Control No. 11-24
Abbreviated Justification and Approval Document
FOR OTHER THAN FULL AND OPEN COMPETITION
of Requirements Not Exceeding $550,000 (IAW FAR 6.304)
1. Contracting Activity: Regional Contracting Office Hawaii, 413th, Contracting Support Brigade
2. Description of Action: Emergency Relocation of Government Owned Refuse Containers in Support of FPCON Bravo
Requirement: X New Repeat Pricing: X Firm-Fixed Price Time & Materials Cost Funds: X OMA Other Funds:
Name of Proposed Contractor: Rolloffs Hawaii, LLC Street Address: 1020 Ulupono Street City, State, Zip: Honolulu, Hawaii 96819-4333 Phone: 808-864-0429 (Kris Gourlay)
3. Description of Services: The estimated value of the proposed action is $61,000.
Describe the services or supplies, including make & model number, to be acquired below.
4. Authority Cited:
(a) 10 USC 2304(c)(1) or 41 USC 253(c)(1); FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements OR
(b) 10 USC 2304(c)(2) or 41 USC 253(c)(2); FAR 6.302-2: Unusual and compelling urgency.
The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other items and services necessary to perform emergency relocation of Government owned refuse containers.
Refuse containers of various sizes (3 cubic yards, 8 cubic yards and roll offs) are located at various locations on Army Installations, Island of Oahu, Hawaii. The contractor shall perform to the standards in the contract and comply with all local, state, and federal regulations. This requirement supports FPCON Bravo as directed by Garrison Commander on 1 May 2011.
5. Reason for Authority Cited: (State why this is the only source that can provide the required supplies or services.)
(a) Services can only be provided from the original source as this is a follow-on requirement for the continued provision of highly specialized services.
(b) Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.
(c) Services/Supplies are needed immediately to satisfy mission requirements.
(d) Additional Information: Nationwide FPCON Bravo activated on 1 May 2011.
Security measures in support of FPCON Bravo requires dumpsters to be located 25 meters (82’ feet) from structures. DPW identified 84 dumpsters that do not meet this criteria and must, therefore, be relocated for compliance.
(i) What harm will come to the Government if desired supplies/services are not provided on time?
(ii) What harm will come to the Government if desired contractor doesn't receive the award?
6. Actions to Increase Competition: None for this requirement.
7. Market Research: (Describe the extent of the market research conducted to identify all qualified sources and the results thereof. "Market Research" is defined as those attempts you made to ascertain whether other qualified sources exist. Research of the market place may consist of written, telephonic, or world wide web inquiries.)
8. Procurement History:
Garrison will not meet their FPCON Bravo mission requirements in a heightened security environment.
There will be compliance delays or no refuse collection services to the relocated containers. The incumbent contractor currently provides pickup and disposal service of all Government generated refuse. Government is not relocating 100% of it’s current inventory, only selected areas designated for FPCON BRAVO compliance. The incumbent contractor will be provided with an updated list of the relocation sites.
Due to urgency, intent is to utilize incumbent refuse contractor for relocation services, therefore, market research to seek other qualified providers was not conducted.
Previous Contract or Purchase Order Number: W912CN-09-C-0052 (Current refuse contract) or N/A Previously competed? N/A No Yes Previous authority for less than Full & Open Competition: FAR 6.302-2: Unusual and compelling urgency.

10. Fair and Reasonable Determination:
Based on comparison of market research of pricing from other commercial refuse service providers, I hereby determine that the anticipared cost to the Government for this contract action will be fair and reasonable.
11. Contracting Officer’s Approval: Based on the foregoing, I approve the one time award to relocate various refuse containers in accordance with FAR 6.302-2 and subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
