(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

Vision Statement

Provide a safe working environment for building occupants.

1. Scope The Contractor shall provide all labor and material to repair and/or replace Deep Well #1 Pump, SB Bldg 1580, Island of Oahu, Hawaii. The Contractor shall perform all work in accordance with Occupational, Safety and Health Administration (OSHA), Federal, State, and County regulations and commercial standards.

2 General Requirements This section describes the general requirements for this effort. The following sub-sections provide details of various considerations on this effort.

2.1 Non-Personal Services

The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.

2.2 Business Relations

The contractor shall successfully integrate and coordinate all activity needed to execute the requirement.

The contractor shall manage the timeliness, completeness, and quality of problem identification. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

2.3 Contract Administration and Management

The following subsections specify requirements for contract, management, and personnel administration.

2.3.1 Contract Management

The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between the support operations at the Directorate of Public Works (DPW) Service Contract Branch and the contractor's corporate offices.

2.3.2 Contract Administration

The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The contractor shall have a single point of contact between the Government and Contractor personnel assigned to support contracts or task orders. The contractor shall assign work effort and maintaining proper and accurate time keeping records of personnel assigned to work on the requirement.

2.3.3 Personnel Administration

The contractor shall provide the following management and support as required. The contractor shall provide for employees during designated Government non-work days or other periods where Government offices are closed due to weather or security conditions. The contractor shall maintain the currency of their employees by providing initial and refresher training as required to meet the PWS requirements. The contractor shall make necessary travel arrangements for employees. The contractor shall provide necessary infrastructure to support contract tasks. The contractor shall provide administrative support to employees in a timely fashion (time keeping, leave processing, pay, emergency needs).

2.4 Subcontract Management

The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. Contractors may add subcontractors to their team after notification to the Contracting Officer Representative (COR). Cross teaming may or may not be permitted.

2.5 Contractor Personnel, Disciplines, and Specialties

The contractor shall accomplish the assigned work by employing and utilizing qualified personnel with appropriate combinations of education, training, and experience. The contractor shall ensure the labor categories as defined in the Labor Categories document (see attachment), labor rates, and man-hours utilized in the performance of each Task Order (PWS line item) issued hereunder will be the minimum necessary to accomplish the task The Contractor shall provide the necessary resources and infrastructure to manage, perform, and administer the contract.

2.6 Location and Hours of Work

Accomplishment of the results contained in this PWS requires work at SB Bldg 1580, Island of Oahu, Hawaii, Monday through Friday between the hours 7:30 a.m. to 4:00 p.m. except US Federal Holidays.

3 Performance Requirements The following section specifies the Performance Objectives and Performance Elements for the contract.

3.1 Repair/Or Replace Deep Well #1 Pump

The Contractor shall repair and/or replace Deep Well #1 Pump, SB Bldg 1580, Island of Oahu, Hawaii.

The p ump is seized and unable to spin causing an alarm on the starter/controls. The Contractor shall remove and dispose of all debris/waste at the end of the workday from work site per applicable federal, state and local requirements. The Contractor shall provide Warranty of services for 90 days for repairs and replacement parts. In the event any replacement parts fail within the manufacturer’s warranty period, the Contractor shall arrange for replacement of the defective parts at no additional cost to the Government

4.2 IWATCH TRAINING

IWATCH within the Army is a nation-wide modern version of a neighborhood watch program focused on the threat of terrorist activity. It is an antiterrorism awareness program that the contractors' workforce, while on Army installations, must be all familiar with to promote and enhance reporting suspicious activity or behavior. The program has two elements: "passive" and "active". The passive element is an individual's situational awareness of his or her surroundings. The active element of IWATCH involves individuals taking action to report suspicious behavior or activities to law enforcement for more investigation.

Contractor personnel, to include subcontractors, performing on or within an Army controlled facility, area or on an Army installation are required to brief and train their personnel on line at IWATCH Training US Army. Contractor personnel shall train all personnel within 5 days of contract award or within 5 days of hiring action. Contractors shall report all completed training to the COR within 7 days of contract award or hiring action.

4.3 Government Furnished Materials

Water and electricity required for the performance of the work covered by this contract will be furnished to the Contractor at no additional cost. Utilities required will be obtained by utilizing existing outlets located throughout the facilities.

5 Deliverables

5.1 Enterprise Contractor Manpower Reporting Application (ECMRA) The ECMRA is a business process that has been approved by the Army as a means for collecting information on contracts that provide services to the Department of the Army. Contractors are required to register and report information via the CMRA website located at Error! Hyperlink reference not valid.. Additional information such as links to user guides, frequently asked question and help desk information is available via the CMRA website.

For this requirements type contract, reporting is required for each task order issued, and shall be entered via the ECMRA website. Completed report(s) may be submitted at any time after a completion of each task order but no later than Oct 30 of each year. Data must be accurate and complete and shall be reported separately for each fiscal year that falls within the period of performance. The Federal Government's Fiscal Year is Oct 1 through September 30.
