Contracting Officer Determination Soliciting from a Single Source
1. CONTRACTING AGENCY: US Army Corps of Engineers, Seattle District
2. DESCRIPTION OF ACTION: Approval is requested for Other Than Full and Open Competition for procuring Brand Name products and services. The Libby Powerhouse SCC Replacement project includes upgrades to the current digital governor network to include all generating unit control functionality previously available in the SCC. The Advantec parts listed below are critical components which will serve as modifications to the existing digital governor system to replace the SCC. The American Governor Services listed below are critical to making those modifications to an existing sytem using the same vendor that installed that system initially.
3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:
The portion of the acquisition requiring brand-name products applies to the Advantec Governor HMI equipment. The Advantec Governor HMI equipment includes the HMI TouchScreen Display, mounting hardware, the HMI Controller with Operating and HMI Application Software, and supporting hardware. The Advantech Governor HMI equipment are required components for completion of the SCC Replacement project at Libby Dam and have a total estimated price of $25,000.
The portion of the acquisition requiring brand name services applies to re-programing and integration of the modifications to the governor control network by American Governor. The American Governor programming and integration services required for the completion of the SCC replacement at Libby Dam have a total estimated price of $53,000.

4. AUTHORITY CITED:
10 U.S.C. 2304(c)(1) Contract Competition Requirements
FAR 13.106-1(b)(1)(i) Soliciting from a Single Source for purchases not exceeding the simplified acquisition threshold.
5. REASON FOR AUTHORITY CITED: Pursuant to FAR 13.106-1(b)(1)(i) “Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name or industrial mobilization.)”
Existing Conditions: Currently at Libby, all five generators have digital governors furnished, programmed, and commissioned by American Governor. American Governor uses Advantech components for their HMI equipment.
Operations: The existing governor HMI screens installed at the actuator cabinets are Advantech brand, and the software has already been developed using Advantech Web Studio, therefore the new HMI for the control room is required to to be Advantech too in order to match and have consistent software. American Governor developed the software and is intimately familiar with it, and therefore is ideally suited to make updates and provide commissioning services. Since the HMI’s will have to interface to the existing governor PLC’s and net, having American Governor furnish the HMI components as well as program them, the risk of improper or imcompatible hardware or software is significantly reduced. Installing non-Advantech or non-American Governor equipment would add complexity, and added complexity correlates directly with increased risk.
Maintenance: With the digital governors throughout Libby and the other Corps’ powerhouses in the northwest being Advantech and American Governor, maintenance practices have become more efficient due to redundancy. Libby personnel are already trained on Advantech and American Governor components. The proposed Advantech devices and software have similar maintenance requirements as existing Governor equipment and would require less time to institute and maintain.
