Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Statement of Work
LWSC Visitor Center Elevator Control System and Drive System Replacement
Part 1
General Information
1. GENERAL: This is a construction contract to supply and install a new control system to the visitor center elevator at Lake Washington Ship Canal (LWSC). The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the installation of a new control system as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
CLIN 1 Replace and modernize elevator control system
CLIN 2 Replace and modernize elevator drive system
1.2 Background: The Lake Washington Ship Canal visitor center was updated in the late 1970’s and has been in regular operation since that time. The elevator is encountering operating problems. One symptom is non-responsive control. Another symptom is elevator cab will stop between floors. Another symptom is elevator suffers from sudden acceleration when moving. Elevator has been serviced annually. Original manufacturer is US Elevator Corps. Elevator type is hydraulic elevator.
1.3 Objectives:
Remove the old elevator control system Install new elevator control system Provide new Operations and Maintenance manuals Provide final as-built drawings, system settings, and all final mechanical and electrical diagrams Test elevator to ensure safe operations Ensure new elevator control system can pass Washington state inspection Ensure elevator has updated safety and control system Fix sudden acceleration problem Fix elevator cab stop at different level with the building floor Emergency phone in elevator cab must be operational when installation is complete
1.4 Scope: The contractor shall provide all equipment and expertise necessary to perform the work in this document.
1.5 Period of Performance: The period of performance shall be for six (6) months; allows for an eight – sixteen weeks lead time for supplies, parts and materials. Elevator must be operational by October 31, 2017.
1.6 General Information
1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which they assure that work complies with the requirement of the contract. Quality Control Program (QCP) is to be delivered within 30 days after contract award, three copies of a comprehensive written QCP shall be submitted to the KO and QAR within 5 (five) working days when changes are made thereafter. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to their QC system.
1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.3 Recognized Holidays: Contractor is not required to perform services on holidays.

1.6.4 Hours of Operation: The contractor is responsible for coordinating hours for conducting business with LWSC. LWSC maintenance staff hours are generally available between the hours of 06:00 and 15:00, Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.6.5 Place of Performance: The work to be performed under this contract will be performed at LWSC Hiram M.
Chittenden Locks, 3015 NW 54th St., Seattle, WA 98107.
Site visit to be conducted at the Hiram M. Chittenden Locks located at 3015 NW 54th Street, Seattle, Washington;
Refer to section 5.3 for date and time.
1.6.6 Type of Contract: The government will award a Firm Fixed Contract.
1.6.7 Security Requirements:
All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy.
In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as
NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.
The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative.
This Form will be provided to the Contracting Officer and shall become part of the official contract file
1.6.7.1 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.
1.6.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Quality Assurance Representative (QAR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced.
Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.9 Quality Assurance Representative (QAR): The QAR monitors all technical aspects of the contract and assists in contract administration. The QAR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies: coordinate availability of government furnished party, and provide site entry of Contractor personnel.
The QAR is not authorized to change any of the terms and conditions of the resulting order.
1.6.10 Key Personnel: The following personnel are considered key personnel by the government: Contract Manager/Alternate Contract Manager. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 7:00 a.m. to 3:00p.m., Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons. Qualifications for all key personnel are listed below:
1.6.11 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are
Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.
1.6.12 Data Rights: If the elevator control system requires software for operation, then the government will get two copies of the software and associated relevant data.
PART 2
DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1. DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government party.
2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.10. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.11. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.
2.1.12. WORK WEEK. Monday through Friday, unless specified otherwise.

GOVERNMENT FURNISHED PRTY, EQUIPMENT, AND SERVICES
3. GOVERNMENT FURNISHED ITEMS AND SERVICES:
3.1. Services: The Government will not provide any services under this contract, except forklift operator for unloading, loading, and moving equipment and materials as needed.
3.2 Facilities: The Government will provide loading and unloading area along with short term storage area for supplies and aerial platform at LWSC. Aerial platform can be stored two days prior to commencement of work and two days after completion.
3.3 Utilities: All utilities in the facility will be available for the contractor’s use in performance of tasks outlined in this PWS. If utilities are needed, the following is required: The Contractor shall instruct employees in utilities requirement and conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount..
3.4 Equipment: The Government will provide a forklift and operator for unloading and moving equipment and materials, if needed during staging and de-mobilization.
3.5 Materials: The Government will not provide any new material(s) for this contract.

CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1 General: The Contractor shall furnish all supplies, equipment, materials, facilities and services required to perform work under this contract that are not listed under Section 3 of this document. Manufactures warranty for hydraulic and contractor warranty of installation.

5. Specific Tasks:
5.1. Basic Services. Visitor Center elevator control system and drive system needs to be modernized. The contractor shall provide parts and services for complete installation of a new elevator control system, drive system, and related components. The contractor will removed and dispose of the old components, and install the new components. Installation is complete when the system is operational, tested, and ready for use with the general public. The contractor shall provide all equipment and expertise necessary to perform the work in the PWS. Note contractor is required to come on site and inspect the existing system physically, and to take all necessary measurements prior to bidding. New control system shall be microprocessor controlled and completed work must meet Washington state laws and regulations. System interface inside the elevator cab and landing controls shall comply with Americans with Disability Act.

Additional Specifications and Requirements:
PART 1: GENERAL
1.1 WORK INCLUDED
Section specifies the requirements for upgrading one existing passenger elevator at Lake Washington Ship Canal.
Install a new elevator control system and equipment to replace the old system and equipment. Existing features to be replaced include, but are not limited to: the hydraulic motor; the hydraulic gear box; elevator brakes; wedge sockets and shackle rods; elevator can door and actuators; brakes; speed governor; elevator car and counterweight guide rail rollers; elevator car safeties; elevator car door reversing edges; oil buffers for the elevator car and counterweights; and elevator electrical systems and wiring including all traveling elevator car power and communications cabling, disconnect switches, motor feeders, emergency power connection, and all associated controls including controller cabinets. Check support beams and car & counterweight guiderail and guiderail brackets, and car platform & sling, for structural adequacy and replaced with new assemblies if found to be structurally deficient. If guiderails reused, reattach existing guiderail brackets with new anchors bolts as specified herein. Also provide the elevator car with new operating controls, communications devices, and provide new hall call stations at each floor landing.
1.2 APPLICABLE CODES AND DESIGN CRITERIA
Design and fabrication of elevator improvements must be in compliance with all requirements for electric traction elevators as listed in ASME A17.1/CSA B44, Safety Code for Elevators and Escalators. Note that, for convenience, specific references are made in this specification to sections contained within ASME A17.1/CSA B44 for several elevator features. This does not exempt the Contractor from full compliance with all applicable provisions of ASME A17.1/CSA B44 where specific references are not listed for certain features. Elevator installations must also be in compliance with Chapter 296-96 of the State of Washington Administrative Codes (WAC) for elevators. Also comply with the International Building Code (IBC) for features such as fire ratings on elevator doors and door frames and with the ADA/ABA Accessibility Guidelines (New ADAAG) for accessibility and usability for physically disabled individuals. Dates of applicable codes are listed below in the references. When complete, elevator car shall have the capacity to lift a live load, exclusive of the car and cable, etc., over the specified travel distance and at the specified travel speed.

1.4 DEFINITIONS
1.4.1 Terminology
Terms used are defined in the Safety Code for Elevators and Escalators, ASME A17.1/CSA B44, which hereinafter includes any reference to the “Governing Code.”
1.4.2 Application of References to an Equipment Item
Reference to a device or a part of the equipment applies to the number of devices or parts required to complete the work.
1.5 SUBMITTALS
The Contractor shall furnish project timeline.
1.6 LONG LEAD TIME EQUIPMENT
Within 30 calendar days following receipt of Notice to Proceed, submit data for elevator equipment that requires long lead-times for ordering. Long lead-time is defined as requiring over 4 weeks from date of ordering to receipt of shipment at the job site. Long lead-time equipment may include, but is not limited to, elevator hydraulic equipment, solid state motor controller, custom elevator car operating panel, and custom hall call stations.
1.7 CERTIFICATIONS AND CONTRACTOR QUALIFICATIONS
1.7.1 Manufacturer Certification
Submit proof in the form of a certificate that the elevator installer is approved by the manufacturer of the elevator system to install the system as specified herein. Provide a certificate directly from the elevator manufacturer complete with the name and a contact phone number of the company representative who prepared the certificate.
1.7.2 Installer Qualifications
Submit proof that the elevator installer has at least five years of experience installing, supervising, and testing elevators of the type and rating specified. Provide licensed elevator mechanics on staff and have at least one licensed elevator mechanic on site at all times work is taking place on the elevator installations. Submit Proof of Current and Valid Elevator Installer License (Washington). Elevator mechanics shall hold either an Elevator Journeyman, an Elevator Mechanics License issued by the State of Washington as outlined in WAC 296-96-00906 and WAC 296-96-00910 or equivalent. Licenses from Washington shall be valid and current. Submit proof of current elevator licenses as part of the installer qualifications. Provide the names of at least three different jobs completed in the last five years that are of a similar type and scope to the specified work. On the list of former jobs, include the names, addresses and contact phone numbers for each client who received the services.
1.7.4 Elevator Mechanic
Work specified in this section shall be performed in compliance with ASME A17.3 under the direct guidance of the Elevator Mechanic who is regularly engaged in the installation and maintenance of the type and complexity of elevator system specified in the contract documents, and who served in a similar capacity for at least three systems that have performed in the manner intended for a period of not less than 24 months. Elevator system manufacturer shall provide a letter of endorsement certifying that the Elevator Mechanic is acceptable to manufacturer. The Elevator Mechanic shall oversee the acceptance inspections and tests, and sign and certify the successful results, and after completion of the acceptance inspections and tests, certify in writing that the installation is in accordance with the contract requirements. Bring any discrepancies to the attention of the Contracting Officer in writing, no later than three working days after the discrepancy is discovered.
1.7.5 Product Data Requirements
Provide Elevator and Accessory product data. Include information on motor, hall station, and buffer on elevators and accessories. For Elevator supporting systems, include information on Car Operating Panels, Signal Fixtures and Emergency Lighting and emergency power systems, and , provide document identification number or bulletin number, published or copyrighted prior to the date of contract bid opening.
1.8 SHOP DRAWINGS
a. Submit Elevator Shop Drawings for review. On the shop drawings, include dimensioned layouts, in plan, elevation, and section, showing the arrangement of new equipment required to be installed in the elevator machine rooms. Show anchorage of new equipment and critical dimensions for code-required clearances for maintenance and operation of the equipment. Provide details on elevator doors modifications, hall call stations, controllers, motors, and points of interface with the fire alarm smoke detection system and HVAC or exhaust systems. Also provide new elevator car interiors on the shop drawings and include wall elevations showing finishes and handrails, location of car operating panels, in-car position indicators, and car riding lanterns. Show any revised building electrical systems required to make the supplied elevator system function as specified.
b. For electrical equipment, provide shop drawings from the equipment manufacturers or shop drawings produced by the Contractor for the electrical equipment. Include the following information on electrical equipment shop drawings:
(1) Schematic diagrams showing all control components, devices and equipment with necessary wire connections with wire numbers for a fully functional control system and shall demonstrate sequence of operation and function of system devices.
(2) Wiring diagrams showing physical arrangement of all components, devices and equipment within cabinets and enclosures with terminals and wire routing to connect a fully functional control system.
(3) Connection diagrams showing all control cabinets, enclosures, boxes and external devices with terminals and the necessary wires with numbering to connect a fully functional control system.
(4) Appropriate sizing of electrical protective devices.
1.9 FIRE PROTECTION SYSTEM
Comply with International Building Code (IBC), NFPA 70, and all additional requirements identified herein
1.10 INDEPENDENT ELEVATOR INSPECTOR
Modified elevator and all tests shall be certified by an independent consultant that all Work is in accordance with procedure described in ASME A17.2 and ASME QEI-1. The Independent Elevator Inspector shall be licensed by the State of Washington to perform elevator inspections. The Elevator Inspector shall inspect the installation of the elevator to ensure that the installation conforms with contract and State of Washington requirements. The Elevator Inspector shall be directly employed by the Prime Contractor and be independent of the Elevator System Manufacturer and the Elevator Mechanic and shall witness the acceptance inspections and tests, approve all results and shall sign and certify the successful results. The Elevator Inspector, after completion of the acceptance inspections and tests, shall certify in writing that the installation is in accordance with the contract requirements, including Washington State laws (RCW) and administrative rules (WAC). Elevator certification and permitting shall be obtained by the Contractor. The inspector shall witness the acceptance inspections and tests, shall approve all results and shall sign and certify the successful results.
