INSTRUCTIONS TO OFFERORS

This is a RFQ (Request for Quote) for a Firm Fixed Price award, and the award will be evaluated as a LPTA (Lowest Price Technically Acceptable). The preferred method of submission of quotes is via e‐mail to Eric.L.Taylor@usace.army.mil. Quotes may also be submitted via mail to U.S. Army Corps of Engineers, Contracting Division, Simplified Acquisition Team, ATTN: Eric L. Taylor, 10 South Howard Street, 7th floor, Room 7000, Baltimore, MD 21201‐2530. Questions concerning this solicitation must be submitted by email to both Eric.L.Taylor@usace.army.mil and Patricia.L.Morrow@usace.army.mil. Please confirm receipt of quote.

Quotes shall incorporate the following requirements:

1. Cover letter on offeror’s letterhead, summarizing the pricing total and signed by the representative managing the account. Include the offeror’s CAGE Code, TAX ID #, and DUNS #.

2. Quote shall include Bid Schedule, using the Government provided template, and Past Performance Questionnaires. The Bid schedule can be found directly after these instructions, and the Questionnaires can be found after the Statement of Work.

3. Quotes shall also include:

a) Manufacturer’s product Information for all materials to be installed, with manufacture’s name, address and any logo redacted.

b) A copy of the proposed warranty details with manufacture’s name, address and any logo redacted.

c) Time and date of site visit attended, if applicable.

4. Please mark the Quotes with the Project Name, bidder name, and date of submission. Late Quotes shall not be accepted. Solicitation or inquiries to end users or other personnel regarding this project are not permitted. SITE VISIT

PAST PERFORMANCE QUESTIONAIRE

PAST PEFORMANCE SUBMISSION: (See Attached Past Performance Questionnaire)

Submission Requirements: Past performance refers to the quality of recent project experience from the customer’s perspective. The Offeror shall arrange for the reference customer point of contact for two projects to fill out the Questionnaire and return directly to Eric Taylor, Contract Specialist, e-mail at Eric.L.Taylor@usace.army.mil. The questionnaires must be forwarded directly by the references.

The Government will not release the questionnaire forms to the Offeror at any time, in order for the Government to solicit candid, unbiased responses and comments. Two References from previously completed jobs must be submitted and include a point of contact and phone numbers. These references must be relevant to the work which will be performed in this contract. Relevant work is defined as appraisal services. References must be recent within the past 3 years.

The Government will assess the degree of success of Offeror’s recent, relevant past performance.

Owners/references will be asked to comment on items such as quality of service, timeliness, management of subcontractor work, including timely payment to subs or suppliers, safety, relations between customer and contractor, level of support for such things as correcting errors. Any offeror who has demonstrated satisfactory past performance will be considered eligible for award. Any offeror who demonstrated unsatisfactory past performance will not be considered eligible for award. If the Government does not obtain past performance information for the projects identified by the offeror and cannot establish a past performance record for the offeror through other sources, or if the offeror has no past performance record and cannot tie significant, relevant experience of key personnel proposed for this project to cited experience, past performance will be evaluated neither favorably nor unfavorably.

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.

Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.

There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

STATEMENT OF WORK

19 August 2016

SCOPE OF WORK

The Raystown Lake Project, Baltimore District, U. S. Army Corps of Engineers will contract the renovation and insulation of the exterior of the block Maintenance Building at the Raystown Lake Project Located in Hesston PA as identified in the specifications and Drawings Provided.

Raystown Lake is located in Huntingdon and Bedford counties in South Central Pennsylvania, approximately 95 miles west of Harrisburg and 175 miles east of Pittsburgh. It is approximately 70 miles from the Pennsylvania - Maryland border. The dam site is on the Raystown Branch of the Juniata River with the main access to the project via Rt. 26 from Rt. 22 to the North and the Pennsylvania Turnpike to the South.

All activities described in the Scope of Work will occur within the Seven Points Recreation Area.

1. GENERAL

The contractor shall provide all necessary supervision, labor, personnel, materials, supplies, products, parts, tools, equipment, vehicles, and transportation required to complete the following actions related to the items listed below:

1.2. DEMOLITION in accordance with drawing D1, D2 and A1

1. Remove corner bollards for siding installation, dispose of same.

2. Remove roof ventilators for roofing installation. Reinstall after roofing and trim work is complete.

3. Remove antenna for roofing and siding installation. Dispose of same.

4. Remove and replace all gutters and downspouts.

5. Remove old metal drain section and replace with schedule 40 PVC pipe.

6. Disconnect electrical lines, conduit, vacuum and refrigerant lines and reconnect upon completion of siding install.

7. Remove window and prep opening to receive new window.

8. Remove light fixture and reinstall after siding is complete.

9. Remove Door/Frame and prep opening for new door/frame.

10. Remove all metal roofing and inspect sub-framing prior to new metal roofing installation.

11. Remove all metal siding and inspect sub-framing prior to new metal siding installation.

12. Remove all soffit and fascia trim, inspect sub-framing prior to new metal siding installation.

13. Remove sign and reinstall upon completion of new siding.

14. Remove louvered vent and replace with new.

15. Remove all wood trim around window.

16. Break concrete sill back flush to wall. Remove and dispose of all demolition and construction debris.

1.3. CONSTRUCTION in accordance with drawing D1, D2 and A1

1. New 29 gauge metal roofing on entire building. Color to match auxiliary building. Roof is Dark Brown

2. New 29 gauge metal siding on all exterior walls. Color to match auxiliary building. Siding is tan.

3. New hollow metal door, frame and hardware.

4. New window (Fixed w/ insulated glass, aluminum clad interior and exterior)

5. New seamless aluminum gutters and downspouts on entire building.

6. Owner to provide electrical to new light. Contractor to install light provided by owner.

7. Install new metal soffit, Fascia and all required trim details on entire building. Colors to match auxiliary building. Dark Brown

1.4 SUBMITTALS AND PROPRIETARY ITEMS

All material listed in the specifications Government must have final approval of before actual work begins. All other products and materials necessary must meet or exceed contract specifications.

1.5. SITE MAINTENANCE AND PUBLIC SAFETY:

The Contractor shall maintain each work site in a safe, clean and neat condition satisfactory to the Contracting Officer’s Representative or designee at all times. In addition, the Contractor at all times shall restrict access to each working site to contract and government personnel equipped with proper personal protective equipment. At no time shall the site or surrounding conditions pose a safety risk to members of the general public.

1.6. STORAGE OF EQUIPMENT:

Contractor equipment and supplies will not be stored on Government land or in Government facilities except in those locations indicated in the contract or at such locations as approved by the Operations Manager, Raystown Lake. The Contractor shall be permitted space near the maintenance area for both an office trailer and tool trailer if desired. Contractor shall make arrangements and provide utilities used for these trailers at their expense. Utilities shall be removed by the contractor at the end of the contract period.

1.7. Rules and Regulations:

The contractor and employees will comply with all rules and regulations governing public use of water resources development projects as set forth in Title 36, CFR, Chapter III, Part 327 and all laws of the Commonwealth of Pennsylvania and the United States as they apply to the Raystown Lake Project, and obey all posted signs. Copies of Title 36 will be available from the Manager.

2. CONTRACTOR REQUIREMENTS AND RESPONSIBILITIES

2.1. The Contractor shall furnish all personnel, vehicles, equipment, materials, supplies and products sufficient to fulfill the contract as described within the scope of work and drawings provided. All equipment placed in service under this Contract shall be equipped with safety features meeting OSHA and Corps of Engineers criteria, including back-up alarm and roll-over protection system (if required).

2.2. The Contractor will be required to attend a pre-work conference prior to beginning work. The pre-work conference will be conducted at the Raystown Lake Offices. The Contractor will bring, to the pre-work conference, the following items:

2.3. The Contractor shall, at his/her expense, obtain any licenses or permits required to perform the contract. The government is not aware of any permits/licenses needed at this time.

2.4. The Contractors’ operation/employees shall be subject to all public laws concerning pollution and safety.

2.5. Costs incurred due to damage(s) to any government facility caused by the Contractor and/or his employees will be the responsibility of the Contractor.

2.6. The CONTRACTOR will remove from the work site any employee who, in the opinion of the Contracting Officer, is objectionable or incompetent. This requirement shall not be the basis of any claim for compensation or damages against the United States or any of its officers or agents.

2.7. All work shall be performed in an orderly manner as directed by the authorized representative of the Contracting Officer. It shall be at the option of the Government to have the contractor correct defective services in a timely, efficient, and workmanlike manner without additional cost to the government. If the contractor fails to correct deficient work in the allotted time frame, the Government reserves the right to withhold funds.

3. CONTRACTOR SAFETY

3.1. General: The U. S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, and all subsequent revisions referred to in the Contract Clause ACCIDENT PREVENTION of this contract, are hereby supplemented as follows. The updated manual can be found at the following website:

A. The CONTRACTOR shall designate an employee responsible for overall supervision of accident prevention activities. Such duties shall include: (1) assuring applicable safety requirements are incorporated in work methods and (2) inspecting the work to ensure that safety measures and instructions are actually applied. The safety plan must be submitted in writing for acceptance by the Contracting Officer's Representative. The designated individual must be able to demonstrate his/her familiarity and understanding of the safety requirements over a prescribed trial period. The safety supervisor shall have the authority to act on behalf of the CONTRACTOR'S general management to take whatever action is necessary to assure compliance with safety requirements. The safety supervisor is required to be on the site when work is being performed.

B. Prior to commencement of any work at a job site, a pre-construction safety meeting shall be held between the CONTRACTOR and the Corps of Engineers Contracting Officer's Representative to discuss the CONTRACTOR'S safety program and in particular to review the following submittals:

(1) CONTRACTORS Accident Prevention Plan: An acceptable accident prevention plan, written by the prime CONTRACTOR for the specific work and implementing in detail the pertinent requirements of EM 385-1-1, shall be submitted for Government acceptance.

(2) Activity Phase Hazard Analysis Plan: Prior to beginning each major phase of work, an activity hazard analysis (phase plan) shall be prepared by the CONTRACTOR for that phase of work. A phase is defined as an operation involving a type of work presenting hazards not experienced in previous operations or where a new subcontractor or work crew is to perform work. The analysis shall address the hazards for each activity performed in the phase and shall present the procedures and safeguards necessary to eliminate the hazards or reduce the risk to an acceptable level.

3.2. Accidents: Accidents are to be investigated by both CONTRACTOR personnel and the Contracting Officer.

ACCIDENT REPORTING, ENG FORM 3394: Section I, Paragraph 01.D, of EM 385-1-1 and the Contract Clause entitled ACCIDENT PREVENTION are amended as follows: “The prime CONTRACTOR shall report on Eng.

Form 3394, supplied by the Contracting Officer, all injuries to his employees or subcontractors that result in lost time and all damage to property and/or equipment in excess of $2,000 per incident. Notification of such accident shall be made to the Contracting Officer Representative immediately. A written report on the above noted form shall be submitted to the Contracting Officer’s Representative within 24 hours following such accidents. The written report shall include the following:

3.3. Applicable OSHA Requirements are expected to be followed.

3.4. OSHA Inspections: CONTRACTORS shall immediately notify the Contracting Officer's Representative when an OSHA Compliance official (Federal or State representative) presents his/her credentials and informs the CONTRACTOR that the workplace will be inspected for OSHA compliance. CONTRACTORS shall also notify the Contracting Officer's Representative upon determination that an exit interview will take place upon completion of the OSHA inspection. (NABSA OCT 05, 1976)

4. QUALITY CONTROL

4.1. The Contractor shall be responsible for maintaining adequate quality control to satisfactorily meet the specification of this contract. The government will assure quality performance through site inspections, and invoice review.

4.2. The Contractor shall establish a quality control program to assure the requirements of the contract are provided as specified under all sections of the contract.

4.3. The Government shall monitor the Contractor’s services by conducting site inspections. The Government reserves the right to alter or change the type of inspection plan at its discretion.

4.4. The Contractor shall designate an on-site representative who has the authority to make decisions, monitor the job for safety and act as an official agent for the contractor in the contractual relationship with the government.

This representative or a designee shall be capable of telephonic or personal communication during work hours.

5. CONTRACT PERIOD

5.1. The Contractor shall be prepared to commence activities within thirty (30) days following the receipt of Notice to Proceed. Actual on-ground activity will be coordinated between the COR and the Contractor. All work is to be completed and invoiced within 120 days from the Notice to Proceed. Services will be performed continuously as required by the Contracting Officer or his Authorized Representative during the contract period to accomplish the work. At the option of the Government, the contract period may be extended a maximum of thirty (30) days.

5.2. The Contractor is required to perform work between the hours of 0630 a.m. and 430p.m, Monday thru Friday, excluding federal holidays. Work performed other than previously specified is to be approved in advance by Contracting Officer.

6. WEATHER AND LIQUIDATED DAMAGES

6.1. Liquidated Damages - The work shall be completed within 180 from Notice to Proceed. Liquidated damages in the amount of $150.00 per day shall be accessed for each day over the allotted time. Weather days, not counting against the work time, shall be allotted at the discretion of the Contracting Officer's Representative.

6.2. The following schedule of monthly anticipated adverse weather delays is based on the National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations.

6.3. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the CONTRACTOR will record on a daily ledger, the occurrence of adverse weather and the resultant impact to normally scheduled work.

Actual adverse weather delay days must prevent work on critical activities for 50% or more of the CONTRACTOR’S scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph

6.2. Above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent full weather work days and issue a modification for contract extension.

7. ACCESS AND GENERAL PROTECTION/SECURITY POLICY AND PROCEDURES

7.1 All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

8. CONTRACT REQUIREMENTS FOR ANTITERRORISM/OPERATIONS SECURITY.

8.1 The Contractor must pre-screen Candidates using the E-verify Program (http://www.dhs.gov/E-Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

8.2 All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

8.3 The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

8.4 All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas."

9. INSURANCE

Pursuant to the contract clause entitled, Insurance—Work on a Government Installation, the Contractor shall procure and maintain during the entire period of his performance under the contract the following minimum insurance.

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 30 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 60 days. The time stated for completion shall include final cleanup of the premises.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is [Contracting Officer shall insert description of the geographical areas where the contract is to be performed, giving the State, county, and city].

52.225-9 BUY AMERICAN—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. As used in this clause--

Commercially available off-the-shelf (COTS) item—

(1) Means any item of supply (including construction material) that is--

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4) such as agricultural products and petroleum products.

Component means an article, material, or supply incorporated directly into a construction material.

Construction material means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.

Materials purchased directly by the Government are supplies, not construction material.

Cost of components means--

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

Domestic construction material means--

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if--

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

Foreign construction material means a construction material other than a domestic construction material.

United States means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American Act to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American Act. (1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including--

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;
