furnish the Contractor a letter of record documenting pre-work conference discussions within one week following the meeting.

1.8. Hours of Operation. Normal workdays and business hours for the Contractor will parallel those of the Government Project, which are generally Monday through Thursday, 0630 to 1700 except Federal Holidays. This excludes work under emergency call outs. In cases of emergency call outs, the COR or the project shift operator will make arrangements for the service call and time of arrival for the Contractor.

1.9. RESOURCES

1.91. Conservation. The Contractor must ensure employees practice utility conservation. The Contractor is responsible for operating under conditions that prevent the waste of utilities to include turning off lights when not necessary for work, turning off water faucets and valves when not in use.

1.9.2. Environmental and Hazardous Materials. The Contractor must establish systems and controls to minimize use of hazardous materials and generation of hazardous wastes, maximize recycling of materials and comply with state and Federal guidelines for hazardous material and waste storage and disposal. The Contractor shall furnish the Government with copies of all Material Safety Data Sheets (MSDS) prior to using or storing such chemicals in Government facilities.

1.10. Contract Site

1.10.1. Maintenance. Contractor and the Contractor’s employees shall make no alterations to the Government property except with the written permission of the Government.

1.10.2 Servicing. It is anticipated that servicing of the elevators will take approximately 2 hours per elevator, with a total service period of approx 8 hours per visit.

1.10.3. Other Work. The Government may undertake or award contracts for other work. The Contractor shall fully cooperate with such other Contractors and Government employees and carefully fit his own work to such additional work as may be directed by the Contracting Officer. The Contractor shall not commit or permit any act which will interfere with the performance of work by any other Contractor or by Government employees.

SECTION 2 DEFINITIONS

2.1. Acceptable Quality Level (AQL). A predetermined value selected and used by the Government Quality

Assurance inspector to distinguish between satisfactory and unsatisfactory performance. For evaluation by random sampling, AQL’s are stated in percentages and have three parts: lot size, sample size and Allowable Reject Level

(ARL).

2.2. Allowable Reject Level (ARL). The allowable margin of error observed under statistically sound quality assurance surveillance.

2.3. Contracting Officer (KO). Contracting Officer is the only person with the authority to enter into, administer, and/or terminate the contract on behalf of the Government.

2.4. Contracting Officer’s Representative (COR). An individual designated in writing by the Contracting Officer Responsible for administration of the contract.

2.5. Contractor. The term Contractor refers to the prime Contractor and all contractor employees and personnel.

The prime Contractor shall be responsible for ensuring all subcontractors comply with the provisions of this contract.

2.6. Deduct Percentage. The percentage obtained when the price for providing a specific requirement for a billing cycle is diminished because the Observed Acceptance Rate (OAR) is below the Acceptable Quality Level (AQL).

2.7. Observed Acceptance Rate (OAR). The observed rate of acceptable performance based on sound quality assurance surveillance.

2.8. Performance Requirement. The point that divides acceptable and unacceptable performance of a task according to the Performance Requirement Summary (PRS) and the Inspection of Services clause. It is the number of defects or maximum percentage of defects in the lot that is acceptable.

2.9. Quality Assurance. A planned and systematic pattern of all Government actions necessary to provide confidence that adequate technical requirements are established; products and services conform to established technical requirements; and satisfactory performance is achieved. For purposes of this contract, quality assurance refers to actions by the Government assurance functions for a contracted service.

2.10. Quality Control. Those actions taken by a Contractor to control the production of outputs to ensure that they conform to the contract requirements.

SECTION 3 GOVERNMENT FURNISHED ITEMS

3.1. Utility services (electrical power, water services, and restroom facilities) required in the performance of the contract are available from Government sources within the contract areas or from other sources approved by the COR. These utilities are available as is. All extensions, adapters and other necessary items are the Contractor’s responsibility.

3.2. Drawings. Any available elevator drawings can be obtained from the COR. Applicable changes shall be noted on drawings and submitted to the COR to be maintained up-to-date. On termination or expiration of the contract all drawings shall be returned to the COR.

SECTION 4 CONTRACTOR-FURNISHED ITEMS AND SERVICES

Except for those items or services specifically stated in Section 3, the Contractor shall furnish everything necessary to perform this contract according to all its terms. Contractor parts and supplies may be stored at a location designated by the COR; however, most spare parts will be carried in Contractor service vehicles. The Contractor must provide all training to Contractor employees required by applicable safety, health or licensing requirements.

SECTION 5 PERFORMANCE WORK STATEMENT

5.1.1. Elevator Maintenance. The Contractor shall provide all elevator maintenance services for the four (4) elevators and the fire panel, noted in Section 5.1.8, unless noted and accepted in the deficiency report or the Quality Control Reports (Section 1.4). Work required by this contract shall be performed on a regularly scheduled basis but not less frequently than once every 30 days.

5.1.2. Supplies and Materials. All materials, supplies, equipment, transportation, supervision, services and any items necessary to perform routine maintenance of all the elevators listed shall be provided by the Contractor.

5.1.3. Routine Maintenance. Includes cleaning, maintenance, repair, inspection, servicing, adjustments, calibrations and inspections as listed by the ASME A 17.1, and ASME A 17.2. Except for emergency callback service, all work shall be scheduled five workdays in advance with the COR.

The names of the COR and shift operator will be provided at the pre-work meeting.

5.1.4. Non-Routine Services. Not included in routine maintenance are hoist enclosures, total replacement of hoist way control cables, door panels, car enclosures, frames, sills, car lighting lamps, hoist ropes, and complete replacement of motor assemblies unless damaged as a result of Contractor negligence. While work or replacement of these specific items is not included in the contract, the Contractor shall note and report to the COR any required repairs and/or replacements necessary along with a detailed report. The contractor shall not commence with any non-routine services prior to receiving approval from the KO. The Government reserves the right to obtain repair services for the excluded equipment appurtenances and accessories from other sources.

5.1.5. Interruption of Service. Elevator maintenance shall be scheduled and coordinated with the COR to minimize interference with plant maintenance and operation activities. Unless there is an emergency situation or an impending safety hazard for an elevator, e.g., the elevator is out of service, stuck, or experiencing a dangerous or potentially dangerous malfunction, plant maintenance and operations will take precedence over elevator maintenance.

5.1.6. Safety. The Contractor’s employees may be working in areas containing control systems vital to the operation of the project. The Contractor shall protect all existing structures, utilities and work of any kind against damage or interruption of service. To ensure the safety of Contractor employees and project personnel, the Contractor shall be trained in the Safe Clearance Program.

5.1.7. Emergency Call-Out Service. In instances where emergency service is needed, the contractor shall provide emergency call-out service 24 hours a day, 7 days per week when requested by the COR or the shift operator on duty. If the COR or shift operator receives a pre-recorded phone message, the Contractor will have one hour to respond back with a phone call. Contractor’s mechanic is required to be on-site to commence work within a maximum of 4 hours after a call for emergency services is made. If the Contractor does not arrive within 4 hours, the Government reserves the right to call an alternate contractor to provide necessary services.

5.1.8. Other Work: The Government may undertake or award contracts for other work. The Contractor shall fully cooperate with such other Contractors and Government employees and carefully fit his own work to such additional work as may be directed by the KO. The Contractor shall not commit or permit any act which will interfere with the performance of work by any other Contractor or by Government employees.

5.2. ELEVATOR MAINTENANCE

5.2.1. Maintenance Schedules. Elevator maintenance schedules shall be submitted to the COR for approval (section 1.6.1). A separate schedule shall be prepared for each non-identical elevator. All schedules shall describe periodic maintenance procedures and specify the frequency of performance. A maintenance schedule shall be posted in each elevator room. Posted schedules shall become the property of the Government and shall not be removed from elevator rooms upon completion of the contract. Coordinate schedule changes with COR and keep all schedules current.

5.2.2. Inspections. Contractor is required to comply with all applicable elevator maintenance/service State and Federal rules and regulations and maintain adequate records of this compliance. The Government reserves the right to have a third party inspect the elevators. All licenses and monthly, annual, and five-year inspections shall conform to ASME A 17.1, and ASME A 17.2. A report of the inspection results must be submitted to the COR for approval. Note that a five-year inspection is required for this contract .

5.2.3. Changes to the elevators. The Contractor shall make no changes to the existing circuits, circuitry wiring and sequencing or otherwise alter the original circuit or wiring design of the elevators. The Contractor may propose and submit any modifications or changes to the COR in a complete, neatly prepared wiring diagrams accompanied by description of the proposed change. Any proposed changes must be approved by the Contracting Officer prior to installation.

SURVEILLANCE: Surveillance will be accomplished using the following Performance Criteria Analysis. If performance in not satisfactory to the percentage listed in the AQL, the COR will notify the contractor’s site manager, with a telephone call, as soon as practicable and ask the contractor to correct the problem.

If a safety issue arises from the Contractor’s unacceptable performance, the Contractor will be given notification and 4 hours to correct the unacceptable performance. The COR may approve additional time if need. If it is not a safety issue the contractor will have three days to correct any deficiencies. The COR will notate on the Performance Criteria Analysis the date, time, and location of the deficiency and send a copy to the Contractor to sign and return to the COR within 3 businesses days

5.2.4 CONTRACTOR QUALITY ASSURANCE. The Contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract. The role of the Government is quality assurance to ensure contract standards are achieved. In this contract the quality control program is the driver for product quality. The Contractor shall develop a comprehensive program of surveillances and monitoring actions. The first major step to ensuring a “self-correcting” contract is to ensure that the quality control program approved At the beginning of the contract provides the measures needed to lead the contractor to success. Once the quality control program is approved, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.

SECTION 6 TECHNICAL EXHIBITS

6.1 MINIMIUM REQUIRED REPORTS

The Contractor must generate, complete and submit reports to the Government. The following is a list of reports, information to be furnished on each report and a time or frequency requirement for each report.

6.1.1. Maintenance Report. The Contractor shall prepare a report, which identifies each elevator, the location, maintenance work performed, repairs needed, non-compliance, development of any defects, date of inspection, name of inspector, overall condition of the elevator and any corrective actions taken should be including. This report shall be submitted within two business days of inspection.

6.1.2. Failure Report. If repairs require work considered over and above routine maintenance work, the Contractor shall notify the COR for appropriate decision and action with a detailed description of reasons for noncompliance with maintenance/repair schedule if applicable and safety problems identified and corrective actions taken. Any deviations from existing drawings shall be submitted to the KO for approval. Drawings can be requested from the COR.

6.1.3. Employee Exposure Hours. Total hours worked by Contractor employees during the month. This report must be submitted monthly.

6.1.4. Incident/Accident Report. An accident constitutes an incident or act involving the Contractor, which may or may not have caused obvious damage to persons or property. This includes injuries to Contractor employees, members of the public, or damage to Government or personal property. The Contractor shall notify the COR by telephone within 30 minutes of any incident or accident, followed by a written report. These reports shall include, but are not limited to, location, nature of the injury or accident, authorities notified and the action taken along with any other pertinent information such as who was injured and what happened. These reports shall be accompanied by sketches, graphs, drawings, and photographs, as needed, and forwarded to the COR within 1 working day following the injury or accident.

7 .0 Contract Administration

7.1 Contracting Officers Representative: At the time of award a Contract Officer Representative (COR) will be appointed in accordance with DFAR 252.201-7000. A designation letter will be forwarded to the Contractor listing the COR’s duties and responsibilities.

7.2 Invoicing: The Contractor shall submit invoices to the Government not more than monthly for the duration of the award.
