FOR

SPRUNG STRUCTURE SHIELD REQUIRMENT

1. DESCRIPTION OF SERVICES. Contractor shall furnish all labor, equipment, supplies, transportation and materials to include necessary to replace membrane for the sprung structure located at the Fort Shafter VCC/Buckner Gate entrance to the installation.

1.2 QUALIFICATIONS.

1.2.1 Trash from all installation products or materials shall be removed and disposed of properly in accordance with all Federal and State regulations. Under no circumstance shall any material be disposed of or left on Government property.

1.2.2 Worker Safety. The contractor and his personnel shall comply with all requirements of the Occupational Safety and Health Act. The contractor shall ensure that all personnel are provided with adequate safety equipment and clothing.

1.2.3 Number of Workers per job. The Government requires the contractor send no less than three (3) workers to every field job for safety reasons and be in compliance with OSHA requirements.

1.3 SPECIFIC TASKS.

1.3.1. The contractor shall prepare and submit to the Coordinator for approval a design plan prior to the start date of the requirement. This plan shall include all aspects of the replacement of the exterior membrane of the sprung shelter. Sprung membrane replacement shall be installed using external applications. Replacement includes replacing the covering and all components for a 50’ wide x 30’ long “Classic Series” Structure, 2x cable tensioned end panels, 2x bays cable bracing, 1x interior office w/ single personnel Door w/ top Lite. Existing vents/windows on the sprung shelter shall be removed and re-installed at appropriate areas to complete the installation. Upon COR approval of the design plan the contractor shall begin work. The plan shall be revised, at no additional cost, until accepted by the COR.

1.3.2 The contractor shall provide an adequate supply of tools, materials, and equipment to complete a full line of repair/replacement requirements. All work must be in accordance with the Sprung manufacture requirements and specifications to ensure integrity throughout project.

1.3.3 The contractor shall remove all dirt and debris from the work site. All debris shall be removed off premises by the contractor and disposed of accordingly. Upon completion structures shall be free of dirt, and all other debris.

1.3.4 Upon completion of the work, the contractor shall contact the COR to set a date and time to inspect work. The contractor shall re-perform, at no cost to the Government, any work deemed unsatisfactory by the Coordinator.

1.3.5 Worker Safety. The contractor and his personnel shall comply with all requirements of the Occupational Safety and Health Act. The contractor shall ensure that all personnel are provided with adequate safety equipment and clothing.

1.4 DAMAGE TO STRUCTURE.

1.4.1 The contractor shall be responsible for any damages incurred to structure and/or any other real property or equipment in place during performance of this contract. The contractor shall repair/replace damage and restore the facility/equipment back to the condition in which it was found. Should damage occur, the contractor shall notify the COR within one (1) hour of discovery. All repairs requires prior approval and acceptance by the COR and/or government representative prior to commencement of work.

2. PERFORMANCE REQUIREMENT SUMMARY (PRS). Contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

Weather conditions 4.3.3 The contractor shall submit in writing within 4 hours to the COR of work stoppage due to inclement weather conditions 100% of the time.

The contractor will submit a new schedule to the COR within 4 hours after work stoppage

4.6 Must be submitted within 30

days after the end of the contract performance period 100% of the time.

The contractor is required to complete this form by the Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs)

3. GOVERNMENT FURNISHED UTILITIES/FACILITIES.

3.1 The Government will furnish water and electricity from existing fixtures and outlets at no cost to the contractor. The contractor shall carefully conserve utilities furnished without charge.

3.2. Prior to start of work, the contractor shall verify with the Coordinator that all utilities to include water and electrical connections don’t affect facilities by this resulting work.

3.3 At the end of the work day, the contractor shall disconnect any electrical equipment connection to the utility source.

4. SPECIAL PROVISIONS.

4.1 QUALITY CONTROL. The contractor shall maintain a quality control program to ensure services are performed in accordance with commonly accepted commercial practices.

4.2. PERFORMANCE ASSESSMENT. The Government will evaluate the contractor’s performance under this contract using the Performance Assessment Plan. The Government reserves the right to inspect the equipment with or without notice to the contractor, and in such detail as deemed necessary.

4.3 WORK SCHEDULE

4.3.1 The contractor shall normally perform work between the hours of 8:00 a.m. to 4:00 p.m., Monday through Friday, excluding Federal holidays. The contractor shall coordinate the scheduling of the work with the Coordinator. The performance period for this requirement will be determined after contract award. After-hours work is not authorized.

4.3.2 Inclement Weather: Should inclement weather prevent performance of work the contractor shall notify the COR. The contractor shall submit a new schedule, in writing within 4 hours after notifying the COR of the work stoppage.

4.4 CONTRACTOR-FURNISHED ITEMS.

4.4.1 TRANSPORTATION

4.4.2 The contractor shall have signs on all service vehicles used in the necessary performance of this contract. Signs shall be placed on each side of the vehicle; lettering shall be a minimum of three (3) inches high and the style bold. It shall have the Company name and phone number.

Magnetic sign is acceptable. The contractor’s employees shall carry at all times, identification containing the employees name and name of company represented.

4.4.3 The contractor shall provide all equipment, materials, tool, services and transportation to perform the requirements of this contract.

4.5 WARRANTY. The contractor shall warrant his work for a period of one (1) year from completion of installation of all parts/services and shall respond within 24 hours to any callback for problems resulting from his work.

4.6 CONTRACTOR MANPOWER REPORTING (CMR) REQUIREMENT.

4.6.1 The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the re-skin sprung structure located at Buckner Gate on Fort Shafter Hawaii via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address http://www.ecmra.mil/, and then click on “Department of Army CMRA” or the icon of the DoD organization that is receiving or benefitting from the contracted services.

Reporting inputs will be for labor executed during the period of performance during each Government fiscal year (FY), which runs Oct 1 through September 30. While inputs may be reported any time during the FY, all data reported no later than October 31 of each calendar year, beginning with 2013. Contractors may direct questions to the help desk by clicking on “Send an email” which is locted under the Help Resources ribbon on the right side of the login page of the applicable Service/Component’s CMR website.”

Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.

5. Security and Safety Anti-Terrorism (AT) and Operational Security (OPSEC).

5.1. IWATCH TRAINING

IWATCH within the Army is a nation-wide modern version of a neighborhood watch program focused on the threat of terrorist activity. It is an antiterrorism awareness program that the contractors' workforce, while on Army installations, must be all familiar with to promote and enhance reporting suspicious activity or behavior. The program has two elements: "passive" and "active". The passive element is an individual's situational awareness of his or her surroundings.

The active element of IWATCH involves individuals taking action to report suspicious behavior or activities to law enforcement for more investigation. Contractor personnel, to include subcontractors, performing on or within an Army controlled facility, area or on an Army installation are required to brief and train their personnel on line at IWATCH Training US Army.

Contractor personnel shall train all personnel within 5 days of contract award or within 5 days of hiring action. Contractors shall report all completed training to the COR within 7 days of contract award or hiring action.

DESCRIPTION OF SERVICES

Contractor shall furnish all labor, equipment, supplies, transportation and materials to include necessary to replace membrane for the sprung structure located at the Fort Shafter VCC/Buckner Gate entrance to the installation.

This acquisition is being procured as a 100% Small Business set-aside.

Basis for Award This requirement will be awarded utilizing FAR 13 and evaluated as Lowest Price Technically Acceptable.

All potential offerors are required to complete and return clause 252.209-7992 with offer.

Site Visit A site visit is scheduled for Wednesday September 16, 2015 at 10am HI Standard Time. Meet at Buckner Gate, Sprung Structure, Fort Shafter, Hawaii. Allow additional time for installation access and parking. Please be prompt.

The purpose of this site visit is provide clarity on any questions that may arise for this requirement. Offerors and/or representatives are encouraged to attend this site visit. If you are interested in attending, submit all attendee's names, e-mail addresses, cell phone and work numbers to Angela McColor at angela.u.mccolor.civ@mail.mil no later than Tuesday September 15, 2015 at 2pm HI Standard Time. If no interest is received by this time, the Government will cancel the planned site visit. If cancelled, no other site visit will be scheduled. Picture taking will allowed during the site visit only for materials/subjects directly related to this requirement.

Attendance constitutes agreement to release the Government of liabilities due to any accidents or injury occurring during the site visit. Any discussions, remarks, and explanations that may be made by the Government representative during the site visit will not change the terms of the solicitiation and the technical specifications unless the solicitation is amended in writing.

Directions to the Site Visit Fort Shafter is located in Honolulu, extending up the ridgeline between Kalihi and Moanalua valleys. It is located just off H-201. All visitors to Fort Shafter must enter through the Buckner Gate.

From Honolulu: Take H-1 West towards Waianae. Follow signs and take a slight left at H-201 West towards Aiea. Follow signs for Fort Shafter.

From Central Oahu or the North Shore: Take HI-99/Kamehameha Highway towards Honolulu.

Merge onto H-2 South. Merge onto H-1 East towards Honolulu. Take exit 13B to merge onto H- 201 East. Follow signs to Fort Shafter.

From the Windward Coast: Take H-3 West towards Pearl Harbor. Take exit 1B to merge onto HI-78 East/H-201 East towards Honolulu. Follow signs to Fort Shafter.

From the Leeward Coast: Take H-1 East towards Honolulu. Take exit 13B to merge onto H-201 East. Follow signs to Fort Shafter.

ADDENDUM TO 52.212-2

The basis for award will be Lowest Price Technically Acceptable (LPTA). The quote will be evaluated and assigned a rating of acceptable or unacceptable. There is one (1) major technical factor:

Technical Approach. This factor along with Price, serve as meaningful discriminators. During the evaluation, if an Offeror receives a consensus "unacceptable" for the major technical factor, that Offeror will then be considered ineligible for further award consideration.

i. Technical Approach - The offerors' Technical Approach will be evaluated and assigned a rating of Acceptable or Unacceptable based on the following minimum requirement:

1. Contractor must send no less than three (3) workers to every field job for safety reasons and be in compliance with OSHA requirements.

Demonstration of a thorough understanding of all requirements will receive an acceptable rating.

Inadequate demonstration of thorough understanding of what the requirement entails will receive an unacceptable rating.

ii. Price - Evaluation of reasonableness will be based on competition.

Past Performance will not be evaluated factor, although the contracting officer will use past performance to assess contractor responsibility IAW FAR 9.1.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (a) Definitions. As used in this provision --

It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

Veteran-owned small business concern means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

"Women-owned small business concern" means a small business concern--

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or

(2) Whose management and daily business operations are controlled by one or more women.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127)”, means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
