JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity: Regional Contracting Office, Hawaii (RCO-HI), 413th
Contracting Support Brigade.
2. Description of Action: Extension of contract W91QUZ-06-D-0016-CJ01 for six (6) months from 29 March 2012 – 28 September 2012, for the Information Technology Support Services for the 9th Mission Support Command (MSC) under authority of FAR 52.217-8, Option to Extend Services. Computer Hardware Enterprise Software and Solutions (CHESS) basic master contract for this ID/IQ delivery order included FAR 52.217-8 but did not compete the cost of extension periods. Estimated value of this action is XXXX; OMA funds will be used, and current contract expires on 28 March 2012.
3. Description of Supplies/Services: IT Support Solution services include consulting, design, implementation, and management of Wide Area Networks/Local Area Networks (WAN/LAN) and all IT systems for the Army Reserve Pacific operated by or under the control of 9th MSC Regional Network Operations & Security Center – Army Reserves (RNOSC-AR). The total estimated value of the six (6) month extension is XXXX.
4. Authority Cited: 10 U.S.C. 2304(c) (2), as implemented by FAR 6.302-2, Unusual and compelling urgency.
5. Reason for Authority Cited: Pursuant to FAR 6.302-2(a) (2), the need for this service is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
A delay in award would result in the following: severe degradation to the mission of the 9th MSC in providing trained and ready Army Reserve forces in support of Pacific Command (PACOM), US Army Pacific (USARPAC), and US Army Reserve missions;
adversely affect the command and control of all Army Reserve forces in the Pacific;
significantly degrade the 9th MSC ability to mobilize Army Reserve personnel and equipment in support of Operation Enduring Freedom (OEF) and conduct mobilization/demobilization activities; and suspend the provision of twenty-four hours a day and seven days a week (24X7) Command, Control, Communications, Computers, and Information Management (C4IM) service support to over 3500 Army Reserve Soldiers stationed in Hawaii, Alaska, Guam, American Samoa, Saipan, Korea, and Japan.
The follow-on contract is in the pre-solicitation phase with solicitation W912CN-12-R- 0007. DD2579 was submitted to Small Business Administration Procurement Center Representative (SBA PCR) on 15 December 2011. Due to the non-concurrence by the SBA PCR of the Contracting Officer’s recommendation to issue solicitation unrestricted through CHESS ITES-2S Contractors on 24 January 2012, continuation of the pre-solicitation approval process has been significantly delayed. The decision to use a small business set aside was finally made on 26 January2012, and has impacted the milestones for a new contract award.
The current contract W91QUZ-06-D-0016-CJ01 will expire on 28 March 2012. The strategy includes a 30-day transition period to mitigate any degrading of services.
Sufficient time no longer remains to solicit, award, and commence with a phase-in period before the expiration of the contract. A competitive procurement of a bridge contract is not feasible as this too will likely result with a lapse in service, as a minimum of 120 days is the standard Procurement Acquisition Lead Time for procurement of this estimated value contract. This contract also includes access to classified data and the need for security clearances for contractor employees, which could not be procured in time to avoid a lapse in service should the bridge contract be issued to someone other than XXXX the incumbent contractor.
This justification is requesting a total of six (6) months however, the RCO intends to only use the minimum necessary to issue a new award. At this time a 4 month extension bridge is planned with two one month options to be exercised in the event of further unforeseen delay.
6. Efforts to Obtain Competition: A competitive action for this extension would lead to delay and a lapse in service. A Federal Business Opportunities notice will be issued to announce the Government’s intent to issue a sole-source extension XXXX.
7. Actions to Increase Competition: The renewal solicitation, W912CN-12-R-0007, is set to be solicited as a small business set-aside to reach as many small businesses as possible.
8. Market Research: Market research conducted on 29 November 2011 of local companies in Hawaii along with the acquisition processing time has indicated the transition/phase-in period could not be met by 28 March 2012 without a break-in service. The Government currently does not have in-house resources to handle this requirement. This extension is to prevent a potential break in service.
9. Interested Sources: Due to pending solicitation action, no sources were sought for this six month extension period. Various small businesses have expressed interest in the renewal of the full contract.
10. Other Facts:
a. XXXX has been performing the contract requirement for the past three (3) years. The contract was competed under the CHESS ITES-2S contracts.
b. Procurement History: The US Army Reserve Theater Support Group –
Directorate of Information Management (USAR TSG IMD) has a re-occurring IT Support Services performance-based requirement. Previous contracts are identified below: Contract DABQ06-03-F-0273 was competed unrestricted under the GSA ANSWER program (IT procurement vehicle). XXXX, and XXXX was the highest rated offeror and the SSA determined the additional cost for the additional level of service to be most advantageous to the Government under best value trade off evaluation.
c. Contract W91QUZ-06-D-0016-CJ01 was competed unrestricted under the
ASCP CHESS ITES-2S program (IT procurement vehicle) with XXXX large firms submitted proposals, and no small businesses provided any proposals.
XXXX was the highest rated offeror under best value trade off evaluation with the lowest proposed price.
