INSTRUCTIONS

INSTRUCTIONS TO OFFERORS

1. The solicitation is “100% small business set-aside”. All work shall be in accordance with the Scope of Work (SOW), attachments, and all other terms and conditions herein.

3. PROSPECTIVE OFFERORS: Contractors shall be registered in the System for Awards Management (SAM) prior to award of a contract or agreement resulting from solicitations.

“Registered in the System for Award Management (SAM) database” means that –

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certification, and Points of contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process.

(4) The Government has marked the record “Active”.

This rule more efficiently implements the Debt Collection Improvement Act of 1996, as it requires contractors to be registered in SAM for consideration of future solicitations, awards, and payment. Registration is required prior to award of any contract, basic agreement, basic ordering agreement, or blanket purchase agreement from a solicitation. LACK OF REGISTRATION IN THE SAM DATABASE WILL MAKE AN OFFER INELIGIBLE FOR AWARD. The web site may be accessed at www.sam.gov.

SAM Priority Processing Request: The notarized letter must have both the vendor signature page AND the notary signature page signed. If missing a signature (or other required data) GSA will reject the letter. This will cause the review and activation of the account will be delayed further. Any prioritization requests received on Friday are subject to delays because of the weekend. For a request you send on Friday afternoon, you may not receive your response until Monday morning.

Albeni Falls Dam (AFD) Spillway Roller Chain

PART 1 GENERAL

1.1 DESCRIPTION

The U.S. Army Corps of Engineers requires two (2) complete roller chains for one (1) Spillway Gate lower leaf, to be delivered to Albeni Falls Dam in Oldtown, Idaho.

The contractor shall supply and deliver individual roller chain components consisting of the following:

72 (ea) Rollers

72 (ea) Roller Shafts

480 (ea) Side Bars – Short

100 (ea) Retaining Rings

Dimensions and tolerances of each component, along with material types are listed in the contract drawing titled “Roller Chain Components Assembly and Parts Details”.

1.2 REFERENCES

1.3 SUBMITTALS

The submittals shall be submitted in two packages:

(1) Prefabrication - SD-02 Shop Drawings, SD-03 Product Data, and SD-07 Material certifications

(2) Post-fabrication - SD-06 Test Reports, SD-07 Independent lab test certification

SD-02 Shop Drawings Shop Fabrication Drawings;

Contractor shall submit detail shop fabrication drawings for metalwork and machine work, prior to fabrication.

Elements of fabricated items inadvertently omitted on contract drawings shall be detailed by the Contractor and indicated on the detailed drawings.

SD-03 Product Data Shop Fabricated Metal Items;

Lists of materials, and records which identify the disposition of approved certified material for each fabricated item shall be submitted for approval and approved prior to fabrication of the components.

Heat Treatment Procedure Procedure shall identify heat treatment process and applicable standards. Submit prior to fabrication of rollers.

Cleaning and Passivation Plan Procedure shall identify the process and applicable standards. Submit prior to fabrication of corrosion-resistant parts

SD-04 Samples Roller chain components;

The Contractor shall furnish a sample consisting of two rollers, two roller shafts, four retaining rings, two side bars-short, and two side bars-long to the Government for approval prior to the fabrication of the remaining components.

The sample shall be submitted with documentation required in SD-06 Test Reports and SD-07 Certificates. The sample shall conform to the specifications of the contract drawing titled “Roller Chain Components Assembly and Parts Details” and be shipped to Albeni Falls Dam. The sample will not be returned.

SD-06 Test Reports Shop Fabricated Metal Items;

Materials tests reports and analysis shall be submitted for approval prior to shipment of items.

Quality Control Reports Reports form Contractor's quality control system. Shall be submitted prior to shipment of items.

SD-07 Certificates Material Certifications Certifications from mill shall be submitted for all chain component materials prior to commencing fabrication.

Independent Lab Test Certification Test report from independent testing laboratory.

PART 2 PRODUCTS

2.1 MISCELLANEOUS METALS AND STANDARD METAL ARTICLES

Miscellaneous shop fabricated metal items shall conform to the respective specifications and other designated requirements. Sizes shall be as specified or shown. Where material requirements are not specified, materials furnished shall be suitable for the intended use and shall be subject to approval. The Contractor shall prepare and submit for approval shop fabrication drawings for all chain components prior to the start of work. All stainless steel components shall be pacified after final heat treatment and machining in accordance with ASTM A 380.

2.2 HEAT TREATMENT PROCEDURE

The procedure shall identify heat treatment process when applicable for item and applicable standards. The procedure shall be submitted prior to fabrication of components.

2.3 CERTIFICATIONS

Where material is specified, the Contractor shall submit mill material certifications report for raw materials.

2.4 ROLLER CHAIN COMPONENTS AND QUANTITIES

With the exception of the retaining rings, all roller chain components shall be fabricated by one manufacturer. All components shall have "pacified" treatment after final machining and heat process in accordance with ASTM A 380.

2.4.1 Rollers: Quantity (72)

Rollers shall be ASTM A 564/A 564M, UNS S17400 Type 630 or S45000 Type XM-25, age-hardened heat treated to obtain a Brinell hardness range of 331 minimum to 401 maximum. Heat treatment of rollers shall not commence until the heat treatment procedure is submitted. Roller outer surface shall be cold-finished per ASTM A 484/A 484M, Class C or hot-rolled and machine-finished to meet tolerances specified. Roller inner hole shall be bored and reamed to meet 63 micro-inch finish requirements.

2.4.2 Roller Shafts: Quantity (72)

Roller shafts shall be "Nitronic 60" or ASTM A 276, UNS S21800, Condition A, minimum Brinell hardness 205, with 63 micro-inch cold ground finished. Retaining ring groove shall be machined per manufacture's dimensions and tolerances.

2.4.3 Side Bars - Short: Quantity (480)

Shall be ASTM A 276, UNS S30400 Condition A, cold-finished per ASTM A 484/A 484M, Class C or hot rolled and machine-finish to meet tolerances specified.

2.4.4 Retaining Rings: Quantity (100)

Retaining rings for roller shafts and links shall be corrosion-resistant stainless steel ASTM A 693- 03, S15700 Condition RH950, conforming to ASME B18.27 external series type with nominal shaft size as shown on the contract drawings. Retaining rings shall be provided from a manufacturer that has least 5 years of experience in the fabrication of industrial retaining rings.

PART 3 EXECUTION

3.1 FABRICATION AND WORKMANSHIP

Workmanship shall be of the highest grade and in accordance with the best modern practices to conform with the specifications for the item of work being furnished.

Stainless steel may be cut by mechanically guided or hand-guided torches provided an accurate profile with a surface that is smooth and free from cracks and notches is obtained. Chip, grind, or machine to sound metal all hand-guided or mechanically guided cuts. For all edges, grind to remove slag and sharp edges, and provide a radius of approximately 1/16-inch minimum.

Accurately machine parts and make all like parts interchangeable. Accurately locate all drilled bolt holes to ensure interchangeability.

3.1.1 Machine Work

Tolerances, allowances and gauges for metal fits between plain, non-threaded, cylindrical parts shall conform to ASME B4.1 for the class of fit shown or required unless otherwise shown on approved detail drawings.

Where fits are not shown they shall be suitable as approved. Tolerances for machine-finished surfaces designated by non-decimal dimensions shall be within 1/64 inch. Sufficient machining stock shall be allowed on placing pads to ensure true surfaces of solid material. Finished contact or bearing surfaces shall be true and exact to secure full contact. Journal surfaces shall be polished and all surfaces shall be finished with sufficient smoothness and accuracy to ensure proper operation when assembled.

3.1.1.1 Finished Surfaces

Surface finishes indicated or specified shall be in accordance with ASME B46.1. Values of required roughness heights are arithmetical average deviations expressed in micro-inches. These values are maximum. Lesser degrees will be satisfactory unless otherwise indicated. Compliance with surface requirements shall be determined by sense of feel and visual inspection of the work compared to Roughness Comparison Specimens in accordance with the provisions of ASME B46.1. Values of roughness width and waviness height shall be consistent with the general type of finish specified by roughness height. Where the finish is not indicated or specified it shall be that which is most suitable for the particular surface, provide the class of fit required and be indicated on the detail drawings by a symbol which conforms to ASME B46.1 when machine finishing is provided. Flaws such as scratches, ridges, holes, peaks, cracks or checks which will make the part unsuitable for the intended use will be cause for rejection.

3.1.2 Cleaning and Passivation of Corrosion-Resisting Steel

Clean and passivate each piece of corrosion-resisting steel part in accordance with ASTM A380. Oil, paint and other foreign substances shall be removed from corrosion-resisting steel surfaces after fabrication. Cleaning shall be done by vapor degreasing or by the use of cleaners of the alkaline, emulsion or solvent type. After the surfaces have been cleaned they shall be given a final rinsing with clean water followed by a 24 hour period during which the surfaces are intermittently wet with clean water and then allowed to dry for the purpose of inspecting the clean surfaces. The surfaces shall be visually inspected for evidence of paint, oil, grease, welding slag, heat treatment scale, iron rust or other forms of contamination. If evidence of foreign substance exist the surface shall be cleaned in accordance with the applicable provisions of ASTM A 380. The proposed method of cleaning and passivation shall be furnished for approval. After treatment the surfaces shall be visually reinspected. Brushes used to remove foreign substances shall have only stainless steel or nonmetallic bristles. Any contamination occurring subsequent to the initial cleaning shall be removed by one or more of the methods indicated above.

3.2 QUALITY CONTROL SYSTEM

The Contractor/manufacturer shall utilize a quality control system to insure all supplied components meet all specifications and requirements. The Contractor shall submit Quality Control Reports for Government approval prior to shipment of components.

3.3 TESTING AND TEST REPORTS

The Contractor shall be responsible for all labor, materials, and costs associated with testing. A sample of three (3) percent of all machined components shall be randomly selected from each lot for examination and testing by an independent certified testing laboratory. An independent lab test certification report shall identify component tested, specification, measured property, pass/fail, name of laboratory, equipment used, and submitted for review. Failure of a sample component will result in the rejection of that entire lot. Errors or defects disclosed shall be remedied by the Contractor at no additional cost to the Government and the batch shall be retested. The Contractor shall be responsible for cost of retesting. The following tests shall be performed on each sample.

3.3.1 Crack Test

Items shall be free of cracks as determined by dye penetrant inspection tests.

3.3.2 Hardness Tests

Each sample shall be tested for Brinell hardness and compared to applicable standard.

3.3.3 Surface Roughness Test

Contractor shall test surface requirements by comparing sample to roughness comparison specimen as per ASME B46.1.

3.3.4 Dimensional Tolerance

Dimensional tolerances shall be compared to components specified requirements.

3.4 SHIPMENT AND STORAGE MACHINED COMPONENTS

Machined surfaces shall be thoroughly cleaned of foreign matter. All finished surfaces shall be protected by suitable means. Assembled and unassembled components shall be oiled and wrapped in moisture resistant packaging or protected by other approved means. All components manufactured shall be packaged shipped in pallet crates suitable for forklift warehouse storage.

PART 4 WARRANTY

All components shall be covered by a 1 year manufacturer’s warranty on all parts, labor and workmanship.

PART 5 DELIVERY

5.1 Schedule

All deliveries must take place during AFD business hours of Monday through Thursday 7:00am ‐ 4:00pm, excluding Federal holidays.

52.204-17 OWNERSHIP OR CONTROL OF OFFEROR (AUG 2020)

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

52.204-20 Predecessor of Offeror (AUG 2020)

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (OCT

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(c) Representations.

52.209-2 PROHIBITION ON CONTRACTING WITH INVERTED DOMESTIC CORPORATIONS--

REPRESENTATION (NOV 2015)

(a) Definitions. Inverted domestic corporation and subsidiary have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations (52.209-10).

(b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-2(b) applies or the requirement is waived in accordance with the procedures at 9.108-4.

(c) Representation. The Offeror represents that--

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(Contracting Officer shall insert the significant evaluation factors, such as (i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) past performance (see FAR 15.304); and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.)

Technical and past performance, when combined, are . (Contracting Officer state, in accordance with FAR 15.304, the relative importance of all other evaluation factors, when combined, when compared to price.)

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (FEB 2021)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision --

“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Reasonable inquiry” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

"Small business concern"--

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.

The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

“Veteran-owned small business concern” means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
