(72) hours after being contacted and require that the water and ice dispensers will be fixed or replaced within seven (7) calendar days of notification of an issue.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

PERFORMANCE WORK STATEMENT
Performance Work Statement (PWS) Ice and Water Dispensers USACE, Engineering and Support Center, Huntsville, Alabama
Revision 2, Date 08/11/2017
1. Synopsis: The Contractor shall furnish and install seven Ice and Water Dispensers to include service agreement for five years at the Engineering and Support Center, Huntsville, Alabama. The Contractor shall provide a fully functional and complete working system in compliance with activity specific requirements itemized in the PWS.
Background: CEHNC presently has the Scotsman HID312A-1 ice and water dispensers at several locations. There is also one under-the -counter unit in Suite 19. This unit has been deemed unhealthy and must be disposed of. All HID312A-1 units are operating satisfactorily and customers are satisfied with the performance. The offices have expanded into several other locations from the main building. Some of these are the sites for the new dispensers.
2. Specific work to be accomplished:
2.1 Description of work. Provide seven Ice and Water Dispensers. Each of these ice and water dispensers shall be adequately sized for a load of no less than eighty (80) people per day. In accordance with FAR 52.211-6, the Government has elected to use brand names in an effort to assist the Contractor in the bidding of this project. Any brand names specified are being used to establish a minimum quality level for various items and products. Any manufacturer or vendor whose products are equivalent to the brand names specified and meet the specification will be accepted by the Government. The Government does not intend or imply that by providing vendors’ or manufacturers’ names in the specification that subject products or items are the only items that will be acceptable to the Government. All products and items, whether named or not named, must clearly meet the salient characteristics of the specifications identified. Current use is Scotsman HID312A, counter top ice and water dispenser.

Salient characteristics are: serves 80 persons per day, nugget ice, air cooled, up to 260 lb. production/24 hrs., external water filter, antimicrobial protection, R-134a refrigerant, UL and NSF certified, powered by 115volts, Phase 1, Dimensions: Weight not to exceed 200lbs per unit. Must fit on a 22 inch deep counter, if under an overhead cabinet, not greater than 20 inches high, if no overhead cabinet, 42 inches max height and maximum width approx. 20 inches. Suite 19 has a current under the sink counter space of an existing unit, to be replaced at approximately, 34 inch height x 15 inches wide x 23 inches deep. Free standing units are expected to meet all previous requirements and dimensions to not exceed 23 inch deep, nor 20 inches wide, nor 6 feet above the existing floor.

A service agreement shall be required to be included in the RFP/RFQ response. The service agreement shall provide a maintenance response within seventy-two (72) hours after being contacted and require that the water and ice dispensers will be fixed or replaced within seven (7) calendar days of notification of an issue.
Installation shall include providing water lines from existing sink water supply lines to the dispensers. Others might only require connection to existing water supply lines for the former dispensers. Plumbing to nearest drain shall also be installed. All water supply lines shall have filtration systems with cartridge type filters; these filters shall be changed semi-annually or per manufacturers suggested O&M process (whichever is more stringent) on all dispensers and have performance capabilities of 1 micron, chlorine reduction, and scale inhibitor.

2.2 Work area shall be cleaned and brought back to prior-to-work condition at the end of each day.
3. Schedule: The Contractor shall develop, maintain, and submit for Government approval, an integral master project schedule identifying critical path events for all requirements to be performed by the Contractor in accordance with this PWS. The Contractor shall provide a final schedule to the COR, coordinated with the customer POC, no later than 5 calendar days after award. This schedule shall include delivery dates, start and finish dates for installation on each location. The work shall be completed in accordance with, and no later than, the following schedule.
Final Schedule is due at 5 calendar days after award. Products shall be delivered within 15 calendar days after award. Installation shall be complete at 30 calendar days after award.
If any of these milestones falls on a Saturday, Sunday or Federal holiday, then the date will be deemed to occur on the next working day.
4. Delivery/Installation: Delivery of products: The Contractor and/or the Contractor’s installation team shall coordinate and schedule all deliveries. The Contractor shall manage the delivery and installation services to correspond appropriately, not having more than 24 hours of time between any scheduled delivery of products and the start of installation. All unpacking and placement of product into the facility shall be performed by the Contractor and/or the Contractor’s installation team. The Contractor shall provide all necessary transportation and equipment to successfully accomplish the delivery and installation of all products in their final location within the facility.
Installation. The Contractor shall install all products at their final locations in the building(s) in accordance with the PWS requirements. Installation shall include removal from packaging, inspection, assembly of dispensers, placement of plumbing items at the correct location, and removal and disposal of all old equipment, dunnage and packaging.
5. Period of Performance: The Contractor shall develop and submit a detailed project schedule showing all milestone events required by this PWS. The schedule shall adhere to Period of Performance (POP) as awarded.
POP extension requests are not guaranteed and may require consideration from the Contractor depending upon the circumstances of the request. If a specific delivery date is required by the Government, it will be specified in the Request for Proposal (RFP). Otherwise, the Contractor shall propose a period of performance (POP) in response to the level of effort required to fulfill the requirements of the RFP. This POP may be negotiated prior to award of the contract. The government reserves the right to award a POP date beyond the contractor’s proposed date.
These days are for government close out actions and are not to be interpreted as additional time or float for the contractor to use for project completion.
6. Payments:

Accident Prevention Plan (APP) for Limited Scope. The Contractor shall be required to submit a Corporate Accident Prevention Plan to the Contracting Officer and Contracting Officer Representative within five business days after initial award of the contract. The APP shall address applicable items listed in Appendix A of the US Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1) in addition to the other applicable requirements of EM 385-1-1 and OSHA requirements. An APP is, in essence, a safety and health policy and program document. The plan shall provide enough information to be generally applicable to all of the work items listed above. The APP is a document that details how, the safety and health requirements of OSHA, other applicable regulatory codes and documents, and the U. S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, are to be accomplished. No work shall be performed until the APP has been reviewed and accepted by CEHNC.
8. Quality Control: The Contractor shall establish and maintain a complete Quality Control Plan (QCP) to verify that contract performance is achieved as specified. A copy of the plan or any updates to the plan shall be provided to the Contracting Officer within 10 business days of receipt of Notice to Proceed and any other time upon request. Personnel performing quality control functions shall be identified to the COR and given sufficient responsibility, authority, and organizational freedom to identify and evaluate quality problems, initiate, recommend, provide solutions or stop the work. The program shall include, but not be limited to, the following:
8.1 Quality Control System. A Quality Control System (QCS), covering all services performed by this contract must specify the areas to be inspected on either a scheduled or unscheduled basis and how often inspections will be conducted and documented.
8.2 Quality Assurance shall be performed by visual inspection.

10. Security: All contractor personnel shall read applicable security regulations, to be provided by the government, to familiarize them with the government’s guidance on security.
10.1 AT Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training by all employees and subcontractor personnel. 10.2 All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
10.3 The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.
10.4 All new contractor employees will complete Level I OPSEC Training within 30 calendar days of their reporting for duty. Additionally, all contractor employees must complete annual OPSEC awareness training. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training.

10.6 The Prime Contractor Company must have a Facility Clearance (FCL) at the appropriate level (IAW the NISPOM DOD 5220.22-M and AR 380-49) prior to the start of the contract awarded period of performance.
Contractor personnel performing work under this contract must have the required security clearance, per AR 380- 67, at the appropriate level at the start of the period of performance. 10.7 The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
10.8 All new contractor employees will complete annual Threat Awareness and Reporting Program (TARP) Training provided by a Counterintelligence Agent, IAW AR 381-12. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee(s) or a memorandum for the record, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training.

11. Prosecution and Completion of Work:
11.1 The Contractor shall prosecute the work under the direction of a responsible representative approved by the Government. The company officer or representative shall be designated as the Contractor’s Project Manager and shall be responsible for complete coordination of all work under this contract. All work shall be accomplished with adequate internal controls, quality assurance processes, and review procedures. These controls and procedures shall be established by the Contractor to ensure technical accuracy and eliminate conflicts, errors, and omissions. The Government may elect to provide third party technical inspection.
11.2 The contractor is required to pay wage rates in accordance with the criteria set forth below:
11.2.1 Wage Rate Requirements (Construction) (WRRC) shall be utilized for construction based labor efforts.
These activities include but are not limited to high/medium voltage wiring, excavation, trenching, removing/repairing walls, flooring, framing, foundation work, masonry, plumbing, lighting replacement, demolition (if other construction work is to follow), painting, replacement of boilers/chillers/air handling units (not including purchase of equipment), installation of new fire alarm systems, and any other work required to be performed by a construction trade.
11.2.2 Service Contract Labor Standards (SCLS) wage rates shall be utilized for non-professional service-based labor efforts if the work is predominantly services. Service activities include but are not limited to the design, project oversight, commissioning, engineering, meter installation, programming, test and balancing, survey, low voltage wiring not requiring an electrician, control system components (motors, actuators, sensors, controls, etc.), repairs to fire alarm systems/chillers/boilers/air handling units, repair/replacement to other ancillary equipment, installation/repair of electronic security systems, and any other work of a services nature that is not required to be performed by a construction trade.
12.3.3 SCLS/WWRC Wage Rate Applicability by Location: WWRC wage rates are only applicable within the United States.
